ב-2013 פרסמנו את הדוח "מסלול הנישול" שעסק במאחז הבלתי מורשה עדי עד ובהשפעתו על ארבעה כפרים פלסטינים שבקרבתו: תורמוסיא, ג'אלוד, אל-מור'ייר וקריות. בדוח תיארנו איך המאחז הוקם על אדמות הכפרים - חלקן בבעלות פלסטינית פרטית, וכיצד למרות היותו בלתי חוקי, רשויות המדינה סייעו להקמתו ולביסוסו באמצעות מימון, תשתיות, הגנה ועוד. בנוסף, הדוח תיעד עשרות מעשי אלימות ופגיעה ברכוש שביצעו אזרחים ישראלים, רובם בשטחים החקלאיים הסמוכים למאחז, והתמקד בכישלון אכיפת החוק על העבריינים ובקשר בין מעשי האלימות לאבדן הגישה של חקלאים פלסטינים לאדמותיהם.
הדוח משרטט רצף שתחילתו בהיעדר אכיפת חוק אפקטיבית על אזרחים ישראלים, המשכו באובדן יכולתם של בעלי אדמות פלסטינים לעבד את אדמתם ולהתפרנס מפריּה, וסופו בגזל אדמות והתרחבות המאחז.
ב-2014 הגשנו יחד עם תושבי הכפרים הסמוכים לעדי-עד עתירה לבג"ץ שבה דרשנו לפנות את כל המאחז. העתירה, בהסתמך על הדוח, הציגה בפני בית המשפט העליון תמונה כוללת של הפרות חוק ומעשי אלימות באזור עדי-עד, וטענה כי בשל היותו מוקד להפרת זכויות אדם, ובשל מחדלי המדינה באכיפת החוק, יש לפנותו.
הטיעון הזה, זכה להתעלמות מקוממת. כמה קרוואנים ומבנים שהיו על אדמה פלסטינית פרטית גזולה הוזזו לתחום "אדמות מדינה", והמדינה הודיעה על כוונתה להכשיר את עדי-עד. השופטים התרצו, דחו את העתירה ונתנו למדינה תשעה חודשים להכשרת המאחז.
כעת המדינה מתכוונת להכשיר את המאחז באמצעות הרחבת תחום השיפוט של ההתנחלות עמיחי (שהוקמה עבור מפוני מאחז בלתי מורשה אחר – עמונה). מדובר בתחום שיפוט עצום, שיכלול שטח הגדול פי 2.5 מהשטח הבנוי של המאחז עדי-עד.
אז מה יצא לנו? המאחז עדי-עד, שהוקם תוך הפרת חוק והתרחב במשך השנים תוך פגיעה בפלסטינים ונישולם מאדמותיהם, יקבל מעמד רשמי של התנחלות ושטחו צפוי לגדול באופן דרמטי.
ומה למדנו? שהמדינה מתגמלת אלימות, נישול, גזל וצפצוף על החוק, אם אתה מתנחל ישראלי כמובן. אם אתה פלסטיני, אין לך שום זכויות, אפילו לא על אדמתך שלך.

In 2013, we published the report "The Road to Dispossession," which dealt with the unauthorized outpost of Adei Ad and its impact on four Palestinian villages nearby: Turmusaya, Jalud, al-Mughayer and Qaryut. The report describes how the outpost was built on village land, some privately owned by Palestinians, and the illegal actions undertaken in its founding. The State authorities supported the outpost's establishment through funding, infrastructure, defense and more. In addition, the report documented dozens of acts of violence and property damage committed by Israeli civilians, most of them in the agricultural areas adjacent to the outpost, and further focused on the failure of law enforcement on the offenders, as well as the connection between the violence and the loss of access to land experienced by Palestinian farmers.
The report outlines a continuum that began with the absence of effective law enforcement on Israeli civilians, and which continued with the loss of Palestinian landowners' ability to access and cultivate their land, to the inability to achieve a sustainable livelihood from its produce, and ultimately to the theft of land and expansion of the outpost.
In 2014, we filed a petition together with residents of Palestinian villages near Adei Ad, to the High Court of Justice, demanding the evacuation of the outpost. The petition, based on the report, presented the Court with a comprehensive picture of the violations of the law and acts of violence in the Adei Ad area, arguing that, since Adei Ad remains a focal point for human rights violations, and due to the State's failure to enforce the law, the unauthorized outpost should be evacuated.
This argument was met with outrageous disregard. A number of caravans and structures on stolen privately owned Palestinian land have been moved to "State lands," and the State announced its intention to authorize the outpost. The judges rejected the petition and gave the State nine months to retroactively authorize the outpost.
Now the State intends to authorize the outpost by expanding the jurisdiction of the Amichai settlement (established for evacuees from another unauthorized outpost - Amona). This is a huge jurisdiction, which will include an area 2.5 times the built-up area of the Adei Ad outpost.
So what have we got? The Adei Ad outpost, which was established in violation of the law and expanded over the years, and which is harming Palestinians and dispossessing them of their lands, will receive official status as a settlement and its area is expected to grow dramatically.
And what have we learned? That the State rewards violence, dispossession, theft and disregard for the law, if you are an Israeli settler of course. If you are a Palestinian, you have no rights, not even on your own land.

השבוע ב"עמק שילה":
