Background: is now being evicted by her brother, arguing that he is the owner of the house because of a title deed issued by the Republic of Bophuthatswana in 1988 giving him ownership of the house.

The Upgrading Act constitutes indirect unfair discrimination on the listed grounds of race and gender because it effects are predominately felt by black women who could not previously be registered as the holders of land tenure rights
