Tech-related harassment must also be looked within the context of a broader intimate relationship, as it is often only one of many forms of intimate partner abuse in a relationship to be considered cumulatively, which may lead to circumstantial evidence re the tech piece/3

There is also no reason why "evidence" cannot come from the complainant's/victim's experiences - a black box theory - ie 'only I and one other person have access to this device, and this is what has been happening for the last few weeks/months'.. /2

Typical lawyer answer coming at you, but it depends! Different applications will track and store data differently, in part depending on functionality. A production order may also be able to get at better data than a customer can see in their own account 1/

An important affirmation of s. 8 protection for the interests in shared spaces and electronic devices by the today in R. v. , effectively overruling multiple provincial Courts of Appeal on this issue. A very positive harbinger for privacy in the digital age.
