Responsibility and Reactive Attitudes

In ‘Freedom and Resentment,' Strawson argues that we cannot separate holding people morally responsible for their actions from specific emotional responses, which he calls reactive attitudes, which we are disposed towards in response to people's actions. Strawson's view might pose problems for forgiveness, in which we choose to overcome reactive attitudes like resentment without altering the judgments that make them appropriate. I present a detailed analysis of reactive attitudes, which I use both to defend Strawson's account of the connection between (...) these states and responsibility, and to show how we can fit forgiveness into this account. Ignorance is often a perfectly good excuse. There are interesting debates about whether non-culpable factual ignorance and mistake subvert obligation, but little disagreement about whether non-culpable factual ignorance and mistake exculpate. What about agents who have all the relevant facts in view but fail to meet their obligations because they do not have the right moral beliefs? If their ignorance of their obligations derives from mistaken moral beliefs or from ignorance of the moral significance of the facts they have in (...) view, should they be excused for failing to meet their moral obligations? It is not obvious that they should. In this paper we argue that the best non-skeptical accounts of moral responsibility acknowledge that factual ignorance and mistake will diminish moral responsibility in a way that moral ignorance and mistake will not. That is because factual ignorance is often non-culpable so long as it meets certain merely procedural epistemic standards but the same is not true of moral ignorance. Our argument is that the assumption that it is gets the standards of culpability for moral ignorance wrong, and that the mistake is encouraged by the thought that culpability in general requires an instance of known wrongdoing: that acting wrongly requires de dicto unresponsiveness to one’s obligations at some stage. We deny this and conclude that, therefore, ignorance and mistaken belief are indeed often perfectly good excuses – but far less often than some philosophers claim. (shrink)

Peter Strawson defends the thesis that determinism is irrelevant to the justifiability of responsibility-attributions. In this paper, I want to examine various arguments advanced by Strawson in support of this thesis. These arguments all draw on the thought that the practice of responsibility is inescapable. My main focus is not so much the metaphysical details of Strawsonian compatibilism, but rather the more fundamental idea that x being inescapable may be reason for us to regard x as justified. I divide Strawsonian (...) inescapability arguments into two basic types. According to arguments of the first type we cannot give up the practice. According to arguments of the second type we should not give up the practice. My reasons for revisiting these Strawsonian inescapability arguments are, first, to establish that these are different and to some extent conflicting arguments. Second, I hope to show that none of Strawson’s inescapability arguments are convincing. Third, I discuss the possibility that the practice of responsibility is inescapable in a different, more pessimistic sense than envisaged by Strawson. What may be inescapable under conceivable scenarios is the conflict of theoretical and practical considerations in the justification of the practice. (shrink)

Through critical examination of three main contemporary approaches to describing moral responsibility, this book illustrates why philosophers must take into account the relationship between retrospective moral responsibility and desert of praise or blame. The author advances the moral attitude account, whereby desert of praise and blame depends on the agent’s moral attitudes in response to moral reasons, and retrospective moral responsibility results from expressions of those attitudes in overt behavior.

Crucially, blame can be addressed to its targets, as an implicit demand for recognition. But when we ask whether offenders would actually appreciate this demand, via a sound deliberative route from their existing motivations, we face a puzzle. If they would, their offense reflects a deliberative mistake, and blame’s hostility seems unnecessary. If they wouldn’t, addressing them is futile, and blame’s emotional engagement seems unwarranted. To resolve this puzzle, I develop an account of blame as a proleptic response to indeterminacy (...) in its target’s reasons, yielding attractive accounts of blame’s relation both to internal reasons claims and to free will. Almost everyone allows that conditions can obtain that exempt agents from moral responsibility—that someone is not a morally responsible agent if certain conditions obtain. In his seminal Freedom and Resentment, Peter Strawson denies that the truth of determinism globally exempts agents from moral responsibility. As has been noted elsewhere, Strawson appears committed to the surprising thesis that being an evil person is an exempting condition. Less often noted is the fact that various Strawsonians—philosophers sympathetic with Strawson’s account of moral responsibility—at (...) least appear to have difficulty incorporating evil persons into their accounts of moral responsibility. In what follows, I argue that Strawson is not committed to supposing that being evil is an exempting condition—at least, that he can allow that evil persons are morally responsible agents. (shrink)

I shall present a problem about accountability, and its solution by Strawson’s ‘Freedom and Resentment’. Some readers of this don’t see it as a profound contribution to moral philosophy, and I want to help them. It may be helpful to follow up Strawson’s gracefully written discussion with a more staccato presentation. My treatment will also be angled somewhat differently from his, so that its lights and shadows will fall with a certain difference, which may make it serviceable even to the (...) converted. Also, I shall point to some disputable things in ‘Freedom and Resentment’, and offer repairs. So I wrote in the first published version of this paper. I wanted not only to be useful to others but also to elicit Strawson’s certificate of approval; and that hope was realized. In his ‘Reply’ Strawson wrote: ‘Bennett in the first eleven sections of his essay sets out and elaborates the essence of my position with such thorough and sympathetic understanding as to leave me little to say.’ I also tried, unsuccessfully, to analyse with more precision Strawson’s concept of reactive attitude, and to explore the extent of and reasons for the incompatibility between reactive attitudes and the objective attitude. I hoped that the display of my failures would induce Strawson to tackle the problems himself, with more success. No such luck! He wrote: ‘Bennett seeks . . . to produce a tighter and more unified organisation of the phenomena . . . than I achieved in “Freedom and Resentment”’, but he did not return to the fray. On the contrary: ‘It does not seem to me to matter if a strict definition [of ‘reactive’] is not to be had’; and he said nothing about reasons for the reactive/objective conflict. In the present version of the paper, I expound ‘Freedom and Resentment’ much as before. Since my attempts to tighten and deepen the theory failed to hook Strawson, and are not of much intrinsic interest, I now omit them. I shall, however, add an application of the doctrines of ‘Freedom and Resentment’ to the most basic philosophical question regarding punishment.. (shrink)

In his influential work, “Freedom and Resentment,” P.F. Strawson argues that the truth of determinism would be irrelevant to our moral responsibility practices, since our commitment to these practices is somehow connected to both our reactive attitudes—e.g. resentment, gratitude, and love—and participation in interpersonal relationships. However, some of the moves made by Strawson in his work remain unclear. In this paper, I address three prominent attempts to explain these moves, and contend that none of them captures his view because they (...) all focus too narrowly on notions of moral demands and feelings of resentment. I argue that the correct understanding of Strawson’s compatibilism needs to take seriously his close connection between the proneness to feel all of the reactive attitudes and our seeing ourselves as agents. In light of this argument, I conclude by offering a more plausible reading of Strawson’s compatibilism. (shrink)

Recently, a number of authors have suggested that the epistemic condition on moral responsibility makes blameworthiness much less common than we ordinarily suppose, and much harder to identify. This paper argues that such epistemically based responsibility skepticism is mistaken. Section 2 sketches a general account of moral responsibility, building on the Strawsonian idea that blame and credit relates to the agent’s quality of will. Section 3 explains how this account deals with central cases that motivate epistemic skepticism and how it (...) avoids some objections to quality of will accounts recently raised by Gideon Rosen. But an intuitive worry brought out by these objections remains. Section 4 spells out this remaining worry and argues that, like traditional metaphysical responsibility skepticism, it has its source in a non-standard explanatory perspective on action, suggesting that strategies for explaining away the intuitive pull of traditional skepticism are applicable in this case too. In this book, Rik Peels provides a comprehensive original account of intellectual duties, doxastic blameworthiness, and responsible belief. The discussions, relating to work in epistemology as well as moral responsibility, are clear and often provide useful entries into the literature. Though I disagree with some of the main conclusions, the arguments are carefully laid out and typically merit a good amount of thought even where one remains unconvinced. After providing an overview of the contents, I specifically suggest that Peels theory (...) fails to account for one important kind of doxastic obligations and doxastic blame. (shrink)

Recently, a number of people have argued that certain entities embodied by groups of agents themselves qualify as agents, with their own beliefs, desires, and intentions; even, some claim, as moral agents. However, others have independently argued that fully-fledged moral agency involves a capacity for reactive attitudes such as guilt and indignation, and these capacities might seem beyond the ken of “collective” or “ corporate ” agents. Individuals embodying such agents can of course be ashamed, proud, or indignant about what (...) the agent has done. But just as an entity needs to have its own beliefs, desires, and intentions to qualify as a bona fide agent, the required capacity for reactive attitudes is a capacity to have one’s own reactive attitudes. If fully-fledged moral agency requires reactive attitudes, the corporate agent must itself be capable of guilt and indignation. In this paper, we argue that at least certain corporate agents are. Or, more precisely, we argue that if there are bona fide corporate agents, these agents can have the capacities that are both associated with guilt and indignation and plausibly required for moral agency; in particular certain epistemic and motivational capacities. Skeptical worries about moral responsibility seem to be widely appreciated and deeply felt. To address these worries—if nothing else to show that they are mistaken—theories of moral responsibility need to relate to whatever concept of responsibility underlies the worries. Unfortunately, the nature of that concept has proved hard to pin down. Not only do philosophers have conflicting intuitions; numerous recent empirical studies have suggested that both prosaic responsibility judgments and incompatibilist intuitions among the folk are influenced by a number of (...) surprising factors, sometimes prompting apparently contradictory judgments. In this paper, we show how an independently motivated hypothesis about responsibility judgments provides a unified explanation of the more important results from these studies. According to this ‘Explanation Hypothesis’, to take an agent to be morally responsible for an event is to take a relevant motivational structure of the agent to be part of a significant explanation of the event. We argue that because of how explanatory interests and perspectives affect what we take as significant explanations, this analysis accounts for the puzzling variety of empirical results. If this is correct, the Explanation Hypothesis also provides a new way of understanding debates about moral responsibility. (shrink)

In his famous text the Bodhicaryāvatāra, the 8th century Buddhist philosopher Śāntideva argues that anger towards people who harm us is never justified. The usual reading of this argument rests on drawing similarities between harms caused by persons and those caused by non-persons. After laying out my own interpretation of Śāntideva's reasoning, I offer some objections to Śāntideva's claim about the similarity between animate and inanimate causes of harm inspired by contemporary philosophical literature in the West. Following this, I argue (...) that by reading Śāntideva's argument as practical advice rather than as a philosophical claim about rational coherence, his argument can still have important insights even for those who reject his philosophical reasoning. A prominent objection to the so-called ‘knowledge norm of belief’ is that it is too demanding or too strong. The objection is commonly framed in terms of the idea that there is a tight connection between norm violation and the appropriateness of criticism or blame. In this paper I do two things. First, I argue that this way of motivating the objection leads to an impasse in the epistemic norms debate. It leads to an impasse when knowledge normers invoke excuses (...) to explain away a prima facie connection between blamelessness and justified belief. Second, I argue that a way out of the impasse becomes available when we take a closer look at some distinctions in the theory of responsibility. There are at least three different notions of responsibility relevant here. I argue that a weaker notion of responsibility – attributability – should be used to motivate the objection that the knowledge norm of belief is too strong. Insofar as the proposal motivates the objection without appeal to blamelessness, it opens up space to move beyond the impasse. (shrink)

We are planning agents and we are, or so we suppose, responsible agents. How are these two distinctive aspects of our agency related? In his "Freedom and Resentment" Peter Strawson understands responsible agency in terms of "reactive attitudes" like resentment and gratitude, attitudes which are normally embedded in "ordinary inter-personal relationships." I draw on Strawson''s account to sketch an answer to my question about responsibility and planning. First, the fact that an action is plan-embedded can influence the agent''s degree of (...) culpability for that action; for such embeddings can constitute or indicate important facts about the quality of the agent''s will. Second, general planning incapacities can to some extent exempt an agent from normal judgments of responsibility. My argument for this second claim appeals to the normal roles of planning in "ordinary inter-personal relationships.". (shrink)

P. F. Strawson's influential article "Freedom and Resentment" has been much commented on, and one of the most trenchant commentaries is Rajendra Prasad's, "Reactive Attitudes, Rationality, and Determinism." In his article, Prasad contests the significance of the reactive attitude over a precise theory of determinism, concluding that Strawson's argument is ultimately unconvincing. In this article, I evaluate Prasad's challenges to Strawson by summarizing and categorizing all of the relevant arguments in both Strawson's and Prasad's pieces. -/- Strawson offers four types (...) of arguments to demonstrate that determinism and free agency cannot be incompatible, showing that the reactive attitude is natural and desirable and the objective attitude is not natural, not desirable, not sustainable, and not compatible with the reactive attitude. Prasad targets Strawson's incompatibilist arguments, showing that determinism and free agency are incompatible. Of Prasad's seven types of arguments, four target Strawson's four above. Three of these succeed and one fails. The remaining three target Strawson's support of the reactive attitude, and of these, one succeeds, and the others fail. Although Prasad's arguments miss the mark at times, he does succeed in putting forth a legitimate challenge to Strawson's notion that determinism is no inhibitor of the reactive attitude. (shrink)

While there is no shortage of disagreement about what is required for blameworthiness, it has traditionally been assumed that freely doing what you know to be wrong all things considered, despite being aware that it is within your power to do the right thing instead, suffices. Let us refer to this traditional assumption as the sufficiency thesis. The sufficiency thesis is plausible, but it is not beyond dispute. Reflection on certain situations in which a person can do the right thing (...) but only at great personal sacrifice highlights some particularly pressing difficulties for it. My principal aim in this article is to show that those difficulties are not insuperable. In this article I argue that it is possible to be blameworthy for doing something that was not objectively morally wrong. If I am right, this would have implications for several debates at the intersection of metaphysics and moral philosophy. I also float a view about which actions can serve as legitimate bases for blame that allows for the possibility of blameworthiness without objective wrongdoing and also suggests an explanation for the appeal of the commonly held view that blameworthiness requires (...) objective wrongdoing. It is often assumed that we are only blameworthy for that over which we have control. In recent years, however, several philosophers have argued that we can be blameworthy for occurrences that appear to be outside our control, such as attitudes, beliefs and omissions. This has prompted the question of why control should be a condition on blameworthiness. This paper aims at defending the control condition by developing a new conception of blameworthiness: To be blameworthy, I argue, is most fundamentally (...) to deserve to feel guilty. Being blamed by someone else is not necessarily harmful to the wrongdoer. The blame might not be expressed, or the wrongdoer might not care. But to blame oneself necessarily involves suffering. This conception of blameworthiness explains why the control condition should obtain: We are morally blameworthy for A only if A was under our control because to be blameworthy is to deserve to feel guilty, to feel guilty is to suffer, and one deserves to suffer for A only if A was under one’s control. In The Stubborn System of Moral Responsibility (2015), Bruce Waller sets out to explain why the belief in individual moral responsibility is so strong. He begins by pointing out that there is a strange disconnect between the strength of philosophical arguments in support of moral responsibility and the strength of philosophical belief in moral responsibility. While the many arguments in favor of moral responsibility are inventive, subtle, and fascinating, Waller points out that even the most ardent supporters of moral responsibility (...) acknowledge that the arguments in its favor are far from conclusive; and some of the least confident concerning the arguments for moral responsibility—such as Van Inwagen—are most confident of the truth of moral responsibility. Thus, argues Waller, whatever the verdict on the strength of philosophical arguments for moral responsibility, it is clear that belief in moral responsibility—whether among philosophers or the folk—is based on something other than philosophical reasons. -/- He goes on to argue that there are several sources for the strong belief in moral responsibility, but the following four are particularly influential: First, moral responsibility is based in a powerful “strike back” emotion that we share with other animals. Second, there is a deep-rooted “belief in a just world”—a belief that, according to Waller, most philosophers reject when they consciously consider it, but which has a deep nonconscious influence on what we regard as just treatment and which provides subtle (but mistaken) support for belief in moral responsibility. Third, there is a pervasive moral responsibility system—extending over criminal justice as well as “common sense”—that makes the truth of moral responsibility seem obvious, and makes challenges to moral responsibility seem incoherent. Finally, there is the enormous confidence we have in the power of reason, which mistakenly leads us to believe that our conscious, rational, and critically reflective selves are constantly guiding our behavior in accordance with our deep values. -/- In these comments, I would like to discuss the many points of agreement I have with Waller, providing along the way additional fuel for his skeptical fire (i.e., his moral responsibility skepticism and his skeptical analysis of the source of our strong belief in moral responsibility). I will also discuss, however, my one main point of disagreement—i.e., his desire to preserve the conception of free will. Waller believes free will can “flourish” in the absence of moral responsibility (see Ch.8), while I maintain they that the variety of free will that is of central philosophical and practical importance is the sort required for moral responsibility in a particular but pervasive sense. This sense of moral responsibility is set apart by the notion of basic desert and is purely backward-looking and non-consequentialist (see Pereboom 2001, 2014; Caruso and Morris, forthcoming). Understood this way, the sort of free will at issue in the historical debate is a kind of power or ability an agent must possess in order to justify certain kinds of desert-based judgments, attitudes, or treatments in response to decisions or actions that the agent performed or failed to perform. Derk Pereboom’s Free Will, Agency, and Meaning in Life provides the most lively and comprehensive defense of free will skepticism in the literature. It contains a reworked and expanded version of the view he first developed in Living without Free Will. Important objections to the early book are answered, some slight modifications are introduced, and the overall account is significantly embellished—for example, Pereboom proposes a new account of rational deliberation consistent with the belief that one’s actions are causally determined and (...) develops a forward-looking theory of moral responsibility con- sistent with free will skepticism. A significant contribution to the field, Free Will, Agency, and Meaning in Life is destined to become a classic and is essential reading for anyone interested in free will and moral responsibility. What would be the consequence of embracing skepticism about free will and/or desert-based moral responsibility? What if we came to disbelieve in moral responsibility? What would this mean for our interpersonal relationships, society, morality, meaning, and the law? What would it do to our standing as human beings? Would it cause nihilism and despair as some maintain? Or perhaps increase anti-social behavior as some recent studies have suggested (Vohs and Schooler 2008; Baumeister, Masicampo, and DeWall 2009)? Or would it rather (...) have a humanizing effect on our practices and policies, freeing us from the negative effects of what Bruce Waller calls the “moral responsibility system” (2014, p. 4)? These questions are of profound pragmatic importance and should be of interest independent of the metaphysical debate over free will. As public proclamations of skepticism continue to rise, and as the mass media continues to run headlines announcing free will and moral responsibility are illusions, we need to ask what effects this will have on the general public and what the responsibility is of professionals. One of the most frequently voiced criticisms of free will skepticism is that it is unable to adequately deal with criminal behavior and that the responses it would permit as justified are insufficient for acceptable social policy. This concern is fueled by two factors. The first is that one of the most prominent justifications for punishing criminals, retributivism, is incompatible with free will skepticism. The second concern is that alternative justifications that are not ruled out by the skeptical view per (...) se face significant independent moral objections. Yet despite these concerns, I maintain that free will skepticism leaves intact other ways to respond to criminal behavior—in particular preventive detention, rehabilitation, and alteration of relevant social conditions—and that these methods are both morally justifiable and sufficient for good social policy. The position I defend is similar to Derk Pereboom’s, taking as its starting point his quarantine analogy, but it sets out to develop the quarantine model within a broader justificatory framework drawn from public health ethics. The resulting model—which I call the public health -quarantine model—provides a framework for justifying quarantine and criminal sanctions that is more humane than retributivism and preferable to other non-retributive alternatives. It also provides a broader approach to criminal behavior than Pereboom’s quarantine analogy does on its own. (shrink)

This paper attempts to provide a defence for a narrative theory of the self in the face of criticisms from the anti-narrative camp. It begins by addressing certain uncontroversial premises that both pro- and the anti-narrative camps might be thought to agree on: the status of humans as homo significans or meaning-makers, the natural form-finding tendency and certain desiderata for significance and value that we possess, and the raw material of life and its constituents that we proceed from. Whereas the (...) pro-narrative camp seeks to provide the narrative theory of the self as a valid argument for how we proceed from the raw material of life and undifferentiated experience and these desiderata and tendencies to a conception of both selfhood and moral responsibility, the anti-narrative camp holds the conclusion to be false and the narrative theory of the self to be invalid. The Parfitian view holds the conception of the self to be ultimately false, whereas the Strawsonian view holds both the conception of the self and the conception of moral responsibility to be ultimately false. The grounds they provide, however, tend to be metaphysical in nature, demonstrating that they have fundamentally misunderstood how the narrative theory of the self functions as a semantic thesis. I will demonstrate certain defects in the metaphysical arguments that anti-narrativists like Parfit and Strawson have made against what is essentially a semantic thesis about how we make sense of our lives. I will also attempt to shore up the semantic thesis in other relevant aspects. (shrink)

This paper addresses the Basic Argument in favour of incompatibilism, both in its Strawsonian form and in its weakened form (the CDA). After examining the worries raised by this argument, I will defend a version of semi-compatibilism that is motivated by a narrative theory of the self, arguing that moral responsibility is possible even if the thesis of determinism is taken to be incompatible with the thesis of freedom of will. The semi-compatibilist argument that I provide lowers the standard of (...) proof, stops the regress of causes, finds a buck-stopper in the form of a self who can be held morally responsible for a choice or an action, and avoids committing the Strawsonian fallacy of circular reasoning by not setting impossible demands on moral responsibility. T.M. Scanlon has recently proposed what I term a ‘double attitude’ account of blame, wherein blame is the revision of one’s attitudes in light of another person’s conduct, conduct that we believe reveals that the individual lacks the normative attitudes we judge essential to our relationship with her. Scanlon proposes that this account justifies differences in blame that in turn reflect differences in outcome luck. Here I argue that although the double attitude account can justify blame’s being sensitive to outcome (...) luck, it cannot justify allocating blame differently when agents with the same attitudes differ only with respect to the luck-based outcomes of their actions. However, Scanlon’s own contractualist theory of morality can be invoked to show that the double attitude account is compatible with blame-based sanctions (e.g., compensation mandated when negligence or reckless result in harm) being sensitive to outcome luck. The resultant view of blame and luck remains desert-based while making sense of the common intuition that differences in outcome luck can matter to how lucky and unlucky individuals are justifiably treated. P.F. Strawson’s theory of moral responsibility remains eminently influential. However, moral philosophers such as G. Watson and T.M. Scanlon have called into question it explanatory basis, which grounds moral responsibility in human nature and interpersonal relationships. They demand a deeper normative explanation for when it is appropriate to modify or mollify the reactive attitudes. In this paper, following A. Sneddon, I argue that the best interpretation of Strawson is an externalistic one which construes moral responsibility as an interpersonal social competence, (...) as this approach uniquely satisfies Strawson’s demand that we justify the reactive attitudes from within the participant perspective. I then show that this is the only interpretation capable of preserving Strawson’s well-known excuse of being peculiarly unfortunate in one’s formative circumstances. (shrink)

Consider the idea that suffering of some specific kind is deserved by those who are guilty of moral wrongdoing. Feeling guilty is a prime example. It might be said that it is noninstrumentally good that one who is guilty feel guilty (at the right time and to the right degree), or that feeling guilty (at the right time and to the right degree) is apt or fitting for one who is guilty. Each of these claims constitutes an interesting thesis about (...) desert, given certain understandings of what desert is. After examining these claims, the paper briefly explores the idea that an offender might deserve certain forms of treatment by others. The paper concludes by contrasting the modest theses on which it focuses with a far bolder one, to the effect that if we are morally responsible, then it makes sense to suppose that some of us might deserve to suffer eternal torment. What is it to be morally responsible for something? Recent philosophical work reveals considerable disagreement on the question. Indeed, some theorists claim to distinguish several varieties of moral responsibility, with different conditions that must be satisfied if one is to bear responsibility of one or another of these kinds. -/- Debate on this point turns partly on disagreement about the kinds of responses made appropriate when one is blameworthy or praiseworthy. It is generally agreed that these include "reactive attitudes" such (...) as resentment and gratitude, but theorists disagree about the nature of these attitudes. They dispute the connections between moral responsibility, desert, and the justification of punishment as well. -/- Many theorists take it that, whatever the appropriate responses are, they are responses to an agent's "quality of will," but there is no consensus on what this comes to. Are the agent's beliefs about the moral status of her behavior what matter, or is it what she cares about, or what she judges important? -/- This volume presents twelve original essays from participants in these debates. The contributors include prominent established figures as well as influential younger philosophers. In this entry we provide a critical review of recent work on the nature and ethics of blame, including issues of moral standing.

Blame is usually discussed in the context of the free will problem, but recently moral philosophers have begun to examine it on its own terms. If, as many suppose, free will is to be understood as the control relevant to moral responsibility, and moral responsibility is to be understood in terms of whether blame is appropriate, then an independent inquiry into the nature and ethics of blame will be essential to solving (and, perhaps, even fully understanding) the free will problem. In this article we first survey and categorize recent accounts of the nature of blame – is it action, belief, emotion, desire, or something else? – and then we look at several proposed requirements on appropriate blame that look beyond the transgressor himself, considerations that will form part of a full account of the ethics of blame. I develop and explore the main themes of Vargas's recent book. The first section of my review lays out Vargas's case for revisionism about moral responsibility: the idea that our thinking about moral responsibility is internally inconsistent, so we need to purge core problematic elements. In the section section, I develop Vargas's own revisionist position. Vargas argues that the practice of blaming people aims at agency cultivation: trying to train people to be more sensitive to moral considerations. I explore similarities (...) between Vargas's model of blame and the classical model, also knows as the 'morality's enforcer' or 'economy of threats' model. I argue that Vargas's revisionism shares the core problem of this model: it has difficulty making sense of the warrant of blaming people who are and will be continue to be unresponsive to blame. Finally, I briefly explore Vargas's discussion of the situationist literature and his argument that manipulation cases don't threaten our being morally responsible for what we do. (shrink)

In this review I present the main claims of McKenna's book Conversation and Responsibility. There McKenna develops a theory of moral responsibility inspired by an analogy with the relationship people bear to each other as part of a conversational exchange. The first half of the book develops the conversational account and considers objections to it. In the second half of the book, McKenna turns to an examination of the kind of normative claim being made when we say that being morally (...) responsible is to be understood in terms of appropriately holding someone morally responsible. I discuss the main themes of the book, how McKenna advances the literature on moral responsibility, and some challenges/limits of the view. (shrink)

In this paper, I explore the idea that someone can deserve resentment or other reactive emotions for what she does by attention to three psychological functions of such emotions—appraisal, communication, and sanction—that I argue ground claims of their desert. I argue that attention to these functions helps to elucidate the moral aims of reactive emotions and to distinguish the distinct claims of desert, as opposed to other moral considerations.

Reactive emotion accounts hold that blameworthiness should be analyzed in terms of the familiar reactive emotions. However, despite the attractions of such views, we are not persuaded that blameworthiness is ultimately a matter of correctly felt reactive emotion. In this paper, we draw attention to a range of little-discussed considerations involving the moral significance of the passage of time that drive a wedge between blameworthiness and the reactive emotions: the appropriateness of the reactive emotions is sensitive to the passage of (...) time in ways that attributions of blameworthiness are not. There are a number of ways in which reactive emotion accounts might attempt to accommodate the moral significance of time, however. We consider the most important of these, but ultimately find them wanting. Accordingly, we conclude that the prospects for the reactive emotion accounts are bleak. Our argument, if successful, has a range of implications for legal theory, most importantly in providing a novel moral basis for statutes of limitations and in shedding light on new avenues in the theory of criminal law generally. Situationists such as John Doris, Gilbert Harman, and Maria Merritt suppose that appeal to reliable behavioral dispositions can be dispensed with without radical revision to morality as we know it. This paper challenges this supposition, arguing that abandoning hope in reliable dispositions rules out genuine trust and forces us to suspend core reactive attitudes of gratitude and resentment, esteem and indignation. By examining situationism through the lens of trust we learn something about situationism (in particular, the radically revisionary moral implications (...) of its adoption) as well as something about trust (in particular, that the conditions necessary for genuine trust include a belief in a capacity for robust dispositions).
