Last week the complaint was EU courts were not sufficiently independent to hear Brexit disputes. And so we now have proposal of independent arbitration, with independent arbitrators. Today calls this independence "names out of a hat". *weeps*

My first post on the Brexit withdrawal agreement should be tomorrow. This post will be on the real concerns any liberal or democrat should have with the proposals on "governance" - supervision and enforcement of the agreement, including of the transition arrangements.

I have a speech I use over and over at my unions conference when people call to open renegotiation on something or other, that *the other side will ask for extra stuff too* so be very careful what you wish for.......

V good point - the “deal” isn’t conclusively “done” until Council gives its consent, which comes after the European Parliament has given its. eg middle of March 2019.

Complex legal instruments are, well, complex. Provisions interact with other provisions, sometimes multiple times. Provisions interact with other legal instruments, else they are meaningless. Not linear or self-contained. Be wary of those who find complexity quick and simple.

After five days I now feel generally on top of the draft withdrawal agreement. Anyone who has managed to get on top of the text in less time has my admiration. And those politicians who mastered it in a few hours before drafting resignations or deciding to vote against, my awe.

Rejection on the technical basis that “a decision constituting final judgment in any proceedings” was not being appealed, just a request for a reference in ongoing proceedings.

Breaking... ... has refused permission to appeal for the government in the Article 50 case. So off to the ECJ it goes.

Whatever happens, it's now clear that the ERG have significantly overestimated the number of MPs who were prepared to trigger a no-confidence motion. Now have to wonder if they have done the same over number of MPs prepared to vote against the deal when the pressure is really on.

Highly revealing rhetoric. TM has never understood that as EU citizens we have the right to be treated without discrimination based on nationality across 28 states. Brexit means the loss of that incredible right as well as freedom of movement. Ironic also to be ceding sovereignty

On the plus side, UK could also push for changes to the withdrawal agreement. But still no guarantee EU would accept them. Reminder, as always: if you think exit talks are complicated, just wait until UK & EU start talking future trade/security..

'Trust me, UK can negotiate a better, Canada-style deal' says David Davis. He conflates withdrawal treaty and future talks. A Canada deal would require Irish backstop. Very misleading from a former Brexit secretary.

There seems to be confusion on what ll happen on 25th &beyond. The Council (not EUCO) adopts a decision to conclude the agreem once the EP has given its consent. Council ll almost certainly adopt the decision unanimously though formally strong QMV applies table might be of help
