The Constitution and the Presidential Succession Act spell out what happens if a President dies, resigns, is unable to serve, or is removed from office. The Vice-President is immediately sworn in and becomes the new President. There is no special election for President.

We are NOT At War with Russia! and therefore they are NOT an "ENEMY".

As I discussed earlier with another Redditor further in this thread, it's common misconception that they US must be at war with a foreign power before treason may be charged. Adam Pearlman (aka Adam Gadahn) was the most recent person charged with treason and there was no formal declaration of war.

Treason can only occur when an American helps a power against which Congress has issued a formal declaration of war.

That's not what the constitution says. Per the USC (emphasis added): "Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. "

Adhere in this context is a somewhat archaic way of saying to support or to owe allegiance to.

Aaron Burr, for instance, was charged with treason but no foreign power was involved. Most recently, Adam Pearlman was charged with treason for his support of Al Qaeda; Congress had not passed a declaration of war against AQ because it was not a sovereign state.

The law is vague as to what constitutes an enemy; the stare decisis is thin as to what is and is not an enemy but it does not require a declaration of war.
