It's a very busy news day today. In particular, with the important decision from the U.S. Supreme Court (on corporations being granted religious rights and chipping away at more union rights) and the usual partisan chum which is irresistible to network and cable news wags, I'd hate to see this jaw-dropping report from James Risen at New York Times get lost amidst all the holiday week noise.

This amazing story reveals that the billion-dollar private security contracting firm Blackwater, hired by the George W. Bush Administration for all manner of things in Iraq and Afghanistan and elsewhere, was apparently even running rough-shod over the U.S. government itself. An investigation into allegations of their corrupt activities in 2007 --- well before their employees are said to have opened random automatic-weapon fire on a crowd in Iraq's Nisour Square (leading to deaths of 17 civilians, including a 9-year old boy) and the enormous blowback against U.S. troops and other interests that subsequently came with it --- was reportedly shut down by the Administration at the time after the firm's "top manager" in Iraq threatened the U.S. State Department's investigator looking into Blackwater's unbridled abuse of power and contract corruption.

According to documents buried by the U.S. government until now, Blackwater's chief in Iraq, Daniel Carroll warned State Dept. investigator Jean C. Richter to his face "that he could kill me at that very moment and no one could or would do anything about it as we were in Iraq".

The government's investigation of Blackwater went away almost immediately thereafter...

On Friday, a three judge panel of the U.S. Circuit Court of Appeal in D.C. reinstated a criminal case against four of five Blackwater (now known as "Xe") mercenaries who had been indicted for voluntary manslaughter in connection with the Nov. 16, 2007 massacre of Iraqi civilians in Nisur Square.

The five guards, as reported by Reuters, were originally "charged with 14 counts of manslaughter, 20 counts of attempt to commit manslaughter and one weapons violation count over a Baghdad shooting that outraged Iraqis and strained ties between the two countries." The decision by the appellate court panel was unanimous and seen as "a victory to the U.S. Justice Department in a high-profile prosecution dating to 2008."

The five had been part of a 23 member Blackwater team known as Raven 23 who "submitted sworn written statements to the State Department using a form that included a guarantee that the statement and...evidence derived therefrom would not be used in a criminal proceeding against the signer," the court stated in its redacted opinion.

The District Court dismissed the case on the grounds that the government had failed to prove that the evidence it was relying upon was not derived or affected by the immunized statements. The Court of Appeal ruled that the District court had erred by treating all of the evidence as tainted instead of conducting an independent, line-by-line analysis as to whether the evidence was independently obtained from other sources, including Iraqis present at the massacre, noting "when armed guards shoot a number of people in a crowd, it doesn't take Hercule Poirot to start wondering what the crowd was doing."

While criminal proceedings continue against these four, low-level former Blackwater mercenaries, Blackwater and its founder Erik Prince are not amongst the accused --- this despite the never resolved, explosive allegations, discussed in our Aug. 10, 2009 article, "Blackwater = Murder, Inc." that the company and its founder had engaged in "murder, destruction of evidence, weapons smuggling" and other sordid crimes...

There is no issue of greater import to the aspirations of a democratic people than matters of war and peace. There can be no greater display of contempt for democracy on the part of an American President than that reflected by a covert decision to engage in a secret war without the knowledge or consent of Congress or the American people.

As late as 2002, George W. Bush felt compelled to seek some semblance of compliance with the War Powers Resolution of 1973, albeit via deceit in which false claims of Iraqi WMD and links to al Qaeda were presented in order to secure Congressional approval of the Authorization for Use of Military Force Against Iraq Resolution.

According to Jeremy Scahill (video below), "in '03/'04 the Bush administration issued an Executive order that authorized U.S. forces to go anywhere in the world where al Qaeda was to fight them; essentially declared the whole world a battlefield..."

The WikiLeaks Pakistan/Yemen cables confirm that President Barack Obama, possibly relying upon the Bush/Cheney cabal's extremist position that the Sept. 14, 2001 Authorization for Use of Military Force Against Terrorists ("AUMF") is tantamount to a blanket license to initiate wars anywhere and everywhere there is a "suspected" presence of al Qaeda, has both perpetuated and expanded these dangerous claims of lawless Executive power...

I wonder why those who were so "outraged" about supposed ACORN corruption (even though it all turned out to be fabricated Rightwing fiction) are not outraged in the slightest about the latest alleged corruption of Blackwater which has now resulted in an actual federal indictment of its former President.

Andrew Breitbart's big big big "Big Government" website, which made its name last year by publishing the phony ACORN "Pimp" Hoax videos hasn't found time to even mention last week's criminal indictments of top Blackwater officials, despite the company receiving BILLIONS in federal tax-payer dollars --- versus the millions ($3.5m/year on average) that ACORN received over the last 15 years.

It's as if Breitbart and his Tea Bag Boyz don't actually care about corruption of federal tax-payer dollars. Hell, they don't even seem to care about actual prostitution --- even CHILD prostitution --- rings being run on the Government dime, since Blackwater is also fighting two different court cases in which former employees allege the company did exactly that, in both Iraq and Afghanistan, with their BILLIONS in federal tax dollars. Yet still not a peep about that either on any of Andy's websites. Go figure.

On Aug. 20, 2009 The New York Times published a front-page article:

[Emphasis added]The Central Intelligence Agency in 2004 hired outside contractors from the private security contractor Blackwater USA as part of a secret program to locate and assassinate top operatives of Al Qaeda, according to current and former government officials.

A substantially similar article appeared in the Washington Post and in the Los Angeles Times.

The New York Times article provided limited background information on Blackwater aka Xe, referencing what amounted to a massacre of 17 unarmed Iraqi civilians gunned down by Blackwater mercenaries in Nisoor Square as simply an instance in which Blackwater had been "accused of using excessive force."

In "Blackwater = Murder, Inc." I covered the explosive allegations made in sworn statements by two former Blackwater employees --- murder, weapons smuggling, corruption, and the use of child prostitutes. I argued:

Now, that same corporate press learned from "official sources" that Blackwater is linked to former Vice President Richard B Cheney's "assassination wing." It repeats, without challenge, the official source contention that the only ones targeted by the "assassination wing" were senior al Qaeda officials --- this despite Jeremy Scahill's and Keith Olbermann's revelation that John Doe 2, reportedly a former member of Blackwater's management, alleged:

After Blackwater guards opened fire and killed 17 Iraqis in the Nisoor Square section of Baghdad on Sept. 17, in true Bushie fashion, the State Dept. unilaterally conferred limited immunity on the Blackwater personnel who were on the scene --- including apparently the guards who opened fire --- in exchange for their statements detailing the events.

According to an ABC report, of the 17 Blackwater guards at the scene of the incident, only five fired their weapons. And an investigation by the FBI reportedly has turned up evidence that only three of the 17 people shot had been involved in attacking the Blackwater detail.

Now comes word that a federal grand jury has been impaneled to investigate the shootings:

The limited immunity given to the Blackwater personnel presents another question: Would it prevent justice from being served if the grand jury finds evidence that the killing of the 14 apparently innocent Iraqis was unprovoked?

Howard Krongard, the inspector general (IG) for the Bush State Dept., has recused himself from a second major probe under his purview. The new recusal was announced yesterday and came at the "request" of House Oversight and Government Reform Committee Chairman Henry Waxman (D-CA).

This new development follows a dramatic moment during a hearing before Waxman's committee on Wednesday when Kronberg was forced to recuse himself from an investigation into Blackwater after it was revealed that, despite his earlier denials, his brother sits on an advisory board for the controversial paramilitary government security contractor. Making matters potentially worse for Krongard, his brother, Buzzy Krongard, issued a statement after the hearing contradicting Howard's testimony regarding the timing of when Howard learned that Buzzy had accepted a seat on the Blackwater board.

It is unclear at the moment whether Democrats on the committee will pursue perjury charges against the State Dept. IG.

Krongard's latest recusal stems from what appears to be obstruction of justice and witness tampering in a criminal probe by the Dept. of Justice into the way billions of dollars in contracts for the construction of the U.S. embassy complex in Baghdad were let by the State Dept.:

James L. Golden, an embassy project overseer who works on a contract basis for the State Dept. in Washington, and who is also said to be a subject of the DoJ probe, may be the other person of interest Krongard met with.

Sean McCormack, a State Dept. spokesman, said Krongard recused himself from the embassy contracts investigation at Chairman Waxman's request:

Despite Krongard's removal from the two highest profile investigations by his office, McCormack says he still has the confidence of Sec. of State Condoleeza Rice.
