SpaceX is facing another NLRB complaint.

SpaceX already filed one lawsuit claiming the agency’s actions o (on a complaint about workers who say they were fired illegally for criticizing Elon Musk) are unconstitutional and now there’s this complaint issued Wednesday night.

SpaceX is accused of using severance agreements with ”unlawful confidentiality and non-disparagement clauses, and an unlawful limit on participation in other claims against SpaceX,â€ among other issues. The parties can either settle (seems unlikely), or there will be a hearing on October 29th.

Vernor Vinge, science fiction writer and creator of the concept of the technological singularity, has died at the age of 79.

According to Ars Technica, Vinge, a professor and computer scientist who was well-known for his hard science fiction novels such as A Fire Upon the Deep and Rainbow’s End, passed away yesterday. A truly excellent author, he postulated that AI will one day surpass the understanding of its human creators; he described this singularity theory in a 1993 essay. But it is probably for his far-reaching and absorbing fiction that Vinge will be best known.

Meta CEO Mark Zuckerberg has announced that WhatsApp is rolling out the option to pin as many as three messages to the top of a chat, up from the single message that’s been possible to pin since late last year. You should read this epic story from 2000 on the Microsoft antitrust trial.

I reread this massive Wired piece this morning on the train, a propos of, you know, things. It’s an incredible tale of antitrust warfare, and it’s wild how much of what the DOJ said and did about Microsoft rhymes with today’s lawsuit against Apple.

I’d bet that Tim Cook saying “buy your mom an iPhoneâ€ will become an iconic legal phrase the way “cut off Netscape’s air supplyâ€ did 25 years ago.

The agency is requesting information from the carriers around how they collect and handle people’s personal data, as well as complaints that information was mishandled in violation of the law. USDOT did not say specifically what incident prompted the review.

US Attorney General Merrick Garland kicks off DOJ press conference on Apple suit.

“Apple has maintained monopoly power in the smartphone market, not simply by staying ahead of the competition on the merits, but by violating federal antitrust law,â€ Garland said.

He also referenced the so-called Apple tax that the company charges for in-app purchases.

“Buy your mom an iPhone.â€

Debates over green bubbles, iMessage, and RCS came to a head in this moment from the 2022 Code Conference when LiQuan Hunt asked Tim Cook about messaging across platforms. Leading to today, when Hunt’s question and Cook’s response came up on page 39 of the DOJ’s antitrust complaint against Apple.

In 2022, Apple’s CEO Tim Cook was asked whether Apple would fix iPhone-to-Android messaging. ‘It’s tough,â€ the questioner implored Mr. Cook, ‘not to make it personal but I can’t send my mom certain videos.â€ Mr. Cook’s response? ‘Buy your mom an iPhone.â€

Correction: it’s on page 39, right 92.

Today’s Decoder explains everything you need to know about the EU’s Digital Markets Act.

The Justice Department just announced a long-awaited, massive antitrust suit against Apple. Those antitrust suits big but slow-moving are the primary way the US is challenging big tech.

But across the Atlantic, the European Union has been hard at work enforcing what’s known as the Digital Markets Act, a sweeping regulation that went into effect earlier this month that’s aimed at leveling the playing field between big tech and smaller competitors. Apple, in particular, has been engaging in what we can only describe as “malicious compliance.â€

Verge reporter Jon Porter, who’s been covering EU regulation for years, joined me on Decoder to break down which companies qualify as “gatekeepers,â€ what new rules they have to follow, and what this means for the future.

What’s one more Tesla investigation among friends?

Massachusetts Senator Elizabeth Warren (D) would like the Securities and Exchange Commission to investigate Tesla over the lack of independence of its board of directors from Elon Musk, according to the Wall Street Journal. Tesla’s board, which includes Musk’s brother and a number of the billionaire’s friends, poses a potential conflict of interest, that could harm shareholders, Warren alleges. The SEC, which has investigated Tesla more times than I can remember, declined to comment on its response to Warren.

A movie based on EA’s The Sims game series is on the way from director / co-writer Kate Herron (Loki) with Margot Robbie’s LuckyChap producing.
