This paper argues that emotions play a key role in intentional explanation, because they can be conceived as rational. Furthermore, their rationality is specific as they make agents act and react with respect to values and norms. Indeed, emotions have cognitive bases and are reactions to the presence of values and are regimented by epistemic norms that can be constrained by social norms. Additionally, thanks to their action and cognitive tendencies emotions ground rational actions by providing, among other features of (...) rationality, intentions to promote values through norms of action that can also be constrained by social norms. In that sense, emotions seem to bridge the gap between rationality and normativity by articulating the rational detection and production of values related to epistemic and action norms that can be both regimented by social norms. The chapter examines Russian political theorist Aleksandr Dugin’s (b. 1962) challenge to the Western liberal order. Even though Dugin’s project is in many ways a theoretical epitome of Russia’s contemporary attempt to profile itself as a regional great power with a political and cultural identity distinct from the liberal West, Dugin can also be read in a wider context as one of the currently most prominent representatives of the culturally and intellectually oriented international New Right. The chapter introduces Dugin’s role (...) on the Russian right-wing political scene and his international networks, Russian neo-Eurasianism as his ideological footing, and his more recent “fourth political theory” as an attempt to formulate a new ideological alternative to liberalism as well as the two other main twentieth-century ideologies, communism and fascism. Dugin’s fourth ideology, essentially meant as an alternative to a unipolar post–Cold War global hegemony of victorious liberalism, draws inspiration from the German conservative revolutionary movement of the Weimar era. In particular, Martin Heidegger’s philosophy of history, with its thesis of the end of modernity and another beginning of Western thought, and Carl Schmitt’s pluralistic model of geopolitics are highlighted as key elements of Dugin’s eclectic political thought, which is most appropriately characterized as a form of radical conservatism. In “Real Patterns” Daniel Dennett developed an argument about the reality of beliefs on the basis of an analogy with patterns and noise. Here I develop Dennett’s analogy into an argument for descriptivism, the view that belief reports do no specify belief contents but merely describe what someone believes, and show that this view is also supported by empirical evidence. No description can do justice to the richness and specificity or “noisiness” of what someone believes, and the same belief can (...) be described by different sentences or propositions (which is illustrated by Dennett’s analogy, some Gettier cases, and Frege’s puzzle), but in some contexts some of these competing descriptions are misleading or even false. Faithful (or truthful) description must be guided by a principle (or principles) related to the principle of charity: belief descriptions should not attribute irrationality to the believer or have other kinds of “deviant” implications. There is a widespread attitude in epistemology that, if you know on the basis of perception, then you couldn’t have been wrong as a matter of chance. Despite the apparent intuitive plausibility of this attitude, which I’ll refer to here as “stochastic infallibilism”, it fundamentally misunderstands the way that human perceptual systems actually work. Perhaps the most important lesson of signal detection theory (SDT) is that our percepts are inherently subject to random error, and here I’ll highlight some key empirical (...) research that underscores this point. In doing so, it becomes clear that we are in fact quite willing to attribute knowledge to S that p even when S’s perceptual belief that p could have been randomly false. In short, perceptual processes can randomly fail, and perceptual knowledge is stochastically fallible. The narrow implication here is that any epistemological account that entails stochastic infallibilism, like safety, is simply untenable. More broadly, this myth of stochastic infallibilism provides a valuable illustration of the importance of integrating empirical findings into epistemological thinking. (shrink)

In the wake of modernism studies' global turn, this article considers the role of translation in fostering Iranian modernism. Focusing on the poetic translations of Bijan Elahi (1945-2010), one of Iran's most significant poet-translators, we demonstrate how untranslatability becomes a point of departure for his experimental poetics. Elahi used premodern Sufi hermeneutics to develop his modernist theory of translation, whereby the alien core of the text is recognised at the centre of the original. As he engages the translated text from (...) many angles, Elahi confounds polarities between innovation and imitation, and authorship and translation, that continue to bifurcate translation studies. In contributing to the globalization of modernist studies, this work adds to our understanding of modernism's entanglement within premodern concepts of creation, as well as to modernism's recreation of tradition from a non-European periphery. The question of what distinguishes moral problems from other problems is important to the study of the evolution and functioning of morality. Many researchers concerned with this topic have assumed, either implicitly or explicitly, that all moral problems are problems of cooperation. This assumption offers a response to the moral demarcation problem by identifying a necessary condition of moral problems. Characterizing moral problems as problems of cooperation is a popular response to this issue – especially among researchers empirically studying the (...) beginnings and limits of moral psychology. However, demarcating the moral in this way severely restricts the domain of moral problems. There are plenty of moral problems that aren’t simply problems of cooperation. In this paper I argue that understanding moral problems as problems of cooperation is too restrictive and offer an alternative way of demarcating moral from non-moral problems. Characterizing what makes a problem moral in terms of cooperation excludes a variety of problems that are ordinarily understood and responded to as moral. The alternative characterization that I propose is based on the American Indian/Native American concept of harmony. Using the concept of cooperation to demarcate the moral removes moral agents from their surroundings or contexts by assuming moral agency applies only to humans or other similarly evolved lifeforms. In contrast, using the concept of harmony allows for moral consideration to be granted to non-humans as well (e.g., non-human animals, plant life, ecosystems, etc.). (shrink)

Big decisions in a person’s life often affect the preferences and standards of a good life which that person’s future self will develop after implementing her decision. This paper argues that in such cases the person might lack any reasons to choose one way rather than the other. Neither preference-based views nor happiness-based views of justified choice offer sufficient help here. The available options are not comparable in the relevant sense and there is no rational choice to make. With the increase of awareness, knowledge, technology and the advent of post-modernist era, the quest for social justice has heightened. Even communism and democracy attempt to offer social justice to its natives. Communism states that humans are free to engage in any kind of occupation and express ourselves freely without government interference, unlike the alienated labour society of the capitalist industry: this for communism is social Justice, while democracy thinks equality before law and power to its natives is social justice. All through the era of Philosophy, Philosophers differ on the definition, and what constitute social justice. Until now, there is no unifying explanation on what social justice is and consists of. This paper tends to look into the history of social Justice and different philosophers from different epochs. It also tried to expose the problems inherent in the definition and what constitute social justice, and cautioned that complimentary imperative should be employ to curtail human egoistic tendency that aids social injustice. Note: "Next to Godliness" (Apeiron) is an expanded version of this paper. -/- According to Plato's successors, assimilation to god (homoiosis theoi) was the end (telos) of the Platonic system. There is ample evidence to support this claim in dialogues ranging from the Symposium through the Timaeus. However, the Philebus poses a puzzle for this conception of the Platonic telos. On the one hand, Plato states that the gods are beings beyond pleasure while, on the other hand, he argues that (...) the best human life necessarily involves pleasure. In this paper, I argue that the solution to this puzzle lies in the fact that the processes by which we assimilate to god, learning and becoming virtuous, are restitutive and hence pleasant. Thus, the reason why the best human life necessarily involves pleasure is that we can never become fully divine and perfect, but must constantly strive to become like the divine, through pleasureful restitutive processes. In this paper, I also provide a close examination and taxonomy of the different models that Plato presents throughout his corpus of assimilation to god. (shrink)

In a recent article, Krauss (2017) raises some fundamental questions concerning (i) what the desiderata of a definition of lying are, and (ii) how definitions of lying can account for partial beliefs. This paper aims to provide an adequate answer to both questions. Regarding (i), it shows that there can be a tension between two desiderata for a definition of lying: 'descriptive accuracy' (meeting intuitions about our ordinary concept of lying), and 'moral import' (meeting intuitions about what is wrong with (...) lying), vindicating the primacy of the former desideratum. Regarding (ii), it shows that Krauss' proposed 'worse-off requirement' meets neither of these desiderata, whereas the 'comparative insincerity condition' (Marsili 2014) can meet both. The conclusion is that lies are assertions that the speaker takes to be more likely to be false than true, and their distinctive blameworthiness is a function of the extent to which they violate a sincerity norm. By positing objective determinations as the own determinations of thought, comprehension reveals thinking as an activity that is practical. For Hegel, comprehending allegedly extrinsic objects, and free willing of the own determinations of the thinking and willing subject, are in essence the same activity: only subjects who can choose between the determinations that determine them can comprehend objects. To (...) elucidate: only subjects who are able to actively determine themselves with the determinations that spontaneously determine them are able to analyse and comprehend the objects of their knowing activity. I defend a relational account of difference in the moral status between fetuses and newborns. The difference in moral status between a fetus and a newborn is that the newborn baby is the proper object of ‘parental responsibility’ whereas the fetus is not. ‘Parental responsibilities’ are a moral dimension of a ‘parent-child relation’, a relation which newborn babies stand in, but fetuses do not. I defend this relational account by analyzing the concepts of ‘parent’ and ‘child’, and conclude that the (...) difference in the moral status between fetuses and newborns means one may claim abortion is morally permissible while also claiming infanticide is not morally permissible, without inconsistency between the two claims. Background Animal-derived constituents are frequently used in anaesthesia and surgery, and patients are seldom informed of this. This is problematic for a growing minority of patients who may have religious or secular concerns about their use in their care. It is not currently common practice to inform patients about the use of animal-derived constituents, yet what little empirical data does exist indicates that many patients want the opportunity to give their informed consent. Discussion First we review the nature and scale (...) of the problem by looking at the groups who may have concerns about the use of animal-derived constituents in their care. We then summarise some of the products used in anaesthesia and surgery that can contain such constituents, such as anaesthetic drugs, surgical implants and dressings. Finally, we explore the problem of animal-derived constituents and consent using Beauchamp and Childress’ four principles approach, examining issues of autonomy, beneficence, nonmaleficence and justice. Summary Disclosing the use of animal-derived constituents in anaesthesia and surgery is warranted under Beauchamp and Childress’ four principles approach to the problem. Although there exist systemic and practical challenges to implementing this in practice, the ethical case for doing so is strong. The Montgomery ruling presents additional legal reason for disclosure because it entails that patients must be made aware of risks associated with their treatment that they attach significance to. The chapter reconstructs and criticizes one of Anscombe's famous three these, namely the claim that a ‘philosophy of psychology’ is a preliminary task to the construction of any possible ethical theory, or that moral philosophy ‘should be laid aside at any rate until we have an adequate philosophy of psychology, in which we are conspicuously lacking’. The claim is that Anscombe’s idea of a philosophy of psychology cannot be simply identified with that of moral psychology with which we are familiar (...) now; that her main claim, namely that actions are analogous to language is quite promising; that among the implications there is not only a criticism to consequentialism but also acknowledgement of a central role for judgement, and accordingly not just a blunt refusal, but instead an unaware rediscovery of Kantian ethics; that her rediscovery of the idea of virtue is promising enough, albeit misunderstood by Anscombe herself when she presents it in terms of coming back to Aristotelian and Thomist ethics as contrasted with modern moral philosophy. I discuss the third of Anscombe’s theses from “Modern Moral Philosophy”, namely that post-Sidgwickian consequentialism makes the worst action acceptable. I scrutinize her comprehension of “consequentialism”, her reconstruction of Sidgwick’s view of intention, her defence of casuistry, her reformulation of the double-effect doctrine, and her view of morality as based on Divine commands. I argue that her characterization of consequentialism suffers from lack of understanding of the history of utilitarianism and its self-transformation through the Intuitionism-Utilitarianism controversy; that she uncritically accepted (...) an impoverished image of Kantian ethics and intuitionism, which was, ironically, an unaware bequest from her consequentialist opponents; that her action theory, yet, is a decisive contribution that may prove useful in formulating answers to questions that have been left open in both utilitarian and Kantian or intuitionist theories; that, to make the best of her actions theory, it is as well to drop her divine law view of ethics, which is incompatible with the former; and that the rather obscure traditional theological doctrine of absolute prohibitions is unnecessary to her project that could fare well with the more sober distinction between perfect and imperfect duties. I begin my comment on Westphal’s study by exploring briefly his refutation of “the arbitrariness thesis,” and then focusing on the “conditio humanae,” i.e. the conditions of life as freedom realized in common life. As I understand it, coordination and cooperation among persons are required because employing freedom in the presence of others presupposes an act of recognition that acknowledges a priori the necessity of universal respect. The right to use and possess things within the institution of property is an (...) illustrative example of this necessity. Justice requires possession not in the form of some equal distribution but as a normative requirement that “everyone shall have property.” One must have property in order to enter the world of inter-subjectivity and become a person. This has important implications for determining how poverty is related to the validity of laws, which depends on the joint legislative will of all persons. (shrink)

After a short historical survey of philosophical views on property, the article contains an analysis of the argument which justifies property by referring to the universal respect due to anyone’s right to use any thing for any purpose. Usage of things for the realization of set ends (or goals) is among the conditions of action/ agency. The capacity of freedom as a specific causal power in real world is dependent on the possibility of using things as means. However, without a (...) real prospect to finish the process of realization of set goals, this causal power would not be real. Property is a scheme within which this prospect becomes a real possibility. Property is thus a condition of effective successful purposeful agency. In property the normative position of all others, besides the owner, has been changed, as they do not have the right to use things possessed for their ends, although they have a right to use any non-possessed thing as a means for whichever end they might set. As a right, property entails, first, the obligation to respect the fact of any established possession, and, second, an obligation to accept and recognize the established possession as ownership, which does not depend on the fact of factual physical control of the property. Ownership is therefore a guarantee of future possession. For this to be established there is a need for an explicit recognition from all others; however this recognition is normatively necessary for everybody, as no-one has a right to withdraw the recognition of a legitimate right to property. This comes from the ontological and axiological difference between persons and things: persons have a right to use and possess unpossessed things as means for realization of ends they set. (shrink)

This paper aims to provide a unifying approach to the analysis of understanding coherencies (interrogative understanding, e.g. understanding why something is the case) and understanding subject matters (objectual understanding) by highlighting the contextualist nature of understanding. Inspired by the relevant alternatives contextualism about knowledge, I will argue that understanding (in the above mentioned sense) inherently has context-sensitive features and that a theory of understanding that highlights those features can incorporate our intuitions towards understanding as well as consolidate the different accounts (...) of how to analyse understanding. In developing a contextualist account of understanding, I will argue that an account of the features commonly taken to be central to understanding greatly benefits from a contextualist framework. Central to my analysis will be the claim that a person has to fulfil the function of a competent problem solver in order to qualify for the ascription of understanding. In addition to the theoretical elucidation of my contextualist approach to understanding, a demanding hypothetical scenario will be developed to function as a test case. (shrink)

O artigo esboça o desenvolvimento da hermenêutica filosófica de Paul Ricoeur a partir de sua fenomenologia da vontade em direção a uma hermenêutica da revelação, mostrando como o projeto radical de destranscendentalizar a subjetividade, subjacente à recepção francesa copntemporânea de uma hermenêutica da suspeita, terma por favorecer um retorno pós-hegeliano a Kant e reformula a filosofia transcendental numa correlação histórica e socialmente mediada entre linguagem e subjetividade, juntamente com uma dialética entre poesis e práxis.

Trata-se de revisitar o debate Rawls-Habermas,em particular, o problema da autonomia política à luz da apropriação que estes autores nos oferecem do procedimentalismo kantiano.Tanto John Rawls quanto Jürgen Habermas, em suas respectivas concepções de "cultura política" e "esfera pública," partem de uma equivocada atribuição de um fundacionalismo moral em Kant de forma a preservar o princípio normativo de universalizabilidade capaz de assegurar a estabilidade de uma "sociedade bem ordenada" e balizar o procedimentalismo democrático enquanto alternativa para os modelos liberais e (...) republicanos. Este artigo procura examinar em que medida a filosofia moral de Kierkegaard se apóia na crítica kantiana da razão dialética. Mostra-se que a rejeição kantiana da prova ontológica da existência de Deus significa um afastamento da incerteza objetiva em direção à certeza prática, enquanto a dialética kierkegaardiana da existência permite que a verdade seja tomada como sendo tanto pessoal quanto objetiva. Se a concepção kierkegaardiana de existência não pode ser separada do Paradoxo Absoluto ou se nem sequer pressupõe a revelação (...) divina parece guiar uma pré-compreensão da oposição luterana entre fé e razão que persiste nas concepções de natureza humana em Kant e Kierkegaard, com relação ao Todo-Outro. Many philosophers think truthmaker theory offers a correspondence theory of truth. Despite the similarities, however, this identification cannot be correct. Truthmaker theory offers no theory of truth, nor can it be employed to offer an acceptable substantive theory of truth. Instead, truthmaker theory takes truth for granted. Though truthmaker theory is not a correspondence theory, it shares with it the same motivational basis—that truth is worldly—and better accounts for what is pre-theoretically compelling about correspondence theories. This paper examines ethics in finance, specifically related to responsible investment. In recent years, socially responsible principles are becoming the de facto standard not only for socially responsible but also for profitable investing. For instance, the United Nations developed the Principles for Responsible Investment (PRI) in 2006, which require institutional investors to incorporate ESG (Environmental, Social and Governance) issues into investment analysis and decision-making processes. This raises the following question: can responsible investments be justified from an ethical point of view? (...) In this paper I first explain responsible investments. Then, I turn to the ethical foundation of responsible investments. There are two arguments for responsible investments. I argue that both fail. Therefore, my conclusion is that the ethical foundation of responsible investments is not firm. (shrink)

In explaining the notion of a fundamental property or relation, metaphysicians will often draw an analogy with languages. The fundamental properties and relations stand to reality as the primitive predicates and relations stand to a language: the smallest set of vocabulary God would need in order to write the `book of the world'. In this paper I attempt to make good on this metaphor. In order to do this I introduce a modality that, put informally, stands to propositions as logical (...) truth stands to sentences. The resulting theory, formulated in higher-order logic, also vindicates the Humean idea that fundamental properties and relations are freely recombinable and a variant of the structural idea that propositions can be decomposed into their fundamental constituents via logical operations. Indeed, it is seen that, although these ideas are seemingly distinct, they are not independent, and fall out of a natural and general theory about the granularity of reality. (shrink)

This paper introduces a novel object that has less structure than, and is ontologically prior to the natural numbers. As such it is a candidate model of the foundation that lies beneath the natural numbers. The implications for the construction of mathematical objects built upon that foundation are discussed.

Post-industrial society is also defined as a "post-class" society, reflecting the breakdown of the stable social structures and identities characteristic of industrial society. If before the status of an individual in a society was determined by his place in the economic structure, that is, by the class affiliation to which all other social characteristics were subordinated, now the status characteristic of the individual is determined by a multitude of factors, among which the increasing role is played by education and the (...) level of culture (according to P. Immanuel Kant’s political philosophy has enjoyed renewed attention as an egalitarian alternative to contemporary inequality since it seems to uncompromisingly reassert the primacy of the state over the economy, enabling it to defend the modern welfare state against encroaching neoliberal markets. However, I argue that, when understood as a free-standing approach to politics, Kant’s doctrine of right shares essential features with the prevailing theories that legitimate really existing economic inequality. Like Friedrich Hayek and Milton Friedman, Kant understands the state’s function (...) as essentially coercive and, in justifying state coercion, he adopts a narrow conception of political freedom that formally preserves the right to choose while denying that the range of choices one actually has can be a matter of justice. As a result, Kant cannot identify various forms of social pressure as potential injustices even as he recognizes their power to create and sustain troubling inequalities. For both Kant and the neoliberals, the result is that economic relations almost never count as unjust forms of coercion, no matter how unequal they are. Views that identify coercion as the trigger for duties of justice are thus particularly ill-suited to orient us to contemporary inequality. (shrink)

We are subject with consciousness. For this we have to have self-consciousness so that consciousness can exist. In this way, there is the possibility of self-knowledge of one's own mental states. Thus, the article aims at investigating the possibility of self-knowledge of one's own mental states, their applicability and consequences in relation to Kantian moral theory. Therefore, it reflects on how self-knowledge of one's own mental states and the characteristics of Kantian moral theory occur. Finally, there is the possibility of (...) moral responsibility for one's own mental states related to Kantian morality and the method of self-knowledge of the very action of the moral agent. I reconstruct Adam Smith’s theory of irony and its application. I illustrate how he defines it as a combination of something “grand” with something “mean” and how this is consistent with his anti-Cartesian and post-skeptic epistemology. I suggest that, for Smith, “systems” of any kind, from Cartesian physics to philosophical monotheism, Stoic ethics, and the “mercantile system” draw their apparent plausibility from some disease of human imagination. I argue that in every field, including political economy, in his view, the philosopher’s (...) task is partially sceptical and partially ironical. That is, it is the task to fight erroneous systems by showing how these arise from unwarranted associations of ideas between apparently “grand” ideas —say, the public interest— with “mean” ones, say, the merchants’ self-interest. In this light, the phrase “invisible hand” turns out to be both an ironic joke and one more application of Smith’s post-skeptical theory of knowledge whose target is dismantling all kind of “invisible” entities that human imagination tends to create. This article shows that in 1.4.2.15-24 of the Treatise of Human Nature, Hume presents his own position on objects, which is to be distinguished from both the vulgar and philosophical conception of objects. Here, Hume argues that objects that are effectively imagined to have a “perfect identity” are imagined due to the constancy and coherence of our perceptions (what we may call ‘level 1 constancy and coherence’). In particular, we imagine that objects cause such perceptions, via what I call ‘indirect (...) causation.’ In virtue of imagining ideas of objects that have a perfect identity, our perceptions seem to be even more constant and coherent (what we may call ‘level 2 constancy and coherence’). Thus, in addition to seeing that Hume is presenting his own position on objects in this section of the Treatise, we see that he is working with a previously unrecognized kind of causation, i.e., indirect causation, and that he has two kinds of constancy and coherence in mind: level 1 and level 2. Linguistic meaning underdetermines what is said. This has consequences for philosophical accounts of meaning, communication, and propositional attitude reports. I argue that the consequence we should endorse is that utterances typically express many propositions, that these are what speakers mean, and that the correct semantics for attitude reports will handle this fact while being relational and propositional.

The notion of habit used in neuroscience is an inheritance from a particular theoretical origin, whose main source is William James. Thus, habits have been characterized as rigid, automatic, unconscious, and opposed to goal-directed actions. This analysis leaves unexplained several aspects of human behavior and cognition where habits are of great importance. We intend to demonstrate the utility that another philosophical conception of habit, the Aristotelian, may have for neuroscientific research. We first summarize the current notion of habit in neuroscience, (...) its philosophical inspiration and the problems that arise from it, mostly centered on the sharp distinction between goal-directed actions and habitual behavior. We then introduce the Aristotelian view and we compare it with that of William James. For Aristotle, a habit is an acquired disposition to perform certain types of action. If this disposition involves an enhanced cognitive control of actions, it can be considered a “habit-as-learning”. The current view of habit in neuroscience, which lacks cognitive control and we term “habit-as-routine”, is also covered by the Aristotelian conception. He classifies habits into three categories: (1) theoretical, or the retention of learning understood as “knowing that x is so”; (2) behavioral, through which the agent achieves a rational control of emotion-permeated behavior (“knowing how to behave”); and (3) technical or learned skills (“knowing how to make or to do”). Finally, we propose new areas of research where this “novel” conception of habit could serve as a framework concept, from the cognitive enrichment of actions to the role of habits in pathological conditions. In all, this contribution may shed light on the understanding of habits as an important feature of human action. Habits, viewed as a cognitive enrichment of behavior, are a crucial resource for understanding human learning and behavioral plasticity. (shrink)

I point out an inconsistency in his approach to torture. I then argue that we should be open to rare counterexamples to his claim and describe a kind of counterexample.

How does Aristotle think about sentences like ‘Every x is y’ in the Prior Analytics? A recently popular answer conceives of these sentences as expressing a mereological relationship between x and y: the sentence is true just in case x is, in some sense, a part of y. I argue that the motivations for this interpretation have so far not been compelling. I provide a new justification for the mereological interpretation. First, I prove a very general algebraic soundness and completeness (...) result that unifies the most important soundness and completeness results to date. Then I argue that this result vindicates the mereological interpretation. In contrast to previous interpretations, this argument shows how Aristotle’s conception of predication in mereological terms can do important logical work. (shrink)

The modern university and the academic profession itself are facing new challenges: First, the increasing complexity of labor markets and globalization are undermining the structure of the academic profession, and secondly, the rise in cost of university research calls into question the autonomy of the university. The internationalization of the academic labor market encourages rethinking the structure of academic professions that have historically been focused on national (regional) contexts. The university is too expensive for the state and/or for students. One (...) way to preserve the autonomy of the university is to offer society, the state, and businesses a wide range of services. This study seeks to answer the following questions: Can bureaucratic (self-)management effectively regulate the growing body of the university? Is it necessary to relinquish part of the university’s autonomy to a hired manager? Can “soft managerialism” and new economic instruments help unleash the modern university’s potential for society and sustain its autonomy? (shrink)

We care not only about what experiences we have, but when we have them too. However, on the B-theory of time, something’s timing isn’t an intrinsic way for that thing to be or become. Given B-theory, should we be rationally indifferent about the timing per se of an experience? In this paper, I argue that B-theorists can justify time-biased preferences for pains to be past rather than present and for pleasures to be present rather than past. In support of this (...) argument, I appeal to the doctrine of temporal parts or “four-dimensionalism” for short. When held in conjunction with a certain evaluative principle about whose experiences matter, four-dimensionalism reconciles B-theory with some time-biased preferences. (shrink)

This paper reveals errors within Norwich et al.’s Entropy Theory of Perception, errors that have broad implications for our understanding of perception. What Norwich and coauthors dubbed their “informational theory of neural coding” is based on cybernetics, that is, control and communication in man and machine. The Entropy Theory uses information theory to interpret human performance in absolute judgments. There, the continuum of the intensity of a sensory stimulus is cut into categories and the subject is shown exemplar stimuli of (...) each category. The subject must then identify individual exemplars by category. The identifications are recorded in the Garner-Hake version of the Shannon “confusion matrix”. The matrix yields “H”, the entropy (degree of uncertainty) about what stimulus was presented. Hypothetically, uncertainty drops as a stimulus lengthens, i.e. a plot of H vs. stimulus duration should fall monotonically. Such “adaptation” is known for both sensation and firing rate. Hence, because “the physiological adaptation curve has the same general shape as the psychophysical adaptation curve”, Norwich et al. assumed that both have the same time course; sensation and firing rate were thus both declared proportional to H. However, a closer look reveals insurmountable contradictions. First, the peripheral neuron hypothetically cannot fire in response to a stimulus of a given intensity until after somehow computing H from its responses to stimuli of various intensities. Thus no sensation occurs until firing rate adapts, i.e. attains its spontaneous rate. But hypothetically, once adaptation is complete, certainty is reached and perception ends. Altogether, then, perception cannot occur until perception is over. Secondly, sensations, firing rates, and H’s are empirically not synchronous, contrary to assumption. In sum, the core concept of the cybernetics-based Entropy Theory of Perception, that is, that uncertainty reduction is the basis for perception, is irrational. (shrink)

Working out a Kantian theory of moral responsibility for animals2 requires the untying of two philosophical and interpretive knots: i.) How to interpret Kant’s claim in the important “episodic” section of the Doctrine of Virtue that we do not have duties “to” animals, since such duties are only “with regard to” animals and “directly to” ourselves; and ii.) How to explain why animals don’t have rights, while human beings who (currently or permanently) don’t have sufficient reason for moral responsibility do (...) have rights. At the heart of the problem lies the philosophical challenge of whether a Kantian account of moral responsibility for animals can take the animals themselves into account in the right way, that is, without utilizing arguments that (wrongly) presuppose that non-human animals are moral agents or can be morally responsible for their actions. -/- The task of untying these two knots is the aim of this chapter. I start by defending Kant’s general claim that our duties regarding animals are not “to” them, but rather “with regard to” them. Relations between human and other animals are not relations between two kinds of moral beings, since animals are not capable of the kind of consciousness, in particular the reflective self-consciousness moral being requires. Instead the more complex human-animal relations are affectionate, social relations to which humans can and sometimes should relate morally. This is why these moral duties are “direct” only to ourselves; we are the only ones in the relations that can be morally responsible for them. Correspondingly, respect (in Kant’s precise sense of the word) is a distinctly reflective, moral emotion internal to the specific normative orientation we have only to beings that can be truly free (reflectively self-conscious), and so, to human beings; morality and respect single out how we regard ourselves and other human beings capable of freedom. As we will see, Kant has a consistent and not counter-intuitive account of why we have the moral attitudes we do about animals and of how it is that these attitudes have the appearance of being about the animals themselves. In addition, Kant can explain why it doesn’t follow from this that these moral attitudes arise from attributing moral rights to the animals themselves. Central to this interpretation is Kant’s Religion, as it contains an account of human nature that adequately explains why we have the positive attitudes we do towards animals; similarly, the Religion contains an account of human evil that explains why we consider other occasions of attitudes towards animals as genuine examples of moral failure. Hence, the Religion is central to understanding why Kant’s approach to animals is neither internally inconsistent nor counter-intuitive. (shrink)

I criticize Robison's proposal to expunge normative ethical paradigms from the engineering ethics curriculum.

The production of scientific instruments in America was neither a postwar phenomenon nor dramatically different from that of several other developed countries. It did, however, undergo a step-change in direction, size and style during and after the war. The American scientific instrument industry after 1945 was intimately dependent on, and shaped by, prior American and European experience. This was true of the specific genres of instrument produced commercially; to links between industry and science; and, just as importantly, to manufacturing practices (...) and cultures. I will argue that, despite the new types of instrument commercialized after the war, this historical continuity of links with science and scientists guided and constrained the design and manufacture of these products. Nevertheless, new designers, manufacturers and customers gradually transformed the culture of scientific instruments in the second half of the century. -/- This chapter deals with a subset of the American instrument industry, namely the measuring and monitoring instruments manufactured for scientific use. Even with the specification of ‘scientific’ instruments, however, these borders are rather artificial and unclear: instrument making from the seventeenth through the twentieth century has generally involved the fabrication of both standard products and custom-made devices for scientific use.2 In this context of sales quantities, ‘scientific’ instruments have often been defined as low-volume, special-order or custom devices. In a similar vein, ‘scientific’ instruments were commonly distinguished from ‘production’ instruments by context of usage, namely their very absence from – and indeed irrelevance to – production environments. This demarcation according to customer and environment was mirrored in at least one furth er respect: the training of their users. The classification into ‘scientific’ and ‘engineering’ applications was as fluid as the relationship between American universities and technical industries themselves.Despite these complementary definitions, the notion of the ‘scientific instrument’ was beginning to prove inadequate even at the turn of the twentieth century, and dramatically so when discussing the post-Second World War period. Definitions altered qualitatively after the Second World War in at least three further ways: (a) new genres of device altered the scope of the scientific instrument; (b) the contribution of State and military sponsorship of new forms of instrument became significant; and, (c) the postwar demand for specialist instruments increased rapidly, owing to wartime innovation, new applications and new customers. I will explore the evolution of instrument manufacturing in this changing context of new technology, funding, development and markets. (shrink)

Works of fiction are alleged to differ from works of nonfiction in instructing their audience to imagine their content. Indeed, works of fiction have been defined in terms of this feature: they are works that mandate us to imagine their content. This paper examines this definition of works of fiction, focusing on the nature of the activity that ensues in response to reading or watching fiction. Investigating how imaginings function in other contexts, I show, first, that they presuppose a cognitive (...) infrastructure encompassing at least one additional kind of mental state, whose role is to determine, to some degree, truth in an imaginary world. I then discuss the implications for the definition of fiction, showing that the definition should be refined to accommodate the structure that imagining presupposes: a work counts as fiction just in case it mandates us, not only to imagine, but to engage in a more complex mental activity, an activity that in addition to imagining, involves positing a backdrop for our imaginings. This paper dealing with extension of the Einstein eld equations using apparatus of contemporary generalization of the classical Lorentzian geometry named in literature Colombeau distributional geometry, see for example [1], [2], [3], [4], [5], [6], [7] and [32]. The regularizations of singularities presented in some solutions of the Einstein equations is an important part of this approach. Any singularities present in some solutions of the Einstein equations recognized only in the sense of Colombeau generalized functions [1], [2] and not classically. (...) In this paper essentially new class Colombeau solutions to Einstein eld equations is obtained. The vacuum energy density of free scalar quantum field  with a distributional background spacetime also is considered. It has been widely believed that, except in very extreme situations, the influence of gravity on quantum fields should amount to just small, sub-dominant contributions. Here we argue that this belief is false by showing that there exist well-behaved spacetime evolutions where the vacuum energy density of free quantum fields is forced, by the very same background distributional spacetime such distributional BHs, to become dominant over any classical energy density component. This semiclassical gravity effect finds its roots in the singular behavior of quantum fields on curved spacetimes. In particular we obtain that the vacuum fluctuations have a singular behavior on BHs horizon. (shrink)

This article undertakes a republican analysis of power in the workplace and labour market in order to determine whether workers are dominated by employers. Civic republicans usually take domination to be subjection to an arbitrary power to interfere with choice. But when faced with labour disputes over what choices it is normal for workers to make for themselves, these accounts of domination struggle to determine whether employers possess the power to interfere. I propose an alternative capabilitarian conception of domination as (...) the arbitrary power to determine access to capabilities necessary for relationships of equality between citizens. This approach allows us to diagnose domination in the workplace and the labour market but does not capture unfreedom arising from the wider socio-structural position of workers. Thus, I supplement this capabilitarian account of the domination of workers with a structural account of dominating power, which reveals a richer set of conditions under which employers dominate workers. Socialist republicans advocate public ownership and control of the means of production in order to achieve the republican goal of a society without endemic domination. While civic republicanism is often attacked for its conservatism, the relatively neglected radical history of the tradition shows how a republican form of socialism provides powerful conceptual resources to critique capitalism for leaving workers and citizens dominated. This analysis supports a programme of public ownership and economic democracy intended to reduce domination in the workplace and (...) wider society. I defend this socialist republicanism from both the Marxist objection that it overlooks the impersonal nature of domination under capitalism and the left-liberal objection that property-owning democracy is sufficient to suppress dominating relationships. The resulting position identifies the need for more ambitious institutional grounds for republican liberty than is often supposed, while offering us a distinctive emancipatory justification for socialism. The epistemic account and the noetic account hold that the essence of scientific progress is the increase in knowledge and understanding, respectively. Dellsén (2018) criticizes the epistemic account (Park, 2017a) and defends the noetic account (Dellsén, 2016). I argue that Dellsén’s criticisms against the epistemic account fail, and that his notion of understanding, which he claims requires neither belief nor justification, cannot explain scientific progress, although it can explain fictional progress in science-fiction.

The picture of moral development defended by followers of Aristotle takes moral cultivation to be like playing a harp; one gets to be good by actually spending time playing a real instrument. On this view, we cultivate a virtue by doing the actions associated with that virtue. I argue that this picture is inadequate and must be supplemented by imaginative techniques. One can, and sometimes must, cultivate virtue without actually performing the associated actions. Drawing on strands in Buddhist philosophy, I (...) explain several methods of moral development that rely on imagination and visualization rather than overt action. These techniques are essential in cases where cultivating virtue the way one practices the harp is impossible. A VISÃO GREGA DE TRABALHO -/- Comecemos pelos gregos, uma civilização excitante que, durante muitos séculos antes de Cristo, já começava a elaborar riquíssimas reflexões sobre vários aspectos da vida humana. No entanto, surpreende aqueles de nós que já ler os primeiros filósofos gregos, como entre tantas análises rigorosas e “diálogos”, um elemento tão central na vida social dos povos, como o trabalho havia tido escassa repercussão. A explicação só faz sentido, justamente, ao analisar a valorização que esses grandes pensadores tinham acerca do nosso objeto de estudo que é o trabalho. Embora, como supracitado, os gregos não tivessem uma visão unânime sobre o trabalho, não é menos certo assinalar que para esta civilização o trabalho foi considerado um fato altamente desvalorizado. O trabalho, para eles, dado a sua vinculação com a dimensão de constrangimento e necessidades, limitava a liberdade dos indivíduos, condição indispensável para integrar o mundo da “pólis” na qualidade de cidadão. O homem livre realizava atividades absolutamente desinteressadas: a atividade intelectual (que não era considerada trabalho) fazia parte do ócio e da contemplação. O trabalho, reservado apenas aos escravos, como bem sinala Hopenhayn (1955), significava uma mera função produtiva. Portanto, o escravo passou a ser unicamente uma força de trabalho. Como tal, ele não tem personalidade e pertence ao seu mestre, como uma coisa entre muitas. Como objeto de propriedade, escapa ao pensamento antropológico que domina a filosofia sofista e socrática, porque para o cidadão grego falar de escravo não implica um sujeito pensante, senão uma coisa ou, no máximo, a força. Também escapa ao pensamento platônico, porque, como uma coisa, parece totalmente desvalorizado na construção idealista-dualista da realidade (HOPENHAYN, 1988. p. 23 – Tradução própria). -/- Três termos fundamentais que devemos recordar da tradição grega: -/- 1 – Ponos: penalidade, fadiga; -/- 2 – Banausia: trabalho mecânico, e -/- 3 – Ergon: realização. -/- Vejamos como essa noção de trabalho é construída como algo servil (ponos), ao qual uma visão positiva de lazer e contemplação foram contrastadas como uma atividade puramente humana e libertadora. As raízes do supracitado são encontradas no valor eticamente supremo da autarquia socrática. Segundo essa noção alcunhada por Sócrates (469-399 a.C.), todo aquele que trabalha está submetido tanto à matéria como aos homens para quem trabalha. Nessa medida, sua vida carece de autonomia e, portanto, de valor moral. Naturalmente, não só os escravos, mas também qualquer trabalhador dedicado a todos os tipos de tarefas manuais, foram desprezados por um pensamento helênico indubitavelmente aristocrático. Para Platão (427-347 a.C.), de origem aristocrática, descendente do último rei de Atenas e discípulo de Sócrates, a autarquia continua a ser perpetrada como um valor ético supremo e, em consonância com os interesses da aristocracia fundiária, afirmava que somente a agricultura evocava autêntica autonomia. Dessa forma, o pensamento platônico restringiu a participação política a escravos, comerciantes e artesãos. Todos eles têm em comum a dependência das condições materiais em que produzem e trocam mercadorias. O plano político estará intimamente relacionado ao econômico-trabalhista: somente quem é capaz de governar a si mesmo (e como sabemos, acontece com aqueles que não trabalham ou possuem terras), pode governar os outros. Somente a liberação total da prática mundana do trabalho abre as possibilidades de dedicar-se, como fez Platão, à contemplação (σχολή), à filosofia e às ciências, e por meio disso saber distinguir o bem do mal, o justo do injusto, o verdadeiro do falso. Quem poderia dedicar-se a tais “tarefas nobres”? Evidentemente, aqueles que não precisam fazer parte da população trabalhadora, isto é, a aristocracia. Esse sistema de governo aristocrático foi defendido, obviamente, por Platão. Em sua “A República” sinala que o governo perfeito é o aristocrático, e que a este se sucedem a timocracia (governo dos guerreiros), a oligarquia (dos ricos) e a democracia (“governo daqueles que amam o prazer, a mudança e a liberdade), que perece por seus excessos nas mãos de alguns homem audaz que se coloca à frente do povo para defender a democracia e “do tronco desses protetores do povo nasce o tirano”, dando origem à tirania.(2) Em seu diálogo “Político” podemos ler: Aqueles que possuem a si mesmos através da compra, e aqueles que podem ser chamados sem nenhuma discussão de escravos, não participam da arte real [...] E todos aqueles que são livres, se dedicam espontaneamente a atividades servis como as supracitadas, transportando e trocando produtos da agricultura e de outras artes; que nos mercados, indo de cidade em cidade por mar e terra, trocando dinheiro por outras coisas ou por dinheiro, o que chamamos de banqueiros, comerciantes, marinheiros e revendedores, poderão, por acaso, reivindicar para eles algo da ciência política? [...], mas também aqueles que estão dispostos a prestar serviços a todos por salários ou por subsídios, nunca os encontramos participantes na arte de governar [...] Como os chamaremos? Como você acabou de dizer agora: servidores, mas não governantes dos estados (PLATÃO, 1983. pp. 237-8 – adaptado). Esse estado ideal que Platão projetou em seus ensinamentos estava longe, a propósito, da democracia ateniense defendida por Péricles. De certa forma, Platão só confiava em uma elite no poder constituída por uns poucos (oligarquia) que não deveriam se render às tarefas servis da produção e circulação das riquezas. Para ele, as crianças aristocráticas deveriam ser selecionadas desde a infância, recebendo uma educação suficiente tanto em filosofia quanto nas “artes da guerra”. Aos trinta anos, eles já seriam capazes de passar por um exame donde seriam selecionados os “filósofos-reis” encarregados do governo. De fato, no entanto, suas concepções de governo nunca poderiam ser executadas com pureza; ou pela chamada “contrarrevolução aristocrática”, ou pela invasão estrangeira subsequente. Essa visão do trabalho que estamos a analisar, como bem sinala Henri Arvon (1914- 1992), conduz a uma sociedade basicamente conservadora e estancada no produtivo. (3) A ideia de liberdade, ócio e contemplação como valores superiores, propõe um desprezo pelo trabalho que, como vimos, é uma atividade puramente transformadora. Há aqueles que, mediante tal contestação, arriscam fundamentar que grande parte do subdesenvolvimento tecnológico na Grécia derive justamente a essa cultura tão peculiar em relação ao trabalho. Caso contrário, se houvesse escravos, por que avançar em conhecimentos que facilitaram o trabalho? Não nos surpreende, nesse sentido, que uma civilização capaz de criar conhecimentos espetaculares em áreas particularmente complexas como a geometria (Euclides), por outro lado, não soubesse (ou não gostaria) de avançar em conhecimentos técnicos aplicáveis ao campo econômico-trabalhista. Já vimos como a cidadania era o escopo da de alguns aristocratas da civilização helênica. Hannah Arendt (1906-1975) sinalava que os gregos distinguiam entre os escravos, os inimigos vencidos (dmôes ou douloi) que estavam encarregados do trabalho doméstico, e os demiourgoi, homens livres para se deslocarem do domínio privado para o público. Somente depois do século V, sinala Arendt, a pólis começou a classificar as ocupações de acordo com os esforços que eles exigiam. Nisso, Aristóteles (384-322 a.C.) teve que desempenhar um papel preponderante que colocou aqueles cujo “corpo está mais deformado” na faixa mais baixa. Ele não admitiria, portanto, aos estrangeiros (os escravos), nem tampouco aos banausoi, antes dos demiourgoi, trabalhadores e artesãos que deviam resignar-se ao mundo dos “oikos”. Estes, não só estavam submetidos à necessidade como eram incapazes de ser livres, mas também incapazes de governar a parte “animal” do seu ser (República, 590). Serão eles, não obstante, aqueles que permitem o florescimento da chamada democracia helênica, pois, quem senão os trabalhadores (escravos ou artesãos) poderia manter com seu esforço o ócio e a contemplação dos “homens livres”, cidadãos do mundo? Como foi supracitado, será Aristóteles quem delimitará ainda mais os direitos de cidadania. Sua cidade ideal, como em Platão, diferenciaria os governantes dos governados. O primeiro, constituído pela classe militar, estadistas, magistrados e sacerdócio. O segundo, pelos agricultores, artesãos e os camponeses. Com os comerciantes há uma certa ambivalência: embora ele considerava uma ocupação antinatural, estava disposto a admiti-los até certo ponto em sua cidade ideal, cuja base seguiria sendo a escravidão. Em sua Política, ele explana: A cidade mais perfeita não fará do trabalhador manual (artesão) um cidadão. Caso o admitir como tal, a definição de virtude cívica [...] não alcança todos os cidadãos, nem apenas os homens livres, mas só os que estão isentos de trabalhos indispensáveis à sobrevivência. Destes, os que estão a serviço de um só indivíduo, são escravos; os que servem a comunidade, são trabalhadores manuais (artesãos) ou trabalhadores não qualificados (ARISTÓTELES, 1998. p. 203). Tampouco compreenderá os agricultores como reivindicava Platão: “Tampouco deverão ser agricultores os futuros cidadãos, pois para a formação de sua virtude e para a atividade política, o ócio é necessário”. Essa prolifera discussão ocorreu em uma civilização onde começaram a surgir as primeiras mudanças produtivas derivadas do crescimento econômico feito do descobrimento do ferro, e sua posterior divisão do trabalho, onde florescem os grupos de comerciantes e a aristocracia proprietária de terras começa a dominar. Os pensadores da época, mais aliados a estes últimos, contrariavam os princípios da acumulação comercial. Em sua Política, Aristóteles aconselha os cidadãos a absterem-se de qualquer profissão mecânica e de toda especulação mercantil. O primeiro, porque limita intelectualmente, e o segundo, porque degrada o ético. Somente o ócio (scholé), para esses pensadores, permite a virtuosidade e a capacidade de julgar. A Koinonia politiké (comunidade dos homens livres) era típica daqueles que não precisavam de trabalho, relegando a população trabalhadora ao mero âmbito da reprodução material (chrematistiké), o que só era possível em um contexto de alta divisão do trabalho onde um grupo minoritário (oligarquia) vivia à custa do trabalho da maioria (muitos deles escravos). O termo “ócio” provém de “scholé”, entendido entre os gregos como tempo para si mesmo, para a contemplação (sjolé) e, portanto, para a formação (scholé = escola). Desse ponto de vista, o ócio para os gregos é um fim em si mesmo. Entre os romanos, no entanto, adquire outra conotação. Em latim octium, designa o campo contraposto ao neo-octium (negócio), ou seja, é o tempo de descanso que permite dedicar-se ao negócio. Tal visão sobre o trabalho e o ócio, respectivamente, não foi, no entanto, como supracitado no início, unanimemente desenvolvida em toda a história da civilização helênica. Os textos de Homero(4) (séculos IX e VIII a.C.) são mais reservados a respeito, mas acima de tudo, na Grécia antiga encontramos autores como Hesíodo (século VIII), que postulavam outras teses. Para o autor de “Os trabalhos e os dias”, o trabalho se constituía em um justo e necessário castigo que Zeus impôs aos homens pelo pecado de Prometeu. Note a similitude com a crença bíblica que veremos adiante. Hesíodo explana: Lembre-se sempre do meu conselho e trabalhe [...] os deuses e os homens se indignam com quem ocioso vive, semelhante em caráter aos zangões sem ferrão, que consomem o esforço das abelhas [...] O trabalho não é nenhuma desonra; desonra é não trabalhar (HESÍODO, 2012. p. 93 e 95). Também entre alguns sofistas (aqueles que vendiam sua sabedoria a quem gostaria de comprá-la), como Protágoras (século V a.C.), “o primeiro e o maior deles”(5), coloca o estudo e a arte (técnica) na mesma faixa, e Antifonte (século V a.C.) disse: “[...] e as honras e preços, e toda a espécie de encorajamento que Deus incumbiu aos homens, devem necessariamente resultar de fadiga e suor”. Como conviveu a cultura grega com essas noções tão diferentes? Tenho a ideia, juntamente com Hopenhayn, que o desprezo dos pensadores gregos pelo manual foi causado pela violência dos guerreiros e dos aristocratas de plantão, que impuseram aos seja derrotados o jugo. Do trabalho árduo e difícil. Porque a aristocracia queria trabalhar nessas condições? A própria divisão do trabalho em si possibilitou o crescimento da civilização helênica, estava gerando diferentes classes com visões distintas sobre o trabalho. Por outro lado, surgiram os camponeses pobres, os derrotados e aqueles que tinham que viver do trabalho artesanal. Essas pessoas, na maioria das vezes isoladas do mundo da “polis”, gerariam suas próprias leituras dos acontecimentos, seus próprios espaços para o desenvolvimento cultural, inclusive sua própria religião, distante daquela imposta pela visão aristocrática, olímpica, contemplativa e estética dos “homens livres”. -/- 2. A VISÃO DOS CALDEUS ACERCA DO TRABALHO -/- A leitura de outros povos e civilizações sobre este tema tem sido diferente. Entre os caldeus, por exemplo, a visão pejorativa analisada entre os gregos não é registrada. Nas escrituras sagradas da religião de Zaratustra (o Avesta), lemos: “É um santo aquele que constrói uma casa, na qual mantém o fogo, o gado, sua mulher, seus filhos, os bons párias. Aquele que faz a terra produzir trigo, que cultiva os frutos do campo, cultiva corretamente a pureza” (HOPENHAYN, 1988. p. 35). Para os caldeus, como se pode observar, o trabalho implica, de uma posição diametralmente oposta à helênica, uma contribuição na ordem econômica, mas também na espiritual. Trabalhar não é só “cultivar o trigo” (dimensão das necessidades fisiológicas), mas também “cultivar a pureza”, dimensão esta, relacionada com a satisfação das necessidades espirituais. Por que apreciamos uma diferença tão acentuada entre essas culturas? Provavelmente, os diferentes graus de desenvolvimento dos povos levaram a isso. Enquanto entre os gregos primava uma divisão do trabalho, onde alguns tinham o status de “homens livres” dedicados à contemplação e ao ócio, outros não tinham escolha a não ser trabalhar, em uma situação de domínio em relação às naturezas daqueles que o empregaram. Esse não foi o caso dos caldeus, que possuía um escasso dividido trabalho, em que a todos se correspondia uma atividade laboriosa. -/- 3. A VISÃO DOS HEBREUS SOBRE O TRABALHO -/- No meio do caminho entre os caldeus e os gregos, encontramos a avaliação do trabalho feita pelos hebreus, dessa vez, tingindo de ambivalências. Tal como ponderava Hesíodo entre os gregos, para os hebreus, o trabalho se constituía de um mal necessário; em um meio para expiar os pecados; dessa vez não de Prometeu, mas de Adão e Eva. Vamos ver, no entanto, alguns aspectos mais complexos. A primeira coisa a se notar da perspectiva hebraica (compartilhada com o cristianismo) é o que se resulta da leitura do livro de Gênesis, aquela história poética e cheia de imagens para elucidar facilmente a origem da criação. Lá se estabelece a ideia de um deus criador-trabalhador: “No princípio Deus criou o céu e a terra [...] No sétimo dia Deus já havia concluído a obra que realizara, e nesse dia descansou [...] de toda a obra que realizara na criação”.(7) Esse Deus como primeira causa (São Tomás de Aquino (1225-1274)) denota laboriosidade seu correspondente descanso, um binômio que será fundamental para compreender a evolução do direito do trabalho e do direito ao descanso semanal contemporâneo. Digamos, em segundo lugar, que o Senhor Deus providenciou o trabalho no Éden: “O Senhor Deus colocou o homem no jardim do Éden para cuidar dele e cultivá-lo”.(8) Portanto, não é certa a ideia de que o trabalho é o resultado do pecado: ao contrário, é um trabalho árduo aquele que deriva do pecado segundo a tradição hebraico-cristã. Antes, na ausência do pecado, havia uma espécie de bom trabalho. Foi o pecado original, que levou Deus a condenar Adão e Eva, e por isso a toda a humanidade, a “ganhar o pão com o suor da sua testa”. “Por isso o Senhor Deus o mandou embora do jardim do Éden para cultivar o solo do qual fora tirado”. (9) O Talmude diz: “Se o homem não encontra seu alimento como animais e pássaros, precisa ganhá-los, isso se deve ao pecado”. Essa sentença, de caráter histórico, promove a ideia de trabalho como meio para expiar o pecado original, mas também como meio para produzir; isto é, legitimando a mudança inerente a todo trabalho e, portanto, legitimando também aquela vontade transformadora que caracterizou desde sempre os povos hebreus.(10) Agora, ao contrário dos caldeus, para os hebreus da antiguidade, o trabalho nunca teve um fim ético em si mesmo, mas foi constituído apenas como um meio. Essa visão esteve sempre presente, e caracteriza muito claramente a concepção que muitos integrantes de nossas sociedades contemporâneas possuem sobre o trabalho, além da religião de cada um. -/- 4. OS ROMANOS E O TRABALHO -/- Os romanos, por sua vez, deram uma importante contribuição para o desenvolvimento do conceito de trabalho. Se bem que, a grosso modo, não houvesse grandes diferenças com o pensamento dos gregos, com quem eles tinham em comum, além disso, uma maior divisão do trabalho fruto do desenvolvimento econômico e o uso massivo de mão de obra escrava(11); a maior contribuição do ponto de vista de sua originalidade histórica estava presente na tradição jurídica que inauguraria o Império Romano. O maior impacto por meios jurídicos e não filosóficos é explicado pelo fato de que os romanos, ao contrário dos gregos, não conseguiram “inspirar” a produção de grandes pensadores sociais. Com efeito, para os romanos, como o escravo não era considerado uma pessoa, o viam-no desprovido de personalidade jurídica. Isso conduziu a negação da relação de trabalho entre a pessoa encarregada de um trabalho manual (escravo) e seu dono. Tal relação correspondia, acima de tudo, ao direito de propriedade que os juristas romanos haviam garantido quase sem limites para seus cidadãos. O problema, como aponta Hopenhayn, surgiu quando o proprietário não ocupa seu escravo, mas aluga-o para terceiros. Surge assim a figura do arrendamento de serviços, que deriva do arrendamento das coisas. Porém, como na realidade o que se alugava era a força de trabalho, a qualidade jurídica desloca-se para a atividade realizada pelo escravo. Dessa forma, a atividade do trabalhador, primeiro do escravo, posteriormente do homem livre, começa a ser tratada como uma coisa, e se converte em antecedente do arrendamento de serviços do Direito Civil moderno. Ademais, na tradição romana, o trabalho manual estava desprestigiado. Cícero (106-43 a.C.) em De Officiis, estabeleceu com fria claridade “ipsa merces est auctoramentum servitius”(12) (todo trabalho assalariado é trabalho escravo). A vida era difícil para esses trabalhadores: nos territórios sob domínio romano, Augusto (63-14 a.C.) tinha imposto um tributo à todos os homens que exerciam algum tipo de trabalho manual, além do imposto à residência, às valas e outros mais particulares como o imposto para a detenção de porcos. Certamente, aqueles que levaram a pior parte no tempo da Roma Imperial foram os escravos (servi) sob domínio e propriedade de seus donos (domini). Me seus tempos de auge, a demanda de escravos em Roma era de 500.000 ao ano. Se compararmos com os 60.000 escravos negros trazidos a América nos anos de maior tráfico, teremos uma ideia mais ou menos exata da magnitude desse triste fenômeno. -/- 5. O CRISTIANISMO E O TRABALHO -/- As mensagens do cristianismo primitivo, são inseridas logo, nesse tempo histórico, onde Roma se tornava o centro das maiores mobilizações de rebeldia da antiguidade. Isaías, nesse sentido, proclamaria que o Messias viria: “[...] a pregar boas novas aos abatidos, a vendar aos quebrantados de coração, a publicar liberdade aos cativos, e aos presos a abertura do cárcere”.(13) Jesus, efetivamente, incluiu em sua missão, mensagens de libertação aos pobres e oprimidos. Porém, ao contrário do supracitado, como bem sinala Eric Roll (1907-2005), dos antigos profetas hebreus, não o faria saudando as comunidades tribais com seu espírito de grupo; mas animado por uma mensagem mais universal e permanente, proclamando uma mudança mais completa e integral na conduta do homem em sociedade, onde os valores de justiça e amor se colocariam em um primeiro plano. Evidentemente, a mensagem do cristianismo primitivo, e mais concretamente de Cristo, distava muito dos filósofos gregos. Deixemos que Roll explique: Temos visto que as doutrinas econômicas de Platão e, em certa medida, de Aristóteles, nasciam da aversão aristocrática ao desenvolvimento do comercialismo e da democracia. Seus ataques contra os males que acarreta o afã de acumular as riquezas são reacionárias: olham para trás, e o de Cristo olha para frente, pois exige uma mudança total, mas relações humanas. Aqueles sonhavam com um estado ideal destinado a proporcionar a “boa vida” para os cidadãos livres unicamente e cujas fronteiras eram as da cidade-estado daquele tempo; Cristo pretendeu falar por todos e para todos os homens. Platão e Aristóteles haviam justificado a escravidão; os ensinamentos de Cristo sobre a fraternidade entre todos os homens e o amor universal eram incompatíveis com a ideia da escravidão, apesar das opiniões expostas depois por São Tomás de Aquino. Os filósofos gregos, interessados somente pelos cidadãos, sustentaram opiniões muito rígidas sobre a diferente dignidade das classes de trabalho, e consideravam as ocupações servis, com exceção da agricultura, como próprias apenas para os escravos. Cristo, ao dirigir-se aos trabalhadores de seu tempo, proclamou pela primeira vez a dignidade de todas as classes de trabalho, assim materiais como espirituais (1942. p. 42 – Tradução própria). Não pode escapar desse estudo, o fato de que o próprio Jesus Cristo herdou o ofício de carpinteiro de seu “Pai” José; e que escolheu seus discípulos entre os pescadores e artesãos da região. Essa visão primitiva do cristianismo, no entanto, deve ser analisada no quadro das escrituras sagradas do Antigo Testamento que compartilha com a cultura (e obviamente a religião) hebraica. Nesse sentido, o trabalho não deixa de ser um meio, descartando-se como um fim em si mesmo. Mas, agora atribuindo-lhe um novo valor, sempre em tento um meio para um fim virtuoso: o trabalho será fundamental para permitir a satisfação das necessidades de cada um, mas também seus frutos, deverão ser inseridos em uma dimensão comunitária, onde o “próximo” necessitado esperará a contribuição fraterna e solidária do cristão. O trabalho, nessa perspectiva, não só possibilita o “tomar”, mas também o “dar”. Em relação a dupla perspectiva, é onde podemos entender a crítica do cristianismo a acumulação da riqueza. Como aponta o evangelista Mateus, “acumular o tesouro no céu, onde nem a traça nem a ferrugem os consomem, e onde os ladrões não perfuram nem roubam. Onde está o seu tesouro está seu coração”. (14) Com São Paulo se incorpora um novo componente valioso: a obrigatoriedade moral do trabalho. Em sua carta aos Tessalonicenses dita claramente “ao que não trabalha que não coma”. Diz São Paulo: Vocês sabem em que forma têm que nos imitar: nós trabalhamos enquanto estivemos entre vocês, não pedimos a ninguém um pão que não teríamos ganhado, senão que, de noite e dia, trabalhamos duramente até nos cansarmos, para não ser carga para nenhum de vocês [...] Além disso, quando estávamos com vocês lhes demos está regra: se alguém não quiser trabalhar, não coma. Mas agora ouvimos que há entre vocês alguns que vivem sem nenhuma disciplina e não fazem nada, muito ocupados em meter-se em tudo. A estes lhes mandamos e lhes rogamos, por Cristo Jesus, nosso Senhor, que trabalhem tranquilos para ganhar a vida (II Tes. 3:10). Essa frase, entendida somente no contexto de uma sociedade donde não existia um conceito de desemprego tal como entendemos atualmente, é curiosamente reproduzida pelo modelo soviético em pleno século XX. Com efeito, a Constituição da União Soviética estabeleceu em seu Artigo 12: “O trabalho é, na Rússia, uma questão de dever e de honra para todo cidadão fisicamente capaz. Essa obrigação é baseada no princípio: “quem não trabalha não come”. (15)(16) Para São Paulo, o trabalho deve ser o meio para ganhar a vida. Ele quis ser exemplo e enquanto pregava continuava trabalhando, presumivelmente como tecelão de tendas. A obrigatoriedade moral se aplica na medida em que a pessoa está em condições de o fazer. Para os incapacitados a fazê-lo (idosos, crianças, deficientes, doentes, acidentados etc.) existia a obrigatoriedade do socorro segundo a máxima do amor (ágape) ao próximo. Essas sentenças morais têm hoje em dia uma importante quota de explicação para com as contemporâneas políticas sociais. -/- 6. O TRABALHO NA IDADE MÉDIA -/- A Idade Média, período que ocupa desde o crepúsculo do Império Romano do Ocidente no século V pelos bárbaros, até o século XV, com a queda de Constantinopla, evidentemente mostra um conjunto importante de escolas e pensadores que marcaram pautas importantes para discernir o valor do trabalho nas diferentes culturas. A organização econômica mais visível nestes mil anos, onde operou o trabalho, consistia em extensões grandes de latifúndios errados do Império Romano (o sistema econômico denominado feudalismo), onde (mediante a falta de escravos) recorreu-se à mão de obra camponesa para o trabalho. O sistema, implicava o arrendamento de parte dessas terras a ex-escravos ou homens livres, em troca de uma renda em dinheiro e espécies, além do cultivo das próprias terras senhoriais. Por certo, a figura do servo não distava muito da do escravo se tivermos em conta as condições de funcionamento do contrato de trabalho. O comércio também teve seu lugar no sistema feudal, o mesmo adquiriu grande importância em certas regiões ou lugares, à exemplo de Constantinopla. A atividade econômica seguia seu rumo na história, e depois dos séculos IX e X, o crescimento das forças produtivas deu lugar a uma maior acumulação por parte de componentes e artesãos e, por certo, a uma maior apropriação de excedentes por parte do Senhor feudal. Essa situação foi ativante para a construção dos primeiros Burgos ou cidades, onde o comércio e a indústria artesanal teriam um marco mais adequado para o seu desenvolvimento. Essa é a etapa do nascimento dos primeiros grêmios corporativos (17). Então para o século XII, a estrutura feudal começa a desmoronar porque a produção de determinados bens começa a ser mais eficiente em cidades e não no feudo. O dinheiro, então, passou a ganhar maior peso que a terra, o que obriga os senhores feudais a aumentar seus rendimentos. Isso leva a um empobrecimento lógico dos camponeses, o que não dura muito, porque na primeira metade do século XIV, a maior parte dos servos alcança sua liberdade. Por sua vez, nessa apertada síntese da história econômica da Idade Média, devemos assinalar que pelo século XIV, e depois das Cruzadas e o posterior desenvolvimento do comércio internacional entre os impérios arábico e bizantino, inaugura-se uma etapa pré-capitalista que durará três séculos. É lá que se levanta mais energética a voz de alguns homens da Igreja contra a tendência à exaltação da riqueza já começava a avivar-se na Europa. São Tomás de Aquino, nesse sentido, não considerará ao comércio pré-capitalista bom ou natural. No entanto, ele o julgava inevitável uma vez que era o meio ao qual o comerciante tinha que manter a sua família. Dessa forma, os lucros do comércio não era outra coisa senão o fruto do trabalho. Se tratava, então, de colocar o acento na justiça da mudança efetuada, para o qual Aquino recorre a Aristóteles, cuja análise sobre o valor de mudança é figurado no seu estudo da Justiça. Muitos padres da Igreja, desde então, pretenderam formular um conceito de “preço justo”. Nesse sentido, o Cristianismo apresenta uma evolução do seu pensamento sobre o comércio que partia de uma visão absolutamente contrária ao começo da Idade Média (Santo Agostinho (354-430), São Jerônimo (347-420) etc.), a outra mais transacionável, que acompanhou, sobretudo, o pensamento de Aquino. Algo similar ocorreu com outro dos “preceitos” da Igreja em matéria econômica: a usura. Esta era considerada pela igreja como a melhor forma de obter lucro. O mesmo evangelista Lucas (século I d.C.) foi categórico ao rejeitar essa linha de operações. A lei hebraica também fez isso, e podemos encontrar no livro do Êxodo (22,25) tal proibição a respeito. Mais atrás no tempo, há antecedentes de condenação à usura entre os hindus (Rigveda, cerca de 1500 a.C.) e budistas (século VI d.C.), além do Islã mais próximo do nosso tempo (século VI d.C.). Ao princípio da Idade Média, como testemunha Roll, a proibição somente alcançava a Igreja, já que o escasso desenvolvimento mercantil não merecia outra coisa. No final da Idade Média, no entanto, que a situação é outra; e a prática secular foi orientada no sentido de promover o empréstimo de dinheiro cobrando por isso um juro. Alarmada ante esses fatos, a Igreja condena mais uma vez a usura no Terceiro Concílio de Latrão de 1179. No mesmo escreveu e ensinou São Tomé (século I d.C.) e outros discípulos da Igreja. No entanto, as práticas econômicas foram minando a autoridade eclesial e está terminou, através de sucessivas etapas, por aceitar, em certas condições e sob certas circunstâncias, a cobrança de juros sobre a concessão de um empréstimo. Em tal sentido, um dos autores mais representativos só início da Idade Média foi Santo Agostinho. Foi este um dos pilares, em seu tempo, das noções “anticapitalistas” que foram seguidas e complementadas por homens do tamanho de São João (347-407), São Ambrósio (340-397), São Clemente (150-215), São Cipriano (200-258) entre outros. (18) Santo Agostinho valoriza o trabalho recordando em tal sentido a São Paulo, a que cita com muita frequência em seus textos. Segundo o Bispo de Hipona, todo trabalho manual é bom pelas razões dadas pelo cristianismo primitivo. Concilia, além disso, seu dualismo platônico, ao sustentar que enquanto o homem trabalha tem a alma livre, de modo que é perfeitamente compatível pensar em Deus ao mesmo tempo em que se trabalha. Essa particular sintonia entre o trabalho e a oração foi perfeitamente posta a prova pelos monges beneditinos, cujo lema “Ora Et Labora” (orar e trabalhar) é paradigmático. “Trabalha e não desesperes” dizia seu fundador, São Bento de Núrsia (480-547), de seus monastérios distribuídos em um primeiro momento a Subiaco, no início do século VI. Também corresponde a São Bento uma sentença que perdura até o dia de hoje no imaginário moral sobre o trabalho: “Otiositas inimica est animae” (a ociosidade é inimiga da alma), tal qual diz uma expressão popular castelhana: “el ocio es la madre de todos los vicios” (o ócio é a mãe de todos os vícios). Tomás de Aquino, alguns séculos depois, continua a reflexão sobre o trabalho e estabelece uma hierarquia de profissões, onde localiza o trabalho agrícola e artesanal acima do comercial. Uma quota de originalidade na história do pensamento sobre o trabalho consistiu em considerá-lo como uma obrigação somente se necessário para subsistir; ou dito de outra maneira: quem não tem necessidade de trabalhar não tem que fazê-lo. Isso sim, à falta de trabalho, devia dedicar-se à oração e contemplação divina, atividades por certo mais elevadas para o autor da Suma Teológica. Logo, considerará que Deus é a causa primária, a que tudo deve a sua existência; por derivação, o homem é causa segunda, procurando atreves do trabalho “criar” em suas dimensões humanas. “Entre todas as formas com que a criatura humana tenta realizar a semelhança divina, não há outra de relevo mais destacado que a de trabalhar, isto é, ser em o mundo causa novos efeitos”, disse o Santo. (19) Aquino, além disso, utilizando categorias platônicas, hierarquiza o trabalho, considerando o intelectual acima do manual. Chama “artes servis” a estes últimos, enquanto que o trabalho intelectual corresponde ao conjunto das “artes liberais”, dignas de maior remuneração ao fazer uso da inteligência. Esta distinção própria da Escolástica, dá lugar à divisão clássica entre as 7 artes liberais: o Trívium (gramática, retórica e dialética) e quadrivium (astronomia, geometria, aritmética e música). Outras contribuições de São Aquino têm a ver com sua posição diante do trabalho agrícola ao qual o considera como o melhor meio para assegurar a subsistência de um povo; a maior importância dada à vida contemplativa sobre a ativa, embora considerando a primeira como “laboriosa”; sua posição sobre a escravidão, que não considerava como natural, no entanto, entendê-la “útil”(20); e sua interpretação sobre o contrato de trabalho: neste, o operário não vende a si mesmo, nem seu corpo, nem sua inteligência, nem sequer sua faculdade de trabalho. Isso significa que o Direito Natural proíbe considerar o trabalho como um objeto de mudança. Propõe, em vez disso, considerar o contrato como um arrendamento de serviço. Em termos gerais, a valorização que sobre o trabalho se realiza na Idade Média, rebaixando ao trabalho manual em relação a outras tarefas, fica explícita na divisão tripartida que recorre, entre outros, Adalberão Bispo de Laon (947-1030): “Triplex Dei ergo domus est quae Creditor uma nunca oran, alii pugnat, Aliique laborant” (ternária é a casa do Senhor e não uma: aqui sobre a terra uns oram, outros lutam e outros trabalham). Não gostaria de deixar passar por alto, finalmente, entre os movimentos originados na Idade Média, a contribuição que sobre o tema do trabalho teve a ordem franciscana. Essa, contra o que muitos podem crer, é uma ordem não mendicante no sentido estrito, mas sim trabalhadora e de pobreza. São Francisco de Assis (1181/82-1226), no final do século XII, marcaria como ninguém dentro do cristianismo, uma vida ascética baseada no trabalho e na pobreza. Inclui, além disso, um elemento pela primeira vez descoberto na cultura europeia: o sentido da alegria que acompanha o trabalho. “Essa condição de 'suor de sua testa' com 'a alegria de seu coração' outorga ao trabalho uma condição diferenciada”. Avançando então na história da humanidade, entramos na época moderna, caracterizada por cinco grandes eventos: -/- 1. A decadência do poder moral da Igreja e o enfraquecimento de seu poder econômico frente ao da crescente burguesia; -/- 2. O renascimento intelectual e artístico; -/- 3. As viagens paras as índias e a descoberta da América; -/- 4. A formação e a constituição dos Estados-nação; -/- 5. As reformas religiosas de Lutero (1483-1546) e Calvino (1509-1564). -/- Nesse contexto, os séculos XV e XVI mostraram como o mercantilismo ia avançando apesar dos esforços de alguns pensadores da Igreja que eventualmente perderam o pulso diante do desenrolar dos acontecimentos. Sucessivas encíclicas papais terminaram por legitimar o interesse nos empréstimos e, por meio desta, levou-se a maior acumulação de riquezas por parte dos banqueiros. Esse foi o meio ideal para o desenvolvimento da atividade do mercador, para quem, o trabalho passou a ser considerado um meio para obter sucesso. Ao dinamizar-se a atividade econômica e mercantil, a visão humanista do trabalho começa a perder valor, realçando-se ao mesmo como um simples meio para fins de enriquecimento. Talvez a exceção a essa noção estendida entre os novos atores tenha sido a proporcionada pelo humanismo renascentista. Para Campanella (1568-1639), por exemplo, sua “Cidade solar”, não existe o divórcio entre trabalho manual e intelectual, isso quando o segundo começa a ser supervalorizado por sua ação no plano das invenções e das novas técnicas.(22) Na mesma linha se situa Thomas More (1478-1535), o autor de “Utopia”, outra reação do cristianismo às projeções que estava adquirindo o cada vez mais influente mercantilismo. Embora o trabalho não seja considerado como um mau, pelo contrário, apresenta características humanizadoras, é sugestivo comprovar como em Utopia a jornada do trabalho não supera as seis horas diárias e na Cidade solar não se devia trabalhar mais que quatro horas. Indubitavelmente, essas versões de sociedades ideais terminariam por impactar sobre maneira a constituição das Missões Jesuítas na América do Sul; e as Franciscanas na Baixa Califórnia. É o Renascimento, o lugar propício, além disso, para renovar o conceito da virtuosidade, agora traduzida na figura do empresário ou financista audacioso e empreendedor. Essa linha foi reforçada logo por Calvino, para quem os negócios são um bom serviço a Deus, e a riqueza não é mais que um fruto de uma vida dedicada ao trabalho desde uma perspectiva ética que analisarei com Weber mais tarde, mas que confere ao trabalho a particularidade de ser um caminho para o sucesso. Esse puritanismo impulsionou sobremaneira a versão do “homo economicus” que mais tarde, em pleno auge do capitalismo pós-industrial, ao qual, segundo Daniel Bell (1919-2011), fora substituído pelos valores hedonistas. -/- REFERENCIAL TEÓRICO AGOSTINHO. Suppose that you're certain that a certain sentence, e.g. "Frida is tall", lacks a determinate truth value. What cognitive attitude should you take towards it—reject it, suspend judgment, or what else? We show that, by adopting a seemingly plausible principle connecting credence in A and Determinately A, we can prove a very implausible answer to this question: i.e., all indeterminate claims should be assigned credence zero. The result is striking similar to so-called triviality results in the literature on modals and (...) conditionals. (shrink)

Few have given an extended treatment of the non-statistical sense of normality: a sense captured in sentences like “dogs have four legs,” or “hammers normally have metal heads,” or “it is normal for badgers to take dust baths.” The most direct extant treatment is Bernhard Nickel’s Between Logic and the World, where he claims that the normal or characteristic for a kind is what we can explain by appeal to the right sorts of explanations. Just which explanatory strategies can ground (...) normalities, though, is difficult to determine without inviting circularity into the account. After raising this and other worries for Nickel’s account, I develop my own account according to which normal features are those which are explained by the kind of thing involved. (shrink)

In 2018 Academic Placement Data and Analysis ran a survey of doctoral students and recent graduates on the topics of diversity and inclusivity in collaboration with the Graduate Student Council and Data Task Force of the American Philosophical Association. We submitted a preliminary report in Fall 2018 that describes the origins and procedure of the survey [1]. This is our final report on the survey. We first discuss the demographic profile of our survey participants and compare it to the United (...) States general population, its doctoral students, and APA membership, finding several areas of underrepresentation (i.e. gender, race/ethnicity, socioeconomic, and veteran status). We then discuss the results of questions regarding diversity and inclusivity. We find, for instance, that participant comfort in philosophy depends on gender, sexuality, race/ethnicity, disability, and language status and that participants most often mentioned the theme of diversity when asked how philosophy could be more inclusive. Finally, we discuss the results of questions related to graduate program and placement. We find, for example, that underrepresented graduates are both less likely to recommend their graduate program to others and less likely to prefer an academic job. We close by making some recommendations for the APA and for the discipline based on our findings. (shrink)

In this paper, I offer a new interpretation of Aristophanes’ speech in Plato’s Symposium. Though Plato deliberately draws attention to the significance of Aristophanes’ speech in relation to Diotima’s (205d-206a, 211d), it has received relatively little philosophical attention. Critics who discuss it typically treat it as a comic fable, of little philosophical merit (e.g. Guthrie 1975, Rowe 1998), or uncover in it an appealing and even romantic treatment of love that emphasizes the significance of human individuals as love-objects to be (...) valued for their own sakes (e.g. Dover 1966, Nussbaum 1986). Against the first set of interpreters, I maintain that Aristophanes’ speech is of the utmost philosophical significance to the dialogue; in it, he sets forth a view of eros as a state of lack and a corresponding desire for completion, which is the starting-point for Diotima’s subsequent analysis. Against the second, I argue that Aristophanes’ speech contains a profoundly pessimistic account of eros. Far from being an appreciative response to the individuality of the beloved, eros, for Aristophanes, is an irrational urge, incapable of satisfaction. It is this irrationality that precludes Aristophanes’ lovers from achieving the partial satisfaction of erotic desire that is open to their Socratic counterparts through their relationship to the forms. This is a book manuscript in progress. The book is a defence of pragmatist quietism in meta-ethics. Some other recent defences of meta-ethical quietism don't provide much in the way of argument for it; still less do they try to ensconce it within a more general explanatory picture of inquiry and the world. But that's what I try to do here, the "picture" being a pretty hardcore version of pragmatism. -/- I tell people it's like "Rorty for dorks".

In How We Understand Others: Philosophy and Social Cognition, Shannon Spaulding develops a novel account of social cognition with pessimistic implications for mindreading accuracy: according to Spaulding, mistakes in mentalizing are much more common than traditional theories of mindreading commonly assume. In this commentary, I push against Spaulding’s pessimism from two directions. First, I argue that a number of the heuristic mindreading strategies that Spaulding views as especially error prone might be quite reliable in practice. Second, I argue that current (...) methods for measuring mindreading performance are not well-suited for the task of determining whether our mental-state attributions are generally accurate. I conclude that any claims about the accuracy or inaccuracy of mindreading are currently unjustified. (shrink)

Several philosophers have argued that human enhancements should be considered a potential solution to climate change. In this paper, I consider one such argument offered by S. Matthew Liao, Anders Sandberg, and Rebecca Roache. I argue that, while their argument is plausible, we have an even stronger reason to consider enhancements a potential solution. In a recent paper in this journal, Tobias Fuchs has offered a ‘working test’ for well-being. According to this test, if it is fitting to feel compassion for a subject because they have some property, then the subject is badly off because they have that property. Since subjects of deception seem a fitting target for compassion, this test is said to imply that a number of important views, including hedonism, are false. I argue that this line of reasoning is mistaken: (...) seems fitting does not imply is badly off. I suggest that Fuchs’s test can tell us little about well-being that we do not already know; and ultimately, tests of the sort he proposes can yield little insight into the nature of well-being. Comesaña and Tal have used a contentious account of evidence possession to claim that an ``evidence of evidence is evidence'' principle of R. Feldman (EEE3) is (true but) trivial. We demonstrate to the contrary that, on the Comesaña--Tal account of evidence possession, EEE3 is false.

Desde os anos 1990, os efeitos da globalização na lei e nos desenvolvimento jurídico têm sido um tópico central no debate acadêmico. Até o presente, o debate foi, contudo, marcado por três lacunas que este capítulo tentará remediar a partir de uma reconceptualização do direito global como o direito de intercontextualidade marcado pela inter-juridicidade e materializado por meio de um corpo de normas que podem ser caracterizadas por sua conectividade. A primeira lacuna é de ordem histórica e empírica. Tanto os (...) críticos quanto os defensores da “lei não estatal” compartilham a premissa de que a “lei além do Estado” e as normas jurídicas correlatas teriam ganhado relevância nos tempos atuais se comparadas a períodos históricos anteriores. Enquanto o direito global, incluindo tanto o direito público e privado de governança global, bem como as construções regionais, como da União Europeia, passou por profundas transformações desde as estruturais, que seguiram os processos de descolonização em meados do século XX, constata-se que não há mais instrumentos de direito global em comparação com outros tipos de lei no mundo contemporâneo do que havia em outros períodos históricos. A segunda lacuna é metodológica. A maioria das produções acadêmicas sobre o direito global é ou de natureza analítica, trazendo reflexões a partir do campo da filosofia, ou de natureza empírica, observando a existência do direito global e os graus de conformidade às normas global em um dado período histórico. Embora essas duas metodologias tenham seu mérito, elas são estáticas, incapazes de explicar e de avaliar a transformação do direito global ao longo do tempo. A terceira lacuna é teórico-conceitual. Em diversas instâncias, o direito global é compreendido como uma lei unitária que produz normas de escala planetária, ou, alternativamente, adota-se uma perspectiva pluralista radical que descarta a existência de normas globais singulares. No entanto, ambas as abordagens parecem não compreender as características estruturais, função e efeitos societários do direito global. Ao contrário, uma terceira posição entre as perspectivas unitárias e radicais pode ser adotada por meio de uma compreensão do direito global e normas legais relacionadas como um tipo descentralizado de direito intercontextual e caracterizado pela inter juridicidade. O direito global pode ser definido como um fenômeno que, a princípio, é ilimitado em alcance, isto é, detém validade sem referência ou limitação a um território ou população específica, embora, por razões práticas, seja submetido a alguma limitação na maioria dos casos. Isso torna o direito global distinto do direito nacional, internacional, transnacional e da lei viva de base comunitária quando definidos da seguinte maneira: direito nacional, a lei dos estados-nação derivada do conceito de soberania; o direito internacional, a lei entre estados-nação; direito transnacional, qualquer lei que, em termos de jurisdição, origem ou efeito, ultrapassa as fronteiras nacionais, produzindo externalidades positivas ou negativas, enquanto continua a depender dos instrumentos e mecanismos legais dos estados; lei viva, normas sociais preenchendo a função de lei no seio de uma comunidade. Esses quatro tipos de lei podem agir, potencialmente, como fonte do direito global inter-jurídico na medida em que são empregadas numa forma intercontextual. Refletindo essa estrutura inter-jurídica, o conteúdo normativo substancial do direito global é caracterizado por uma relativa predominância estrutural de normas de conectividade. Normas de conectividade estão orientadas a facilitar o transplante, isso é, a extração, transmissão e incorporação dos componentes de significado de um contexto jurídico-legal para outro, como, por exemplo, no caso do comércio internacional e das leis de investimento, lei comercial doméstica ou leis aprovadas sobre atividades missionárias no contexto das leis religiosas. O conceito de normas de conectividade, portanto, diferencia-se do entendimento clássico sobre as normas de coerência, cuja finalidade é dar coerência no âmbito de uma coletividade sob a base de prescrições de ações que limitem o escopo de possíveis ações futuras e estabelecer sanções para a não-conformidade. Diferencia-se, ainda, de um entendimento progressivo sobre as normas como normas de possibilidade, implicando a articulação de futuros possíveis com base numa distinção entre o factual e o não-factual, isto é, mediante o distanciamento do mundo factual, com o objetivo de acentuar a abertura do futuro. Assim sendo, as normas de conectividade são, em outras palavras, um terceiro tipo de normas localizado entre as normas de coerência e as normas de possibilidade. (shrink)

While increasing attention has been paid in recent years to the relation between Foucault’s conception of critique and Kant’s, much controversy remains over whether Foucault’s most sustained early engagement with Kant, his dissertation on Kant’s Anthropology, should be read as a wholesale rejection of Kant’s views or as the source of Foucault’s late return to ethics and critique. In this paper, I propose a new reading of the dissertation, considering it alongside 1950s-era archival materials of which I advance the first (...) scholarly appraisal. I argue that Foucault manifests a fundamental ambivalence to Kantian anthropology, rejecting it in theoretical terms while embracing its practical (‘pragmatic’) conception of the subject. Furthermore, I take these texts to collectively evidence Foucault’s attempt to situate himself within the anthropological-critical tradition rather than extricating himself from it. If we interpret Foucault to reject this tradition’s appeal to an essentialized, theoretical conception of subjectivity, what remains of anthropology is its inherent practical reflexivity in structure. Thus, I situate Foucault’s conception of ethics as one’s relation to oneself in continuity with this tradition. (shrink)

In addition to protecting agents’ autonomy, consent plays a crucial social role: it enables agents to secure partners in valuable interactions that would be prohibitively morally risk otherwise. To do this, consent must be observable: agents must be able to track the facts about whether they have received a consent-based permission. I argue that this morally justifies a consent-practice on which communicating that one consents is sufficient for consent, but also generates robust constraints on what sorts of behaviors can be (...) taken as consent- communicating. In this chapter, the embodied consciousness of clubbing and raving is considered through the theory of extended mind, according to which the mind is a distributed system where brain, body, and environment play equal parts. Building on the idea of music as affective atmosphere, a case is made for considering the vibe of a dance party as cognitively, socially, and affectively distributed. The chapter suggests that participating in the vibe affords primary musical consciousness—a kind of pre-reflexive state characterized by affective (...) and bodily knowledge—and speculates about the neural correlates of clubbing and raving by means of an analogy with brain research on psychedelic states. There is a libertarian argument for live donor organ markets, according to which live donor organ markets would be permitted if we simply refrained from imposing any substantive and controversial moral assumptions on people who reasonably disagree about morality and justice. I argue that, to the contrary, this endorsement of live donor organ markets depends upon the libertarians’ adoption of a substantive and deeply controversial conception of strong, extensive property rights. This is shown by the fact that these rights would (...) prevent states intervening in cases of preventable and intuitively impermissible wronging of others that can arise when free individuals engage in voluntary offers and exchanges. I outline two forms of such wronging: discrimination and disrespectful demands. I argue that although these types of acts are morally impermissible, the policy question of whether and how they should be regulated by states is non-trivial. I then argue that there is good reason to think that organ markets would rely on disrespectful demands. This may help explain the widespread moral repugnance people feel toward organ trading. It also provides a prima facie, though not decisive, case for states to prohibit such markets. (shrink)

A compact microcontroller based photoacoustic spectrometer (PAS) has been designed and fabricated. The photoacoustic (PA) cell designed for the present study is of Helmholtz resonator type with a provision to measure the sample behavior as a function of temperature. In this system, an electret microphone is employed to achieve high signal to noise ratio. The microphone compartment is isolated from the sample compartment to avoid the heating effect to the electric microphone which detects the photoacoustic signal. A high-gain low-noise two (...) stage preamplifier, second order bandpass and tunable narrow band-pass filters have been designed with a low noise op-amp LM308 to improve signal quality. C8051F060 microcontroller-based phase sensitive detector has been implemented to measure the amplitude and phase of the signal from the photoacoustic cell. The applications of PAS for phase transition studies on some samples are presented. The designed system is low-cost, very compact and easy to carry the experiments for studying the thermal properties of samples. (shrink)

In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. The Guggenheim’s spring retrospective of the seminal Swedish painter, Hilma Af Klint, has, naturally, evoked a multitude of art critics and visual culture scholars who laud her radical abstraction which, at the beginning of the 20th century, preceded Kandinsky, Malevich, Mondrian. Yet, where much attention has been given to the symbology and motifs riddling Klint’s work – bold, private, untethered and nonrepresentational as they are – there has been a modicum of nuanced thought on how, exactly, esotericism and theology fomented (...) Klint’s pedagogical projects. Jillian Steinhauer, for instance, has underscored Klint’s naturalistic watercolors; featuring flowers and lifelike drawings of women; Summer Landscape (1888) suggests Klint’s technical aptitude for rendering light. Jadranka Ryle, in a clever article titled “Reinventing the Yggdrasil,” invokes Klint’s motif of the Yggdrasil, or the holy tree of Norse mythology, as a political axle for Nordic romanticism. Ryle makes the claim that by redirecting the Yggdrasil towards androgynous abstraction, Klint’s engagement with Norse mythology subverts the nationalist and patriarchal romanticism that previously characterized the nineteenth century’s use of the Yggdrasil. Others have adroitly uncovered biographical fragments from Klint’s life, detailing how she and four friends formed De Fem (“the Five”), an exclusively female coven that met weekly, praying, meditating, and holding seances to commune with spiritual guides. Rather than poise the Swedish maverick within the cannon of abstraction qua a political praxis, feminist subject-being, or historiography – projects that have been exhaustively overwrought, to the point of rendering Klint’s work both mute and reductively technical– I would like to take this time to closely examine simply one of Klint’s paintings and foreground it as an axiomatic modernist injunction between metaphysics and epistemology. While many film theorists declare Agamben as, in equal part, a Deleuzian film theorist, I pose that, through this Benjaminian lens, we can parse distinctive cinematic questions that Agamben exclusively pursues - in particular, cinema's potential as a repurposive counter-dispositif to combat dominant forms via critique. This is not to suggest that parallels do not exist between Agamben and Deleuze’s approaches: as Meillassoux has noted, Deleuze's logic of representation (also known as "correlationism") develops an "image of thought that attempts to (...) overcome the binary separation” between matter and spirit, mind and body. Furthermore, Agamben is unequivocally astricted to the Bergson-bound Deleuzian tradition of "untimeliness," whereby cinema extricates "the fallacious psychological distinction between image as psychic reality and movement as physical reality." Furthermore, both Agamben and Deleuze are committed to a notion of "cinema-thought," as Jean-Luc Nancy terms it, or haecceities of Oneness—a commitment to cinema-as-immanence, or indexing thought, rather than mediating it via hermetic historicism. However, Agamben's concept of gesture, as a prelinguistic mode of communication, suspends the symbolic, replacing taxonomy and, therefore, offers a sublime breach: "Gesture is the communication of a potential to be communicated." In other words, Agamben’s gesture is something of an “enigmatic signifier,” insofar as it is impregnated with a primitive and unconscious meaning. (shrink)

Where Deleuze and Guattari introduce us to “lines of flight,” they transcode the mechanics of “flight” through “capture,” fomenting what is understood by many as Deleuze’s philosophical thesis: forging an analog relationship between univocity and difference via multiplicitious immanence. This is, of course, posed against Freud’s molar unities in their second chapter “One or Several Wolves.” Thus, if Heidegger is the philosopher par excellance of queries between hermeneutics and immanence (the philosopher of anti-immanence), it is Deleuze who asks “what is (...) the relationship between immanence and multiplicity?” While, for radical immanence qua Laruelle and post-Laruelleans, Deleuze is confounded with multiplicity (caught in an eternal Prometheun ἰσονομία (isonomia) where there is no victor), for Deleuze multiplicity and difference are two components that can fit together adeptly. Guided by the principle of univocity, Deleuze describes a world of pure multiplicity—all multiplicities are equally immanent within nature. As Whitehead spoke of “occasions,” Deleuze speaks of specific gatherings (of heterogeneous multiplicities), dubbed “assemblages,” that occasion themselves as blips – blips of singularity on an otherwise smooth plane. Following philosopher Levi R. Bryant's account of "dim media," I situate political lines of flight qua psychogeographies vis-a-vis urban topology. (shrink)

Unlike mainstream Western ethics, African environmental ethics recognizes the interconnectedness and interdependence of all beings than individuality of being. This implies that Africans have often lived in peace and harmony with nature, realizing that the environment is key to life and that everything possesses intrinsic value. It is on the strength of the prevailing observations that this paper is geared toward unraveling African philosophy of environment and in the process argues that Africans indeed do have a philosophy of environment due (...) to their respect and oneness to both the living and nonliving components within the ecosystem. This paper employs the method of exposition, critical analysis as well as argumentation to prove that indeed, Africans have good intentions of taking care of the environment and not abuse it. This is evident in some of their cultural heritage where during some planting seasons, some lands are left fallow for some years to avoid excessive use that leads to erosion, also, many forests and groves are tagged ‘taboo’ to scare away people in order to preserve them as well as the other non-human beings found in the forest. African societies are becoming aware of the shortcomings of Western capitalist value system, because of its aftermath on individual, society, and environment. Many of African conservationist values, moral attitudes and ways of life have been destroyed by the exploitative capitalist ethos of European colonialism and modernity. Three decades of African countries trying to build their economies like the Western models have left her people wallowing in poverty, and her environment exposed to hazards. With this new imbibed Western values, African population (...) will continue to rise, as well as innovation in science and technology, thus, there is a growing need to put adequate measures in place against further environmental degradation. This paper tends to show the ethical implication of environmental crises on African societies. It concludes with the need for Africans to jettison western anthropocentric, capitalist and individualist values for her communal values. This paper further acknowledges that due to modernity, African value systems such as taboo and totems are being outdated. This paper proposes that scientific methods of environmental conservation and Christian ethics in the spirit of African communitarianism can go a long way in curbing ecological problems within the continent. Walter Benjamin’s oft-quoted 1936 essay “The Work of Art in the Age of Its Technological Reproducibility” advances the claim that, for the first time in history, the “function” of the work of art is political, as evidenced by cinema. For Benjamin, film is the “first art form whose artistic character is entirely determined by its reproducibility” and Giorgio Agamben, a contemporary Benjaminian philosopher, further elucidates this “function,” positing that cinema essentially ranks with ethics and politics, not solely with aesthetics, and, (...) consequently, is proximate to philosophy itself. Whereas Deleuze’s Cinema books posed cinema as enacting time in a pure state, Agamben, in his “Notes on Gesture,” breaches from Deleuze’s spatial and cartographic theory of cinema, drawing on Guy Debord’s “détournement via montage,” Simone Weil’s “decreation” and, perhaps most implicitly, from Benjamin. Agamben’s political theory of cinema, motivated by cinema’s “stoppage and repetition of time,” is directly informed by Benjamin’s: “optical unconscious,” appropriation of Brecht’s “social Gestus,” and the relationship between technological reproducibility and aura. Agamben’s “gesture” fastens cinema’s aesthetics not only to ethics and politics, but to the “ontological consistency of human experience,” or to a way of being. (shrink)

This work is an examination of Peter Singer’s notion of speciesism: case for animal rights in Ejagham culture. It primarily deals with an evaluation of the phenomenon of animal rights from the standpoint of Peter Singer’s notion of speciesism. Singer’s notion of speciesism deals with the moral obligation humans owe to animals as against the bias or prejudice that humanity has greater moral worth than non-human animals. Most opponents of speciesism contend that, animals are not members of the moral community (...) as such humans have no moral obligation to them. Contrary to this view, proponents of speciesism argue that animals are capable of suffering and should be considered morally. Thus, the emphasis here is that just like many societies of the world, the Ejagham people are guilty of speciesism. Among the several ways by which speciesism is practiced, this work identifies hunting, deforestation, bush burning and fishing as ways by which the Ejagham people are guilty. Using the tool of critical analysis, evaluation and prescription, this work submits that animals have interest, as such, should be granted rights. (shrink)

The paper, Some Indigenous Solutions to African Environmental Problems: An Appraisal, is written to examine the relevance of African Environmental Philosophies to addressing African environmental problems. African environmental problems include: water pollution, air pollution, land pollution, climate change, flood and many more. Researchers have shown that these problems are caused by phenomena like coal mining, nuclear waste, deforestation, overfishing, wars, etc. It is a known fact that attempts have been made over the years to resolve these problems, with pockets of (...) successes, yet more needs to be done. Nigeria’s Niger Delta Development Commission, Kenya’s Bio-safty Act 2009, The National Environment Policy of Ghana, Oil Pipeline Act 2004, Nuclear Safety and Radiation Protection Act 2004 are a good example of such attempts with pockets of successes and challenges. This work uses the methods of rational speculation and critical analysis to examine aboriginal approaches to resolving African environmental challenges as recorded in Mark Omorovie Ikeke’s Philosophical Consciences, Caroline N. Mbonu’s Ecospiritualism, Thaddeus Metz’s Model Relationalism, and Chimakonam Jonathan Okeke’s Ohanifism. This work charged African environmental policymakers, Lecturers, and Students with the responsibility to understand and apply the theoretical foundation for sustainable living as recorded in the above philosophies. This is the time when Africans must use indigenous African methods and principles to proffer solutions to African environmental problems. (shrink)

Ever since nonhuman entity along with the environment became a major ethical issue, anthropocentric worldviews have been blamed for all that is morally wrong about our dealings with nature. Those who regard themselves as non-anthropocentrists/ holistic scholars typically assume that the West’s anthropocentric axiologies and ontologies instigate all of the environmental degradations associated with human species. In contrast, a handful of environmental philosophers aver that anthropocentrism is entirely acceptable as a foundation for environmental ethics as human’s perspective cannot be entirely (...) removed from the decision-making process. They often argue that it is possible for the man to act responsibly towards the environment for humanity and its future generation. Thus, there is an ever-present tension between anthropocentrism and holism, with each side trying to dominate each other. In my opinion, these extreme views are lump sided, as such lack room for tolerance. The thrust of this paper is to bridge the gap between these ethical theories with the theory of ‘anthropoholism’. Anthropoholism is a thesis in environmental ethics that acknowledges man (anthropo) values, role in the ecosystem as well as the ontology, but argues that despite this position, man is just a part of nature, such that he cannot exist independently of the environment, or can he be understood without reference to the environment. With this, the theory of anthropoholism is able to bridge the gap between the two extreme views by explaining the connection between them. François Laruelle has rightfully earned the title of contemporary French philosophy’s archetypical heretic, having fostered the “non-standard” method of univocal genericity and spurred an altogether radical praxis, inciting a new generation of loyal followers that include Jason Barker and Ray Brassier. Laruelle’s method, often referred to as “non-philosophy” (though “non-philosophy” is an abbreviation of “non-standard philosophy”), withdraws from the metaphysical precept of separating the world into binarisms, perhaps epitomized by the formative division between “universals” and “particulars” in Kant’s Transcendental Deduction. Laruelle’s method also rejects the “evental” nature of Being described by Heiddegger as the foundation for philosophy's “standard model,” which Heidegger termed Ereignis (often translated as “the event of Appropriation”). In its immanence, Laruelle’s “One” is understood as generic identity - an identity/commonality that reverses the classical metaphysics found in philosophy’s bastion thinkers (a lineage that runs from Plato to Badiou), where the transcendental is upheld as a necessary precondition for grounding reality. Instead, Laruelle asserts the “One” as the immanent real: generic, non-philosophical and axiomatic. (shrink)

Drawing on Adorno and Horkheimer's oft-quoted 1944 essay, “The Culture Industry: Enlightenment as Mass Deception,” Bernard Stiegler’s The Age of Disruption affirms that the Frankfurt School duo scrupulously envisaged a “new kind of barbarism,” or an inversion of modernity’s Enlightenment project illustrated by our contemporary political semblance. Surveying the critical social fissures that index contemporary Western civil society—from 9/11 to the 2002 Nanterre massacre and the 2015 Charlie Hebdo shooting—Stiegler diagnoses that our epoch is plagued by the “absence of epoch,” (...) whereby computational capitalism and algorithmic governmentality have extirpated the “transcendental imagination” underlying vital primordial narcissism. In short, these are symptoms a world increasingly “going mad,” in a thousand ways, possible because we are the bearers of “a negative protention of a becoming without future,” yet “we prefer not to say so: we do not want to know about it.”.
