Was the release of the Pentagon Papers also “malevolent intent”? It does not seem that way now, but a grand jury was assembled to try the journalists who released them for conspiracy. (U.S. empire has always been vengeful.) Goodale is arguing to take a longer view on this.

“Computer crimes” laws are very out of date and have dubious origins; the case of Aaron Swartz illustrates how they are used for vindictive purposes. Goodale’s point is that Assange functioned as a journalist, and therefore should be protected like one.
