Formally introducing the measure sets up a vote by the full House, probably by mid-March and perhaps as soon as next week, because of a timeline spelled out by law. Initial passage by the Democratic-run House seems assured. The measure would then move to the Republican-controlled Senate, where there may be enough GOP defections for approval. The moderate senator Susan Collins of Maine said Wednesday she would back a resolution blocking the declaration, making her the first Republican to publicly state her support for the effort to thwart the emergency declaration.

Approval of the resolution is widely expected in the Democratic-controlled House. A vote by the full House is expected in mid-March. If the House passes the resolution, then the GOP-controlled Senate would be required to take it up.

It is not yet clear whether there are sufficient numbers of Republicans senators who would join Democrats in approving the resolution. One moderate, Sen. Susan Collins, R-Maine, said she would support the resolution. But with the Republicans holding a 53-47 majority in the Senate, three other Republicans would have to join Collins for the resolution to have a chance at passage.

And Citizens for Responsibility and Ethics has filed a motion against the Department of Justice demanding that the agency provide documents pertaining to the legal justification of the president’s emergency declaration. California Attorney General Xavier Becerra, who is leading the states coalition, alleges that Trump 'has veered the country toward a constitutional crisis of his own making' despite a refusal by Congress refusing to allocate the funds needed to start construction.

A government watchdog group in Washington, DC, has already filed a lawsuit related to President Donald #Trump’s declaration of a national emergency to build barriers on the #UnitedStates’ border with Mexico, becoming the first of what is likely to be many legal challenges to the president’s unilateral action. The group, Citizens for Responsibility and Ethics in Washington, filed the lawsuit Friday (Feb 15), shortly after Trump’s announcement. It is demanding that the Department of Justice’s Office of Legal Counsel 'provide documents concerning the legal authority of the president to invoke emergency powers.'

CREW said its lawsuit seeks to have the Justice Department honor the group’s Freedom of Information Act request in January for documents showing 'relevant communications, including legal opinions, from OLC, the Department of Homeland Security, and the Department of Defense' as they relate to Trump’s previous threats to declare a national emergency. Shortly after CREW filed its lawsuit, the American Civil Liberties Union announced its intent to challenge the #emergencydeclaration.
