The problem with the powers of the attorney general was summed-up by @afuahirsch in 2010. Nothing has changed. The AG is still in reality a member of the government, & the govt interfering with individual prosecutions is ‘anathema to the rule of law’.

The UK government may make prosecutions of members of its armed forces subject to the approval of its attorney general. This would be a step backwards for justice as the executive -the government- should not be able to interfere in individual cases.

And of course the UK government should always ensure it does not make anyone stateless, for any period of time. It should listen to its own Supreme Court that described the ‘evil of statelessness’ in a judgment in 2013. (6/6)

Anyone threatened with having their citizenship removed needs to be able to access a fully fair hearing, where they and their lawyer can see & challenge the evidence used, & the decision is suspended until any legal challenge is over. Not the current secretive system (5/6).

Any power to remove citizenship should only be used as a last, not a first resort. Those making such a decision need to consider its full impact, including on children and others affected. (4/6).

UK law gives its Home Secretary the power to remove citizenship when he thinks it’s ‘conducive to the public good’. This is hopelessly vague & increases the risk of arbitrary decisions. The legal justification for removing citizenship should be much tighter. (3/6)

Begum’s case shows the alarming powers the UK govt has to strip its citizens of their nationality. The power to take such a drastic step should not rest with one politician, @sajidjavid, subject to political pressure. It should be with an independent figure like a judge. (2/6)
