Maleka says the structure of the agreement under this letter reflects a "clear engagement between Regiments and Transnet" over locomotives but the handwritten note, which is - for now - inexplicable, asserts the contract is between Transnet and McKinsey.

"Chair, it's not normal for a supplier to a customer using a customer's logo in its letterhead [...] using someone else's logo would be unusual," says Sinton. He adds it would be unusual to elevate a letter to a contract, which appears - to him - to be the case here.

Zondo says this letter appears to be addressed to Anoj Signh but toward the end "you are told that he is what has been agreed" and then you have on the last page what any agreement would normally look like. "It just seems strange to me," he begins.

Maleka refers to a contract, says it's "quite clear" Transnet is engaging Regiments for this project before noting a fee structure listed in the letter. Sinton notes an annotation "the contract [...] is with McKinsey and Regiments is contracted to them."

Maleka refers to a letter 19 November 2013 recording Nedbank was replaced because of some conflict of interest. "McKinsey agrees to replace Nedbank with Regiments in the best interests of Transet," says Maleka.

Sinton says, "Staff of Regiments actually commenced work alongside McKinsey work at Eskom [...] and then Mr Wood left Regiments to join Mr Essa at Trillian, and McKinsey appointed Trillian as their supply development partner [...] they felt they had been badly treated."
