On 21 Nov 1918 passed the Parliament (Qualification of Women) Act 1918, which allowed women to become MPs for the first time as long as they were 21 years old. At just 27 words, it remains the UK's shortest statute. Most economical!

The agreed the Order should be amended: "to allow domestic UK judges to award damages in the rare cases where there is no other effective remedy available for a violation of human rights caused by a judicial act." (para. 82). 9/?

Evidence was submitted to by pointing out that the Government's approach failed to trust our own judges; left others affected by judicial error to go to Strasbourg & was a waste of public resource. 6/?

Guess what? The Government proposes only to allow judges the discretion to award damages in Article 6 cases where a person has been (a) committed to prison and (b) has not been legally represented. Hmmmmn. 4/?

They respond to the judgment in Hammerton v UK. That case found a violation of Article 13 (right to a remedy) when Mr Hammerton was committed, without legal representation, in violation of Article 6 ECHR. Section 9(3) of the HRA 1998 barred the recovery of damages. 3/?

See today's report on the proposal for a Remedial Order. It would amend s.9(3) of the Human Rights Act to allow for damages when judicial mistakes violate the right to fair trial. Spoiler: it doesn't go far enough. 1/?
