On Friday, the Standing Rock Sioux Tribe filed a motion with the U.S. District Court in Washington, D.C., asking District Judge James Boasberg to throw out Dakota Access’s lawsuit against the Army Corps of Engineers. The Department of Justice, which represents the Corps, filed a similar motion.

The motions do not affect the lawsuit filed by Standing Rock Sioux Tribe against Corps permits, which are currently held in abeyance pending the recently initiated Environmental Impact Statement (“EIS”) process considering route alternatives.

After initially supporting the Army Corps against the Tribe’s earlier litigation about the pipeline, the company shifted its position to sue the Corps in November of 2016, arguing that it had all the permissions it required in order to complete the pipeline across Lake Oahe. The lawsuit came as a surprise, as the company had previously acknowledged that it still required a real estate easement — that has not yet been granted — before finalizing construction. The lawsuit came after the Corps announced on December 4, 2016, that it would prepare an EIS considering both the Tribe’s treaty rights and route alternatives to the Lake Oahe crossing.

In its motion to the Court asking it to dismiss the company’s lawsuit, the Tribe explained how the Corps has not, and could not have, issued the easement yet. It also explained how the Corps’ decision to provide a full EIS on route alternatives for the pipeline was legally required and appropriate in light of the history of the Sioux.

“The Dakota Access corporation's lawsuit is a desperate attempt to bully the government into getting the easement and violating Standing Rock’s rights,” said Dave Archambault II, Standing Rock Chairman. “It will not succeed. We look forward to working with the Corps on an EIS that fully takes into account our history and our rights, and are confident that the easement at Lake Oahe will ultimately be denied.”

In early September 2016, the Do No Harm Coalition at UCSF (University California San Francisco) was invited to help create a free clinic at the camp of the Standing Rock Lakota Dakota and their supporters who are gathering to protect access to clean water and dignity of their ancestral lands. In November 2016, UCSF Native American health students under the Native American Health Alliance at UCSF assumed the role of indigenous leadership for this exciting project.

The Mni Wiconi (Water is Life) Health Clinic is a free integrative clinic that is developing with Standing Rock Sioux Tribe traditional healers, UCSF providers and students, National Nurses United, Changing Woman Initiative (indigenous midwifery group) and Global Health Care Alternative Project to provide free care to all people on tribal land in the Standing Rock Sioux reservation. At the invitation of the tribe, our consortium’s goal is to create a space for the imagining and practice of decolonized medicine in order to further the health of the community in the short-term with the expanded population due to pipeline resistance and in the longterm after the encampments have dissolved.

We are currently raising funds to build the clinic, to cover general liability and the necessary equipment and medications to practice responsibly. This clinic will employ two local Lakota health workers, a physician and a tribal healer, and will be staffed with volunteer nurses from RN Response Network (NNU), volunteer visiting physicians with a plan for medical student involvement from UCSF.

Our shared vision is to create a community-based clinic with indigenous leadership, following self-determined models for health resilience and a place where indigenous practitioners dominate the health care experience.

Members of the UCSF community (faculty, staff and trainees) traveling to Standing Rock do so as private citizens, volunteering 100% of their time and effort. Travel and activities, including any medical assistance provided through a free clinic there are not UCSF-sanctioned activities. UCSF has allowed its institutional crowdfunding platform to be used by an interested group of UCSF students and community members who are in the process of completing registration as a registered campus organization. It is their intent to raise funds to create a free clinic at Standing Rock that will operate under the authority of the Standing Rock Sioux Tribe and not UCSF.

(Jan 9, 2017 teleSUR) "Standing Rock Looks to Get Suit Against Army Corps Dismissed" The nation also filed a lawsuit against Corps permits given to the oil company. The Standing Rock Sioux Tribe has filed a motion with the U.S. District Court in Washington, D.C., asking for the dismissal of Dakota Access’s lawsuit against the Army Corps of Engineers, which had also filed its own motion against the oil company, Earthjustice, the law firm representing the tribe, said Monday.

The motion is against a lawsuit filed by Energy Transfer Partners in November asking District Judge James Boasberg to declare it legal that the company has the right to build the Dakota Access pipeline on the tribe’s sacred lands across Lake Oahe.
