Law Changes

BIPARTISAN STATE BOARD OF ELECTIONS AND ETHICS ENFORCEMENT

 

On March 16, 2018, Session Law 2018-2, also known as House Bill 90, became law. The law, which Gov. Roy Cooper has challenged in court, created a nine-member Bipartisan State Board of Elections & Ethics Enforcement, including four members each from the Democratic and Republican parties and one member who is not affiliated with either of those parties.

Under that statute, the governor chooses four members each from lists of six nominees submitted by the state Republican and Democratic parties. Those eight State Board members then choose two nominees who are not affiliated with either party, and the governor selects the final member from those two nominees.

As the legal challenge continues, Gov. Roy Cooper has appointed all nine members. The new State Board oversees the elections process, as well as campaign finance, ethics and lobbying disclosure and compliance in North Carolina.

 

Rule Making

The State Board of Elections & Ethics Enforcement is responsible for the administrative Rules found in Chapter 8 of the North Carolina Administrative Code.
