The Supreme Court already has a list of digital civil liberties issues to consider in the near future, and that list is likely to grow.
If confirmed, President Donald Trump’s nominee to fill the late Justice Antonin Scalia’s seat on the Supreme Court—Judge Neil Gorsuch of the U.S. Court of Appeals for the Tenth Circuit—will be in a position to make crucial decisions affecting our basic rights to privacy, free expression, and innovation.

The Supreme Court is being asked to consider a pair of cases dealing with law enforcement obtaining cell phone location records: the U.S. v. Graham ruling out of the Fourth Circuit Court of Appeals and the U.S. v. Carpenter out of the Sixth Circuit Court of Appeals. In both cases, the courts ruled that law enforcement did not need a warrant to obtain long-term, historical cell phone location data pinpointing a suspect’s location and movement.
Song lyrics are some of the most searched-for topics on the Internet. This has lead to fierce competition among lyrics sites. If you scroll to the bottom of one of these websites, you’ll see the claim: “Song discussions is protected by U.S. Patent No. 9,401,941.” We are honoring this “song discussions” patent as January’s Stupid Patent of the Month.
EFF has submitted comments to the Patent Office urging it not to support efforts to undermine the Supreme Court’s recent decision in Alice v. CLS Bank. The Patent Office had called for public submissions regarding whether “legislative changes are desirable” in response to recent court decisions, including Alice. We explain that, far from harming the software industry, Alice has helped it thrive.
Patent trolls were down but certainly not out in 2016. After a massive burst of litigation at the end of last year, we saw a noticeable drop in patent troll lawsuits at the start of this one. But trolls began returning to court as the year continued and 2016 will likely end with a relatively small overall decline. Consistent with recent trends, troll cases clustered in the Eastern District of Texas.
