Moral Constructivism

Among the available metaethical views, it would seem that moral realism—in particular moral naturalism—must explain the possibility of moral progress. We see this in the oft-used argument from disagreement against various moral realist views. My suggestion in this paper is that, surprisingly, metaethical constructivism has at least as pressing a need to explain moral progress. I take moral progress to be, minimally, the opportunity to access and to act in light of moral facts of the matter, whether they are mind-independent (...) or -dependent. For the metaethical constructivist, however, I add that moral progress ought also mean that agents come to be or could come to be motivated to act in light of the right kind of moral judgments. Together I take this to mean that, for all forms of constructivism, moral progress must be explained as a form of moral improvement, or agents aspiring to be better sorts of moral agents. In what moral improvement consists differs for various forms of constructivism. Here I distinguish between three different versions of metaethical constructivism: Humean constructivists as represented by Street (2008; 2010; 2012), Kantian constitutivist constructivists as represented by Korsgaard, and constructivists about practical reason as represented by Carla Bagnoli (2002; 2013). I conclude by showing that only constructivism as a view about practical reason can fully account for moral progress qua the opportunity for moral improvement. (shrink)

This chapter aims to situate Kant’s account of practical reason in metaethical debates. First, it explains the reasons why it is legitimate and instructive to discuss Kant’s relevance in contemporary metaethics, hence addressing some issues about the intended scope of metaethics and its relation to practical reason and psychology. Second, it defends an interpretation of Kant’s conception of autonomy, which avoids some paradoxes traditionally associated with self-legislation. Third, it shows that constructivism best captures Kant’s conception of practical reason and of (...) its authority. Kantian constructivism is defended as a self-standing metaethical theory, which is designed to account for the objectivity and unconditional authority of practical knowledge, on the basis of standards congruent with shared subjective experience. This version of constructivism, adopting a “dialogical” interpretation of the autonomy of rational will, explains how finite rational agents are obligated and bound by the moral law. (shrink)

It is largely agreed that if constructivism contributes anything to meta-ethics it is by proposing that we understand ethical objectivity “in terms of a suitably constructed point of view that all can accept” (Rawls 1980/1999: 307). Constructivists defend this “practical” conception of objectivity in contrast to the realist or “ontological” conception of objectivity, understood as an accurate representation of an independent metaphysical order. Because of their objectivist but not realist commitments, Kantian constructivists place their theory “somewhere in the space between (...) realist and relativist accounts of ethics” (O’Neill 1988: 1). Furthermore, they argue that their practical conception of objectivity succeeds in making sense of certain features of morality, such as its categorical authority and its relation to rational agency, which escape rival theories (Korsgaard 1996b, Korsgaard 2003b). To this extent, constructivism claims a privileged place in meta-ethics. The legitimacy of this claim is widely challenged. Precisely because of its practical conception of objectivity, many – including some constructivists — regard constructivism as a first-order normative theory, rather than as a meta-ethical position, hence not on a par with realism. Some critics object that constructivism fails to offer a distinct meta-ethics because it is structurally incomplete and thus must be combined with a fully-fledged meta-ethics (Hussain and Shah 2006); others argue that it tacitly relies on realism (Timmons 2003; Shafer-Landau 2003; Larmore 2008). Thus far, the debate about the prospects of constructivism as a meta-ethical theory has been driven by the conviction that the case for or against constructivism depends on its ontological commitments. In this chapter, I propose a change in perspective. My aim is to defend constructivism as an objectivist account of practical knowledge. Its defining feature is the claim that practical knowledge is knowledge by principles. Its task is to establish a constitutive relation between knowledge of oneself as a practical subject and knowledge about what one ought to do. By focusing on the issue of practical knowledge I hope to show that the difficulty in situating Kantian constructivism firmly on the meta-ethical map, along with other meta-ethical theories, reflects ambiguities and oscillations about the practical significance of ethics. Even though the term is ambiguous, I retain the qualification “Kantian” for the constructivist theory I outline, and for two reasons. First, while the theory I outline differs from current agnostic or anti-realist variants, it is closer to its origins, since Kant treats practical reason as a cognitive capacity and takes moral judgments to be objective moral cognitions, which importantly differ from other sorts of rational cognitions because they bind us in the first person. Practical cognitions are common knowledge because they are such that all subjects endowed with rationality can arrive at them by reasoning and find them authoritative. Thus understood, Kantian constructivism carves a distinct logical space in the meta-ethical debate that other sorts of constructivism fail to identify. This is the second reason for keeping the qualification “Kantian”. On this formulation, constructivism is antagonistic to non-cognitivist theories denying that moral judgments have cognitive contents, because they deny that there is something to be known; but it is also a rival to cognitivist theories denying that knowledge can be practical in itself. How constructivism differs over the realist theories of practical reason is the least understood aspect of this debate. This essay aims to make the case that practical reason is both discursive and emotional. In contrast to foundational and anti-realist accounts of practical reasoning, it attempts to show that the moral feeling of respect plays a cognitive but non-evidential role in the account of the cognitive and practical powers of reason. The argument proceeds as follows. In section 1, I consider some prominent constructivist arguments against the model of applied knowledge and show that they are driven by non-cognitivist assumptions about the practicality of ethics and the legitimacy of epistemological claims. In section 2, I argue that these arguments do not succeed in disposing of the idea of practical knowledge as incoherent, because they trade on an ambiguity regarding the proper object of practical knowledge. To solve this ambiguity, I turn to Anscombe’s contrast between “practical” and “speculative” knowledge as models for understanding action. I thus suggest that Anscombe’s account of practical knowledge as knowledge of oneself as an agent is an important resource for Kantian constructivism. This finding prompts us to reset the current dispute about the ontological and epistemological commitments of Kantian constructivism, as illustrated in section 3. While constructivism does not postulate any moral ontology prior to reasoning, it attributes to reasoning the cognitive powers to establish a distinctive relation between the agent and her action. The task of sections 4-7 is to account for the distinctive features of Kantian constructivism understood as an objectivist account of practical knowledge. In section 4, I argue that in order for reasoning to accomplish its normative tasks, it should be conceived as a self-legislating activity. I respond to some objections to the idea of self-legislation as the form of rational willing by offering a dialogical view of practical reason. In section 5, I propose a non-standard interpretation of Kant’s argument of “the fact of reason” to show that the constructivist account of self-legislation does not build on realism about value, as its detractors claim. The “basis of construction” is the subjective experience of respect for the self-legislative capacity itself. This moral feeling conveys our awareness of rational agency and shows our responsiveness to the demands of practical reason. It is an emotional mode of practical knowledge of oneself as an agent (in the sense specified in section 2), but not as a mode of moral discernment. In section 6, I show how practical knowledge of oneself as an agent relates to practical knowledge about what one ought to do. I thus account for the relation between respect as emotional moral consciousness and respect as a deliberative constraint. Finally, in section 7, I reply to the objection of subjectivism. I explain how the complex sort of objectivity that Kantian constructivism affords is at the same time more ambitious and more modest than is generally assumed. (shrink)

Are there such things as moral truths? How do we know what we should do? And does it matter? Constructivism states that moral truths are neither invented nor discovered, but rather are constructed by rational agents in order to solve practical problems. While constructivism has become the focus of many philosophical debates in normative ethics, meta-ethics and action theory, its importance is still to be fully appreciated. This paper takes a constitutivist approach to self-deception, and argues that this phenomenon should be evaluated under several dimensions of rationality. The constitutivist approach has the merit of explaining the selective nature of self-deception as well as its being subject to moral sanction. Self-deception is a pragmatic strategy for maintaining the stability of the self, hence continuous with other rational activities of self-constitution. However, its success is limited, and it costs are high: it protects the agent’s self by undermining the (...) authority she has on her mental life. To this extent, self-deception is akin to alienation and estrangement. Its morally disturbing feature is its self-serving partiality. The self-deceptive agent settles on standards of justification that are lower than any rational agent would adopt, and thus loses grip on her agency. To capture the moral dimension of self-deception, I defend a Kantian account of the constraints that bear on self-constitution, and argue that it warrants more discriminating standards of agential autonomy than other contemporary minimalist views of self-government. Constructivism in ethics is the view that insofar as there are normative truths, for example, truths about what we ought to do, they are in some sense determined by an idealized process of rational deliberation, choice, or agreement. As a “first-order moral account”--an account of which moral principles are correct-- constructivism is the view that the moral principles we ought to accept or follow are the ones that agents would agree to or endorse were they to engage in a hypothetical (...) or idealized process of rational deliberation. As a “metaethical account” – an account of whether there are any normative truths and, if so, what they are like – constructivism holds that there are normative truths. These truths are not fixed by facts that are independent of the practical standpoint, however characterized; rather, they are constituted by what agents would agree to under some specified conditions of choice. In working to provide a more precise definition of constructivism in metaethics, the focus of this entry, one faces two main difficulties. The first difficulty is that constructivism comes in several varieties, each of which claims a different niche within metaethics, and some claim no space at all. The second difficulty concerns where to place constructivism on the metaethical map in relation to realism and anti-realism. These are terms of art, and it is highly contested which views count as realist and which as antirealist. These two difficulties will be addressed in what follows by focusing on the distinctive questions that constructivist theories are designed to answer. Section §1 defines the scope of constructivism in ethics, in contrast to constructivism in political theory. Sections §§2-5 illustrate the main varieties of metaethical constructivism, which are designed to account for the nature of normative truths and practical reasons. Section §6 presents the main varieties of constructivist accounts of the justification of moral judgments of right and wrong. This article argues that Rawls’ history of ethics importantly contributes to the advancement of ethical theory, in that it correctly situates Kantian constructivism as an alternative to both sentimentalism and rational Intuitionism, and calls attention to the standards of objectivity in ethics. The author shows that by suggesting that both Intuitionist and Humean doctrines face the charge of heteronomy, Rawls appearsto adopt a Kantian conception of practical reason. Furthermore, Rawls follows Kant in assuming that ethical objectivity can be vindicated only (...) if the productive and constructive powers of reason are acknowledged. The author accounts for this assumption against the background of Kant’s moral psychology, and examines Intuitionist and Humean rejoinders. Contrary to a common view, the author arguesthat because of its claims on the nature of moral agency and the sovereignty of practical reason, Kantian Constructivism sets the standards of ethical objectivity higher than its alternatives, and is more ambitious and more demanding than the realist conception of objectivity. Constitutivism aims to justify substantial normative standards as constitutive of practical reason. In this way, it can defend the constructivist commitment to avoiding realism and anti-realism in normative disciplines. This metaphysical debate is the perspective from which the nature of the constitutivist justification is usually discussed. In this paper, I focus on a related, but distinct, debate. My concern will not be whether the substantial normative claims asserted by the constructivist have some elements, which are not constructed, but real, given (...) independently from us; instead, my concern will be more narrowly epistemic – whether those claims can be derived from premises, which are normatively less substantial than the normative conclusions themselves. I focus on Korsgaard’s transcendental articulation of the constitutivist argument. I conclude that more work would need to be done, in order for this argument to function as intended. (shrink)

Abstract Robert Stern's Understanding Moral Obligation is a remarkable achievement, representing an original reading of Kant's contribution to modern moral philosophy and the legacy he bequeathed to his later-eighteenth- and early-nineteenth-century successors in the German tradition. On Stern's interpretation, it was not the threat to autonomy posed by value realism, but the threat to autonomy posed by the obligatory nature of morality that led Kant to develop his critical moral theory grounded in the concept of the self-legislating moral agent. Accordingly, (...) Stern contends that Kant was a moral realist of sorts, holding certain substantive views that are best characterized as realist commitments about value. In this paper, I raise two central objections to Stern's reading of Kant. The first objection concerns what Stern identifies as Kant's solution to the problem of moral obligation. Whereas Stern sees the distinction between the infinite will and the finite will as resolving the problem of moral obligation, I argue that this distinction merely explains why moral obligations necessarily take the form of imperatives for us imperfect human beings, but does not solve the deeper problem concerning the obligatory nature of morality: why we should take moral norms to be supremely authoritative laws that override all other norms based on our non-moral interests. The second objection addresses Stern's claim that Kantian autonomy is compatible with value realism. Although this is an idea with which many contemporary readers will be sympathetic, I suggest that the textual evidence actually weighs in favor of constructivism. (shrink)

Suppose we grant that evolutionary forces have had a profound effect on the contours of our normative judgments and intuitions. Can we conclude anything from this about the correct metaethical theory? I argue that, for the most part, we cannot. Focusing my attention on Sharon Street’s justly famous argument that the evolutionary origins of our normative judgments and intuitions cause insuperable epistemological difficulties for a metaethical view she calls "normative realism," I argue that there are two largely independent lines of (...) argument in Street’s work which need to be teased apart. The first of these involves a genuine appeal to evolutionary considerations, but it can fairly easily be met by her opponents. The second line of argument is more troubling; it raises a significant problem, one of the most difficult in all of philosophy, namely how to justify our reliance on our most basic cognitive faculties without relying on those same faculties in a question-begging manner. However, evolutionary considerations add little to this old problem, and rejecting normative realism is not a way to solve it. (shrink)

Is there an approach to human rights that justifies rights-allocating moral-political principles as principles that are equally acceptable by everyone to whom they apply, while grounding them in categorical, reasonably non-rejectable foundations? The paper examines Rainer Forst’s constructivist attempt to provide such an approach. I argue that his view, far from providing an alternative to “ethical” approaches, depends for its own reasonableness on a reasonably contestable conception of the good, namely, the good of constitutive discursive standing. This suggests a way (...) in which constructivism about human rights might be able to coherently and plausibly negotiate the tension between the scope, the depth and the strength of discursive inclusion: the justification of rights-allocating moral-political principles needs to be premised on an “ethical”, perfectionist defense of the good of constitutive discursive standing. Kantian constructivists accord a constitutive, justificatory role to the issue of scope: they typically claim that first-order practical thought depends for its authority on being suitably acceptable within the right scope, or by all relevant others, and some Kantian constructivists, notably Onora O'Neill, hold that our views of the nature and criteria of practical reasoning also depend for their authority on being suitably acceptable within the right scope. The paper considers whether O'Neill-type Kantian constructivism can coherently accord this key role (...) to the issue of scope while adhering to the universalist, ‘cosmopolitan’ commitments at its core. The paper argues that this is not so. On the one hand, it shows that O'Neill's attempt to ‘fix’ the scope of practical reasoning supposes, rather than establishes, a view of ethical standing and the scope of practical reasoning. On the other hand, the paper argues that Kantian constructivism should endorse a non-constructivist, perfectionist view of the good to determine that scope. The paper thereby supports the perfectionist conjecture that Kantian constructivism, in order to defend its universalist commitments, should take refuge in non-constructivist, perfectionist considerations, and that Kantian constructivism should therefore construe perfectionism as a partial, though uneasy, ally. The paper addresses O'Neill's view that her version of Kant's Categorical Imperative, namely, the requirement of followability (RF), marks the supreme principle of reason; it takes issue with her claim that RF commits us to Kantian constructivism in practical philosophy. The paper distinguishes between two readings of RF: on a weak reading, RF ranges over all (practical) reasoning but does not commit to constructivism, and on a strong version RF commits to constructivism but fails to meet its own test, and (...) so is self-defeating. The paper argues that RF, if understood strongly, depends for its reasonableness on reasons that cannot coherently be required to meet RF, so that RF cannot be the supreme principle of reason. The paper considers several responses to this problem in order to suggest that RF depends for its reasonableness on perfectionist considerations. (shrink)

The dissertation defends that the often-assumed link between constructivism and universalism builds on non-constructivist, perfectionist grounds. To this end, I argue that an exemplary form of universalist constructivism – i.e., O’Neill’s Kantian constructivism – can defend its universalist commitments against an influential particularist form of constructivism – i.e., political liberalism as advanced by Rawls, Macedo, and Larmore – only if it invokes a perfectionist view of the good. (En route, I show why political liberalism is a form of particularism and (...) reconstruct the role of its conception of public justification, its implied contextualism about justified belief, its conceptions of toleration, neutrality, good reasons, and legitimacy, and, not least, its justification-constitutive conception of reasonableness.) Contrary to what is often assumed, then, at the level of a vindication of the very project of a universalist constructivism, universalist constructivists should construe perfectionists not as their opponents, but as partial, though uneasy, allies. Adviser: Professor Stefan Baumrin In the first chapter I introduce the distinction between metaethics and normative ethics and argue that metaethics, properly conceived, is a part of cognitive science. For example, the debate between rationalism and sentimentalism can be informed by recent empirical work in psychology and the neurosciences. In the second chapter I argue that the traditional view that one’s theory of semantics determines what one’s theory of justification must be is mistaken. Though it has been the case that (...) there are ‘typical’ combinations of semantic and justificational theories this is by no means forced on one. In the third chapter I examine two current kinds of expressivism; that of Blackburn and Copp. Each gives us an example of different combinations of semantic and justificatory theory. In Blackburn’s case he combines a use theory of meaning with a classic emotivist theory of justification, In Copp’s case it is a neo-Gricean philosophy of language with a realist’s theory of justification. I find both of these wanting as they ultimately collapse into relativistic subjectivism. In the fourth and fifth chapter I turn to developing Emotive Realism. The basic idea behind this view is that when someone says ‘x is wrong/right’ that person has (a) expressed a moral emotion about x and at the same time (b) expressed the belief that the emotion in (a) is the correct one to have. The belief expressed in (b) will be true or false depending on one’s theory of justification. In the fourth chapter I argue that we need separate semantic theories for thoughts and sentences. In the fifth chapter I fill in the details of Emotive Realism as I see it. (shrink)

According to the standard objection, Kantian constructivism implicitly commits to value realism or fails to warrant objective validity of normative propositions. This paper argues that this objection gains some force from the special case of moral obligations. The case largely rests on the assumption that the moral domain is an eminent domain of special objects. But for constructivism there is no moral domain of objects prior to and independently of reasoning. The argument attempts to make some progress in the debate (...) by defending a robust conception of construction, which names a distinctive view of practical reasoning as transformative. (shrink)

In “Practical Reason and the Possibility of Error," Douglas Lavin claims to have discovered a paradox deep in the heart of Christine Korsgaard’s neo-Kantian project. I argue that Lavin's criticism rests on a mistaken conception of ideal agency. In particular, he falsely assumes that since it is no accident that an ideal agent lives up to sound norms, it must have been impossible for her to deviate from them.

Some moral disagreements are so persistent that we suspect they are deep : we would disagree even when we have all relevant information and no one makes any mistakes. The possibility of deep disagreement is thought to drive cognitivists toward relativism, but most cognitivists reject relativism. There is an alternative. According to divergentism, cognitivists can reject relativism while allowing for deep disagreement. This view has rarely been defended at length, but many philosophers have implicitly endorsed its elements. I will defend (...) it. (shrink)

G.A. Cohen and David Estlund claim that, because of their fact-dependent nature, constructivist theories of justice do not qualify as moral theories about fundamental values such as justice. In this paper, I defend fact-dependent, constructivist theories of justice against this fact-independency critique. I argue that constructivists can invoke facts among the grounds for accepting fundamental principles of justice while maintaining that the foundation of morality has to be non-empirical. My claim is that constructivists ultimately account for the normativity of fact-dependent (...) principles by referring to a fact-independent, moral conception of the person, which is not a principle of justice.1. In this paper, I argue that a form of moral constructivism inspired by Hume's Enquiry yields a plausible response to the problem of relativity. Though this problem can be stated in many different ways, I argue that a Humean constructivism is far more universal in scope that Hume's positions are often taken to be. In addition, I argue that where Hume's position does imply a limited scope, this limitation is perfectly appropriate. I discuss four iterations of the relativity problem(s) here: (...) the incorrigibility of local practices (local practices relativism), the relativity of fundamental moral principles (local principles relativism), the contingency of moral principles (modal relativism), and, in a short postscript, the limited scope of moral normativity (normative relativism). They think, in other words, that the target normative facts are reducible to, or constituted by, or identical with, some facts involving our relevant responses. But these philosophers rarely allow all of our actual responses (of the relevant kind) to play such a role. Rather, they privilege some..

The Shmagency Challenge to Constitutivism In metaethics – and indeed, meta-normativity – constitutivism is a family of views that hope to ground normativity in norms, or standards, or motives, or aims that are constitutive of action and agency. And mostly because of the influential work of Christine Korsgaard and David Velleman, constitutivism seems to be gaining grounds in the current literature. The promises of constitutivism are significant. Perhaps chief among them are the hope to provide with some kind of (...) answer to the skeptic about morality or perhaps practical reason, and the hope to secure for practical reason a kind of objectivity that is consistent with its practical, motivationally engaged nature. The former philosophical motivation for constitutivism – most clearly present in much of Korsgaard’s relevant work[1] – relies on the fact that constitutive norms seem to be less mysterious than not-clearly-constitutive norms. There arguably is nothing mysterious about, say, the norms of certain reasonably-well-defined activities, like building a house, or playing chess. And challenges by the relevant skeptic – the one asking "Why should I make sure the house I’m building can shelter people from the weather?" or "Why should I not castle when my king is checked?" – seem very rare, barely intelligible, and anyway remarkably easy to cope with. We should explain to the misguided skeptic that if he doesn’t even try to build something that can protect people from the weather, he’s not in the business of building a house at all; that if she doesn’t even try to play by the rules of chess, she’s not in the business of playing chess at all; and so on. It would be nice, the constitutivist hope seems to go, if we had something equally powerful by way of a response to the skeptic asking "Why be moral?". The other main motivation for constitutivism – most clearly present in David Velleman’s relevant work[2] – starts from a commitment to some rather strong kind of existence-internalism about reasons: An agent has a reason to?, according to such views ), only if she can come to?, or at least to be motivated to?, by sound deliberation starting from her actual motivational set. More and more people seem to think that constructivism - in political philosophy, in moral philosophy, and perhaps in practical reasoning most generally - is the way to go. And yet it is surprisingly hard to even characterize the view. In this paper, I go to some lengths trying to capture the essence of a constructivist position - mostly in the realm of practical reason - and to pinpoint its theoretical attractions. I then give some reason to suspect that there (...) cannot be a coherent constructivist view about practical reason as a whole, at least not if it is to be interestingly constructivist, in a sense I make reasonably precise. There is a fairly widespread—and very infl uential—hope among philosophers interested in the status of normativity that the solution to our metaethical and, more generally, metanormative problems will emerge from the philosophy of action. In this essay, I will argue that these hopes are groundless. I will focus on the metanormative hope, but—as will become clear—showing that the solution to our metanormative problems will not come from what is constitutive of action will also devastate the hope of gaining significant insight (...) into first-order, normative truths by focusing on what is constitutive of action. Constitutivism argues that the source of the categorical force of the norms of rationality and morality lies in the constitutive features of agency. A systematic failure to be guided by these norms would amount to a loss or lack of agency. Since we cannot but be agents, we cannot but be unconditionally guided by these norms. The constitutivist strategy has been challenged by David Enoch. He argues that our participation in agency is optional and thus cannot be a source of (...) categorical demands. In this paper, I defend the viability of constitutivism by showing that agency is indeed a special ‘inescapable’ enterprise. Agency has the largest jurisdiction, and it is closed under rational assessment. This inescapability does not exempt constitutivism from raising the question whether agents have reason to be agents, but this question has to be taken up within agency. If this question is answered affirmatively, then—I argue—the criteria of practical correctness are self-ratifying in a non-circular way. This is sufficient to show the viability of the constitutivist strategy. Whether agents have conclusive reasons to be agents, however, is a matter to be addressed in the terms of particular versions of constitutivism. (shrink)
