This paper explores some consequences of Lewis’s (Australas J Philos 74(4):549–567, 1996) understanding of how knowledge is compartmentalized. It argues, first, that he underestimates how badly it impacts his view. When knowledge is compartmentalized, it lacks at least one of two essential features of Lewis’s account: (a) Elusiveness—familiar skeptical possibilities, when relevant, are incompatible with everyday knowledge. (b) Knowledge is a modality—when a thinker knows that p, there is no relevant possibility where p is false. Lewis proposes compartmentalized knowledge to (...) keep treating knowledge as a modality while mitigating one of its unrealistic epistemological implications: In normal modal epistemic logic (and standard possible world semantics), a thinker always counts as knowing the strongest proposition that follows from the set of all the individual propositions that this thinker knows. Lewis’s compartmentalization proposal is that thinkers merely know the conjunctions of propositions that are known in each of, but not across, their compartments. The irony is that in avoiding overblown knowledge the view now allows for thinkers to attend to skeptical error possibilities and yet knowledge is present. The account avoids inflation of knowledge in one sense only to acquire another type of knowledge the view denies subjects can have. This problem motivates an inspection of knowledge accounts whose intra-compartment closure principles are weaker than those that are valid in normal modal-logic. The conclusion is that some formulations of closure can avoid the challenge Lewis’s view faces. Nevertheless, even these closure principles pose a barrier—perhaps an implausible barrier—for knowledge of ignorance. Even when the reasoning supporting the lack of knowledge is sound, a subject cannot always know she doesn’t know. Interestingly, this obstacle is one that knowledge of knowledge doesn’t seem to face. The aim of the consequentializing project is to show that, for every plausible ethical theory, there is a version of consequentialism that is extensionally equivalent to it. One challenge this project faces is that there are common-sense ethical theories that posit moral dilemmas. There has been some speculation about how the consequentializers should react to these theories, but so far there has not been a systematic treatment of the topic. In this article, I show that there are at least five (...) ways in which we can construct versions of consequentialism that are extensionally equivalent to the ethical theories that contain moral dilemmas. I argue that all these consequentializing strategies face a dilemma: either they must posit moral dilemmas in unintuitive cases or they must rely on unsupported assumptions about value, permissions, requirements, or options. In "Analyticity and Ontology," I argued that there are counterexamples to the claim that the sentences analytically entailed by a claim $\phi$ require nothing more of the world for their truth than does $\phi$. The counterexamples involve sentences which, I argued, are analytically entailed by certain truths, but which nevertheless require more of the world for their truth. John Horden has offered two interesting criticisms of this argument. First, he contends that its conclusion is inconsistent. Second, he contends that the (...) argument faces a dilemma, depending on which of two hypotheses about the meanings of the sentences involved in the counterexamples turns out to be true. Here I reply to Horden's criticisms and briefly indicate what I take their lesson to be. (shrink)

David Hume is widely recognized as providing the most influential statement of the “compatibilist” position in the free will debate — the view that freedom and moral responsibility can be reconciled with (causal) determinism. The arguments that Hume advances on this subject are found primarily in the sections titled “Of liberty and necessity”, as first presented in A Treatise of Human Nature (2.3.1-2) and, later, in a slightly amended form, in the Enquiry concerning Human Understanding (sec. 8). Although there is (...) considerable overlap in content between these two statements of Hume's position, there are also some significant differences. This includes, for example, some substantial additions in the Enquiry discussion as it relates to problems of religion, such as predestination and divine foreknowledge. While these differences are certainly significant they should not be exaggerated. Hume's basic strategy and compatibilist commitments in both works remain the same in their essentials.. (shrink)

We show that any coherent complete partial order (ccpo) is obtainable as the fixed-point poset of the strong Kleene jump of a suitably chosen first-order ground model. This is a strengthening of Visser’s result that any finite ccpo is obtainable in this way. The same is true for the van Fraassen supervaluation jump, but not for the weak Kleene jump.

The immediate aim of this paper is to articulate the essential features of an alternative compatibilist position, one that is responsive to sources of resistance to the compatibilist program based on considerations of fate and luck. The approach taken relies on distinguishing carefully between issues of skepticism and pessimism as they arise in this context. A compatibilism that is properly responsive to concerns about fate and luck is committed to what I describe as free will pessimism, which is to be (...) distinguished from free will skepticism. Free will skepticism is the view that our vulnerability to conditions of fate and luck serve to discredit our view of ourselves as free and responsible agents. Free will pessimism rejects free will scepticism, since the basis of its pessimism rests with the assumption that we are free and responsible agents who are, nevertheless, subject to fate and luck in this aspect of our lives. According to free will pessimism, all the major parties and positions in the free will debate, including that of skepticism, are modes of evasion and distortion regarding our human predicament in respect of agency and moral life. Vector models of language are based on the contextual aspects of words and how they co-occur in text. Truth conditional models focus on the logical aspects of language, the denotations of phrases, and their compositional properties. In the latter approach the denotation of a sentence determines its truth conditions and can be taken to be a truth value, a set of possible worlds, a context change potential, or similar. In this short paper, we develop a vector semantics for language based (...) on the simply typed lambda calculus. Our semantics uses techniques familiar from the truth conditional tradition and is based on a form of dynamic interpretation inspired by Heim's context updates. (shrink)

In a recent paper we have defined an analytic tableau calculus PL_16 for a functionally complete extension of Shramko and Wansing's logic based on the trilattice SIXTEEN_3. This calculus makes it possible to define syntactic entailment relations that capture central semantic relations of the logic---such as the relations |=_t, |=_f, and |=_i that each correspond to a lattice order in SIXTEEN_3; and |=, the intersection of |=_t and |=_f,. -/- It turns out that our method of characterising these semantic relations---as (...) intersections of auxiliary relations that can be captured with the help of a single calculus---lends itself well to proving interpolation. All entailment relations just mentioned have the interpolation property, not only when they are defined with respect to a functionally complete language, but also in a range of cases where less expressive languages are considered. For example, we will show that |=, when restricted to L_{tf}, the language originally considered by Shramko and Wansing, enjoys interpolation. This answers a question that was recently posed by M. Grenon and Smith (2004) propose a framework for the ontology of things in space and time involving and invoking the distinction between continuants and occurrents, which has become a key element of Basic Formal Ontology (BFO). The terminology of SNAP (from “snapshot:” state of a continuant at a time) and SPAN (how an occurrent develops over an interval or timespan) occurs in that paper’s title. While any commonsense ontology will have a place for both continuants and occurrents, there is much (...) room for philosophical debate on whether one of them is more basic than the other, or can be reduced to the other, or whether they are equally fundamental, or whether they are two different perspectives on the same reality. Grenon and Smith opt for the last of these. They call the accounts of continuants (SNAP) and occurrents (SPAN) both “ontologies.” They do not have a single ontology of all that is in space and time. This dialog throws a few of the common arguments around a bit and comes to no sure conclusion. But one of the characters bears a faint resemblance to a certain Buffalonian philosopher. (shrink)

So far, color-naming studies have relied on a rather limited set of color stimuli. Most importantly, stimuli have been largely limited to highly saturated colors. Because of this, little is known about how people categorize less saturated colors and, more generally, about the structure of color categories as they extend across all dimensions of color space. This article presents the results from a large Internet-based color-naming study that involved color stimuli ranging across all available chroma levels in Munsell space. These (...) results help answer such questions as how English speakers name a more complex color set, whether English speakers use so-called basic color terms (BCTs) more frequently for more saturated colors, how they use non-BCTs in comparison with BCTs, whether non-BCTs are highly consensual in less saturated parts of the solid, how deep inside color space basic color categories extend, or how they behave on the chroma dimension. This chapter assesses theories of the nature of personal love in Anglophone philosophy from the last two decades, sketching a case for pluralism. After rejecting arationalist views as failing to accommodate cases in which love is irrational, and contemporary quality views as giving love the wrong kind of reason, it argues that other theories only account for different subsets of what a complete theory of love should explain. It therefore concludes that while love always consists in valuing someone as a (...) particular individual, there are multiple ways of doing this, corresponding to multiple kinds of love. (shrink)

Proofs of God in Early Modern Europe offers a fascinating window into early modern efforts to prove God’s existence. Assembled here are twenty-two key texts, many translated into English for the first time, which illustrate the variety of arguments that philosophers of the seventeenth and eighteenth centuries offered for God. This article draws on the antebellum political thought of Black abolitionists Frederick Douglass and Martin Delany in critically assessing the efficacy of reasonableness in advancing the aims of emancipatory politics in political discourse. I argue, through a reading of Douglass and Delany, that comporting oneself reasonably in the face of oppressive ideology can be counterproductive, if one's aim is to undermine such ideology and the institutions it supports. Douglass and Delany, I argue, also provide us with a framework for evaluating (...) alternative discursive strategies we might wish to employ in light of the limited value of reasonableness for emancipatory politics. The ‘managed-metabolism’ hypothesis suggests that a ‘cooperation barrier’ must be overcome if self-producing chemical organizations are to undergo the transition from non-life to life. This dynamical barrier prevents un-managed autocatalytic networks of molecular species from individuating into complex, cooperative organizations. The barrier arises because molecular species that could otherwise make significant cooperative contributions to the success of an organization will often not be supported within the organization, and because side reactions and other ‘free-riding’ processes will undermine cooperation. As a result, (...) the barrier seriously impedes the emergence of individuality, complex functionality and the transition to life. This barrier is analogous to the cooperation barrier that also impedes the emergence of complex cooperation at all levels of living organization. As has been shown at other levels of organization, the barrier can be overcome comprehensively by appropriate ‘management’. Management implements a system of evolvable constraints that can overcome the cooperation barrier by ensuring that beneficial co-operators are supported within the organization and by suppressing free-riders. In this way, management can control and manipulate the chemical processes of a collectively autocatalytic organization, producing novel processes that serve the interests of the organization as a whole and that could not arise and persist in an un-managed chemical organization. Management self-organizes because it is able to capture some of the benefits that are produced when its interventions promote cooperation, thereby enhancing productivity. Selection will therefore favour the emergence of managers that take over and manage chemical organizations so as to overcome the cooperation barrier. The managed-metabolism hypothesis demonstrates that if management is to overcome the cooperation barrier comprehensively, its interventions must be digitally coded. In this way, the hypothesis accounts for the two-tiered structure of all living cells in which a digitally-coded genetic apparatus manages an analogically-informed metabolism.GraphicalOpen image in new window. One argument for the moving spotlight theory is that it better explains certain aspects of our temporal phenomenology than does any static theory of time. Call this the argument from passage phenomenology. In this paper it is argued that insofar as moving spotlight theorists take this to be a sound argument they ought embrace a new version of the moving spotlight theory according to which the moving spotlight is a cresting wave of causal efficacy. On this view it is more (...) than just presentness that is temporary: a range of other fundamental properties are also temporary because presentness synchronically changes the fundamental properties that are instantiated in the present moment, from those instantiated when that moment is future, or past. On this view having experiences as of presentness co-varies with the presence of presentness, allowing the moving spotlight theorist to provide a compelling explanation for why we have the temporal phenomenology we do, and to explain how we can know that we are present by reflecting on the nature of said phenomenology. Summary of the major innovations of Emil du Bois-Reymond (1818-1896).

Can an agent deliberating about an action A hold a meaningful credence that she will do A? 'No', say some authors, for 'Deliberation Crowds Out Prediction' (DCOP). Others disagree, but we argue here that such disagreements are often terminological. We explain why DCOP holds in a Ramseyian operationalist model of credence, but show that it is trivial to extend this model so that DCOP fails. We then discuss a model due to Joyce, and show that Joyce's rejection of DCOP rests (...) on terminological choices about terms such as 'intention', 'prediction', and 'belief'. Once these choices are in view, they reveal underlying agreement between Joyce and the DCOP-favouring tradition that descends from Ramsey. Joyce's Evidential Autonomy Thesis (EAT) is effectively DCOP, in different terminological clothing. Both principles rest on the so-called 'transparency' of first-person present-tensed reflection on one's own mental states. (shrink)

This paper focuses on the research field of machine ethics and how it relates to a technological singularity—a hypothesized, futuristic event where artificial machines will have greater-than-human-level intelligence. One problem related to the singularity centers on the issue of whether human values and norms would survive such an event. To somehow ensure this, a number of artificial intelligence researchers have opted to focus on the development of artificial moral agents, which refers to machines capable of moral reasoning, judgment, and decision-making. (...) To date, different frameworks on how to arrive at these agents have been put forward. However, there seems to be no hard consensus as to which framework would likely yield a positive result. With the body of work that they have contributed in the study of moral agency, philosophers may contribute to the growing literature on artificial moral agency. I argue for an egalitarian conception of modesty. Modesty is a virtue because an apt expression of what is, and is not, morally salient in our attitudes toward persons and is important because we are prone to arrogance, self-importance, and hero worship. To make my case, I consider 3 claims which have shaped recent discussions: first, that modesty is valuable because it obviates destructive social rankings; second, that modesty essentially involves an indifference to how others evaluate one's accomplishments; and third, (...) the widespread but normatively fraught assumption that the modest person is deserving of credit. Although the first 2 features identify something significant about modesty, they fail to ground it. I argue that appeals to deserved credit bear a larger explanatory burden than has been supposed; they can smuggle in the illegitimate social hierarchies that modesty is supposed to counter. I make my case for modesty as an excellence in moral perspective by arguing that prominent, nonegalitarian, accounts of modesty allow for or promote illegitimate forms of social privilege. Modesty is valuable because it expresses a commitment to fair distribution of basic moral recognition and a skillful response to unjust social hierarchies at odds with this fair distribution. Religious conversion gives rise to disagreement with one’s former self and with family and friends. Because religious conversion is personally and epistemically transformative, it is difficult to judge whether a former epistemic peer is still one’s epistemic peer post-conversion, just like it is hard for the convert to assess whether she is now in a better epistemic position than prior to her conversion. Through Augustine’s De Utilitate Credendi (The Usefulness of Belief) I show that reasoned argument should play a crucial (...) role in assessing the evidential value of religious conversions, both for the person who converts and for her (former) peers. The human attempts to access, measure and organize physical phenomena have led to a manifold construction of mathematical and physical spaces. We will survey the evolution of geometries from Euclid to the Algebraic Geometry of the 20th century. The role of Persian/Arabic Algebra in this transition and its Western symbolic development is emphasized. In this relation, we will also discuss changes in the ontological attitudes toward mathematics and its applications. Historically, the encounter of geometric and algebraic perspectives enriched the mathematical (...) practices and their foundations. Yet, the collapse of Euclidean certitudes, of over 2300 years, and the crisis in the mathematical analysis of the 19th century, led to the exclusion of “geometric judgments” from the foundations of Mathematics. After the success and the limits of the logico-formal analysis, it is necessary to broaden our foundational tools and re-examine the interactions with natural sciences. In particular, the way the geometric and algebraic approaches organize knowledge is analyzed as a cross-disciplinary and cross-cultural issue and will be examined in Mathematical Physics and Biology. We finally discuss how the current notions of mathematical (phase) “space” should be revisited for the purposes of life sciences. (shrink)

Do the new sciences of well-being provide knowledge that respects the nature of well-being? This book written from the perspective of philosophy of science articulates how this field can speak to well-being proper and can do so in a way that respects the demands of objectivity and measurement.

Spinoza’s philosophy of mind is thought to lack a serious account of consciousness. In this essay I argue that Spinoza’s doctrine of ideas of ideas has been wrongly construed, and that once righted it provides the foundation for an account. I then draw out the finer details of Spinoza’s account of consciousness, doing my best to defend its plausibility along the way. My view is in response to a proposal byEdwin Curley and the serious objection leveled against it by Margaret (...) Wilson and Jonathan Bennett. (shrink)

I defend an expanded reading of immanent causation that includes both inherence and causal efficacy; I argue that the latter is required if God is to remain the immanent cause of finite modes.

Lethal Autonomous Weapons (LAWs) are robotic weapons systems, primarily of value to the military, that could engage in offensive or defensive actions without human intervention. This paper assesses and engages the current arguments for and against the use of LAWs through the lens of achieving more ethical warfare. Specific interest is given particularly to ethical LAWs, which are artificially intelligent weapons systems that make decisions within the bounds of their ethics-based code. To ensure that a wide, but not exhaustive, survey (...) of the implications of employing such ethical devices to replace humans in warfare is taken into account, this paper will engage on matters related to current scholarship on the rejection or acceptance of LAWs—including contemporary technological shortcomings of LAWs to differentiate between targets and the behavioral and psychological volatility of humans—and current and proposed regulatory infrastructures for developing and using such devices. After careful consideration of these factors, this paper will conclude that only ethical LAWs should be used to replace human involvement in war, and, by extension of their consistent abilities, should remove humans from war until a more formidable discovery is made in conducting ethical warfare. Contrastivism about knowledge is the view that one does not just know some proposition. It is more adequate to say that one knows something rather than something else: I know that I am looking at a tree rather than a bush but I do not know that I am looking at a tree rather than a cleverly done tree imitation. Knowledge is a three-place relation between a subject, a proposition and a contrast set of propositions. There are several advantages of (...) a contrastivist view but also certain problems with it. Classical pragmatists wrote extensively on cognition from a naturalistic perspective, and many of their views are compatible with contemporary pragmatist approaches such as enactivist, extended, and embodied-Bayesian approaches to cognition. Three principles of a pragmatic approach to cognition frame the discussion: First, thinking is structured by the interaction of an organism with its environment. The present dissertation concerns cognitive psychology—theories about the nature and mechanism of perception and thought—during the High Middle Ages (1250–1350). Many of the issues at the heart of philosophy of mind today—intentionality, mental representation, the active/passive nature of perception—were also the subject of intense investigation during this period. I provide an analysis of these debates with a special focus on Durand of St.-Pourcain, a contemporary of John Duns Scotus and William of Ockham. Durand was widely recognized as a leading philosopher (...) until the advent of the early modern period, yet his views have been largely neglected in the last century. The aim of my dissertation, then, is to provide a new understanding of Durand’s cognitive psychology and to establish a better picture of developments in cognitive psychology during the period. -/- Most philosophers in the High Middle Ages held, in one form or another, the thesis that most forms of cognition (thought, perception) involve the reception of the form of the object into the mind. Such forms in the mind explain what a given episode of cognition is about, its content. According to what has been called the conformality theory of content, the content of our mental states is fixed by this form in the mind. Durand rejects this thesis, and one of the primary theses that I pursue is that Durand replaces the conformality theory of content with a causal theory of content, according to which the content of our mental states is fixed by its cause. When I think about Felix and not Graycat, this is to be explained not by the fact that I have in my mind the form of Felix and not Graycat, but rather by the fact that Felix and not Graycat caused my thought. -/- This is both a controversial interpretation and, indeed, a controversial theory. It is a controversial interpretation because Durand seems to reject the thesis that objects are the causes of our mental states. In the first half of the present dissertation, I argue that Durand does not reject this thesis but he rejects another nearby thesis: that objects as causes give to us ‘forms’. On Durand’s view, an object causes a mental state even though it does not give to us a new ‘form’. In the second half of the dissertation I defend Durand’s causal theory of content against salient objections to it. (shrink)

[paragraph 3 of the article] The goal of this article is to flesh out that initial understanding of incarnational immutability. The method I employ to attain this goal is to consider cases of predications from the texts of conciliar Christology. I show potential ontological truth conditions for those predications being true that do not require the truth conditions I propose for immutability to be unsatisfied. Put otherwise, I show ontological truth conditions for predications that imply Christ’s mutability and Incarnation that (...) are also consistent with the truth of “Christ is immutable.” Since the truth conditions for the incarnational texts do not require the falsity of the claim that “Christ is immutable,” the incarnational claims do not require the rejection of immutability. Until recently, experimental philosophy has been associated with the questionnaire-based study of intuitions; however, experimental philosophers now adapt a wide range of empirical methods for new philosophical purposes. New methods include paradigms for behavioural experiments from across the social sciences as well as computational methods from the digital humanities that can process large bodies of text and evidence. Psycholinguistic methods hold great promise for experimental philosophy. Many philosophical thought experiments and arguments proceed from verbal descriptions of possible cases. Many relevant intuitions and conclusions are driven by spontaneous inferences about what else must also be true in the cases described. Such inferences are continually made in language comprehension and production. This chapter explains how methods from psycholinguistics can be employed to study such routine automatic inferences, with a view to assessing intuitions and reconstructing arguments. We demonstrate how plausibility (...) ratings, pupillometry, and reading time measurements can be used to examine hypotheses about automatic inferences in speech and text comprehension. Two experiments on inferences from polysemous (perception-)verbs provide evidence of a potentially consequential ‘salience bias’. Findings help assess intuitions about unusual cases and analyse a philosophical paradox (‘argument from hallucination’). The paper thus illustrates how we can adapt psycholinguistic methods for philosophical purposes and demonstrates the methods’ philosophical usefulness. (shrink)

Hilary Putnam (1981) proposed an interesting and much discussed attempt to refute a skeptical argument that is based on one form of the brain-in-a-vat scenario. In turn, Putnam’s attempted refutation is based on content externalism (also known as semantic externalism). On this view, the referents and meanings of various types of singular and general terms, as well as the propositions expressed by sentences containing such terms, are determined by aspects of the speaker’s external environment. In this entry, we will consider (...) the basic features of and problems with Putnam’s original argument, and we will also present and discuss several of the most important attempts to reconstruct or improve upon that argument. A familiar part of debates about supererogatory actions concerns the role that cost should play. Two camps have emerged: one claiming that extreme cost is a necessary condition for when an action is supererogatory, while the other denies that it should be part of our definition of supererogation. In this paper, I propose an alternative position. I argue that it is comparative cost that is central to the supererogatory and that it is needed to explain a feature that all accounts (...) agree is central to the very notion of supererogation: optionality. Perhaps because of this agreement on its importance, few attempts have been made to clarify and explain the notion of optionality. I argue that giving an account of the optionality of supererogatory requires drawing a line between doing the bare minimum permissible and going beyond the bare minimum and that this line ought to be drawn based on comparative cost of alternative permissible acts. Having outlined my account and motivated it, I discuss and reject two concerns that might be raised: firstly, that it is extreme cost, not comparative cost, that matters and, secondly, that in fact no cost is needed for an act to be supererogatory. If our metaphysical concept of a person is influenced by irrelevant external factors, including political factors, being intellectually responsible requires considering multiple theories in multiple domains and coming to some kind of picture that coheres with as many intuitions about persons in as many domains as possible. Theories that do not meet this standard ought to be rejected. The Integrated Self Theory is influenced by irrelevant political factors, and does not cohere with intuitions about persons in the political and ethical (...) domain. This is because having an integrated self depends upon one’s political standing, i.e., whether one is privileged or not, and therefore, whether one has enough control over the effects of the social and political forces that act upon the self. And, not everyone has the privileged political standing that allows for a fully integrated self. The Integrated Self Theory is not politically neutral. If the integrated self is the ideal of a normally functioning individual, then this leads counting those without a privileged standing, as potentially not counting as persons, an unfair political consequence of the Integrated Self Theory. The Integrated Self Theory, therefore, ought to be discarded. (shrink)

A central idea in Ruth Millikan’s biosemantics is that a representation’s content is restricted to conditions required for the normal success of actions that it has as its function to guide. This paper raises and responds to a problem for this idea. The problem is that the success requirement seems to block us from saying that epistemic modal judgments represent our epistemic circumstances. For the normal success of actions guided by these judgments seems to depend on what is actually the (...) case, not on whether or to what extent various possibilities were supported by our evidence. In response, I argue, first, that actions guided by epistemic modal judgments have as their function to implement strategies for handling epistemic circumstances, second, that the successful performance of this function requires that aspects of these circumstances obtain, and, third, that biosemantics can thus understand epistemic modal judgments as representing these aspects. The recognition of such strategic contents introduces complications; I further argue that these are benign. (shrink)

Recently, many philosophers have claimed that the world has an ordered, hierarchical structure, where entities at lower ontological levels are said to metaphysically ground entities at higher ontological levels. Other philosophers have recently claimed that our language has an ordered, hierarchical structure. Semantically primitive sentences are said to conceptually ground less primitive sentences. It’s often emphasized that metaphysical grounding is a relation between things out in the world, not a relation between our sentences. But conflating these relations is easy to (...) do, given that both types of grounding are expressed by non-causal “in-virtue-of” claims. The purpose of this paper is to clarify the relation between metaphysical and conceptual grounding. I argue that conceptual and metaphysical grounding are exclusive: if a given in-virtue-of claim involves conceptual grounding, then it does not involve metaphysical grounding. I also develop some heuristics for deciding which type of grounding is relevant in a given case. These heuristics suggest that many proposed cases of metaphysical grounding do not actually involve metaphysical grounding at all. (shrink)

This article examines the development of affirmative sexual consent in Canadian jurisprudence and legal theory and its adoption in Canadian law. Affirmative sexual consent requirements were explicitly proposed in Canadian legal literature in 1986, codified in the 1992 Criminal Code amendments, and recognized as an essential element of the common law and statutory definitions of sexual consent by the Supreme Court of Canada in a series of cases decided since 1994. Although sexual violence and non-enforcement of sexual assault laws are (...) worldwide phenomena, the international scholarly literature reflects limited awareness of these developments in Canadian law. This article remedies that gap in the literature. The Canadian experience with the definition of sexual consent as communicated “voluntary agreement” demonstrates the value of this conceptualization of consent; the definition provides a well-defined set of nondiscretionary reference points for legal analysis of the facts in sexual assault offenses. The effect is to facilitate effective enforcement of the sexual assault laws and affirm the right to sexual autonomy, sexual self-determination, and equality, consistent with fundamental principles of individual human rights. For all these reasons, familiarity with the Canadian experience may be useful to those engaged with the reform of rape and sexual assault laws in other jurisdictions. (shrink)

There are two chief tasks which confront the philosophy of scientific method. The first task is to specify the methodology which serves as the objective ground for scientific theory appraisal and acceptance. The second task is to explain how application of this methodology leads to advance toward the aim(s) of science. In other words, the goal of the theory of method is to provide an integrated explanation of both rational scientific theory choice and scientific progress.

Most philosophers in the High Middle Ages agreed that what we immediately perceive are external objects. Yet most philosophers in the High Middle Ages also held, following Aristotle, that perception is a process wherein the perceiver takes on the form or likeness of the external object. This form or likeness — called a species — is a representation by means of which we immediately perceive the external object. Thomas Aquinas defended this thesis in one form, and Durand of St.-Pourçain, his (...) Dominican successor, rejects it. This paper explores Durand's novel criticism of Aquinas's species-theory of cognition. I first develop and defend a new interpretation of Durand's central criticism of Aquinas's theory of cognition. The aim of this paper is to show that the concept of vagueness based on an S4 modal operator C of clearness (Ca to be read as “It is clear that a”, “It is definitely the case that a”, or something similar) leads to a concept of columnar higher-order vagueness. More precisely, the paper shows the following: Weakly scattered topological spaces provide a class of topological models for modal logic for which the topological translation of C (and of the “unclearness (...) operator” U related to C) satisfy the requirements of columnar higher-order vagueness. Polar spaces, recently introduced by Rumfitt to cope with the Sorites paradox, turn out to be a particularly philosophically interesting class of weakly scattered spaces. All topological spaces support a concept of stably columnar vagueness that is only slightly weaker than proper columnar vagueness. For all topological spaces, the boundaries of sets that satisfy the McKinsey axiom are columnar. The set of McKinsey sets has the structure ofa Boolean algebra. (shrink)

Infallibilism is commonly rejected because it is apparently subject to easy counter-examples. I describe a strategy that infallibilists can use to resist this objection. Because the sentences used in the counter-examples to express evidence and belief are context-sensitive, the infallibilist can insist that such counter-examples trade on a vacillation between different readings of these sentences. I describe what difficulties await those who try to produce counter-examples against which the proposed strategy is ineffective.

Martin Heidegger (1889–1976) is one of the most influential philosophers of the twentieth century. His influence, however, extends beyond philosophy. His account of Dasein, or human existence, permeates the human and social sciences, including nursing, psychiatry, psychology, sociology, anthropology, and artificial intelligence. In this chapter, I outline Heidegger’s influence on psychiatry and psychology, focusing especially on his relationships with the Swiss psychiatrists Ludwig Binswanger and Medard Boss. The first section outlines Heidegger’s early life and work, up to and including the (...) publication of Being and Time, in which he develops his famous concept of being-in-the-world. The second section focuses on Heidegger’s initial influence on psychiatry via Binswanger’s founding of Daseinsanalysis, a Heideggerian approach to psychopathology and psychotherapy. The third section turns to Heidegger’s relationship with Boss, including Heidegger’s rejection of Binswanger’s Daseinsanalysis and his lectures at Boss’s home in Zollikon, Switzerland. (shrink)

I explore what BernardWilliams means by regarding one’s action ‘purely externally, as one might regard anyone else’s action’, and how it links to regret and agent-regret. I suggest some ways that we might understand the external view: as a failure to recognize what one has done, in terms of Williams’s distinction between intrinsic and extrinsic luck, and as akin to Thomas Nagel’s distinction between an internal and external view. I argue that none of these captures what Williams was getting at (...) because they do not allow one to take a view on one’s action. I offer two alternative accounts. One turns around what we identify with, the other concerns what we care about. Both accounts capture how I might regret, rather than agent-regret, my own action. I demonstrate that these accounts can explain the relationship between an insurance payout and the external view, and they can explain the agent-relativity of agent-regret. (shrink)

Recognizing that truth is socially constructed or that knowledge and power are related is hardly a novelty in the social sciences. In the twenty-first century, however, there appears to be a renewed concern regarding people’s relationship with the truth and the propensity for certain actors to undermine it. Organizations are highly implicated in this, given their central roles in knowledge management and production and their attempts to learn, although the entanglement of these epistemological issues with business ethics has not been (...) engaged as explicitly as it might be. Drawing on work from a virtue epistemology perspective, this paper outlines the idea of a set of epistemic vices permeating organizations, along with examples of unethical epistemic conduct by organizational actors. While existing organizational research has examined various epistemic virtues that make people and organizations effective and responsible epistemic agents, much less is known about the epistemic vices that make them ineffective and irresponsible ones. Accordingly, this paper introduces vice epistemology, a nascent but growing subfield of virtue epistemology which, to the best of our knowledge, has yet to be explicitly developed in terms of business ethics. The paper concludes by outlining a business ethics research agenda on epistemic vice, with implications for responding to epistemic vices and their illegitimacy in practice. (shrink)

The concept of 'authenticity' is highly valued on social media sites (SMSes), despite its ambiguous nature and definition. One interpretation of 'authenticity' by media scholars is a human's congruence with online portrayals of themselves (e.g. posting spontaneous photographs from their lives, or using real biodata online). For marketers and 'influencers', these patterns of behaviour can achieve certain gains: sales for a business, or success of a campaign. For existentialist philosophers, using 'authenticity' as a means to an end is against its (...) very definition. In this paper, I investigate what SMS users are looking for by their supposed 'authentic' portrayal online. My experimental approach draws upon empirical data from the Instagram social media site. Using machine learning techniques, descriptions and features of posts - including subjects, captions, and contexts - will be categorised and aggregated. I will then interpret these findings, drawing upon work by Taylor, Golomb, and Guignon, whose works on authenticity are based on mid-20th century existentalists. I argue that the existentialist ideals on authenticity are not necessarily present in contemporary SMS use. I will also argue that the popular interpretation of authenticity on SMSes can be self-defeating, when it seeks to turn the 'for-itself' into an 'in-itself'. (shrink)

Triviality arguments against the computational theory of mind claim that computational implementation is trivial and thus does not serve as an adequate metaphysical basis for mental states. It is common to take computational implementation to consist in a mapping from physical states to abstract computational states. In this paper, I propose a novel constraint on the kinds of physical states that can implement computational states, which helps to specify what it is for two physical states to non-trivially implement the same (...) computational state. In this paper, I use an example from the history of philosophy to show how independently defining each side of a pair of contrary predicates is apt to lead to contradiction. In the Euthyphro, piety is defined as that which is loved by some of the gods while impiety is defined as that which is hated by some of the gods. Socrates points out that since the gods harbor contrary sentiments, some things are both pious and impious. But “pious” and (...) “impious” are contrary predicates; they cannot simultaneously characterize the same thing. Euthyphro changes his definition, but the problem of recognizing emotional ambivalence is only side-stepped. I go on to show how contemporary philosophers run into a similar problem. According to Prinz, something is good if and only if we harbor positive sentiments towards it and bad if and only if we harbor negative sentiments towards it. Thus, if we are ambivalent towards something (if we harbor both positive and negative sentiments towards it), then it is both good and bad. Like “pious” and “impious”, “good” and “bad” are contraries. Next, according to the fitting-attitude theory first elaborated by Brentano and favored by contemporary meta-ethicists like Blackburn, Brandt, Ewing, Garcia, Gibbard, McDowell, and Wiggins, something is good if and only if it is a fitting (appropriate) object of approbation, and something is bad if and only if it is a fitting (appropriate) object of disapprobation. I argue that moral ambivalence is sometimes appropriate, i.e., that the correct response to some things is to both love and hate them. Hence, according to the fitting-attitudes theory, some things are both good and bad. I conclude by discussing a variety of ways in which the problem of ambivalence may be solved, suggesting that attitudes of approbation and disapprobation be further individuated by the reasons for them.
