2.3 Ticket Holders have responsibility for complying with the terms and conditions of this Agreement. Rio 2016 reserves the unrestricted right to terminate the licence granted by a Ticket.

2.4 If a Ticket Holder is not 18 years of age or over, their parent(s) or legal guardian(s) are responsible for their actions and conduct and their compliance with the terms and conditions of this Agreement. Children under the age of 14 years may not attend a session unless accompanied by an adult. If any further age restrictions are defined by governmental authorities, including age restrictions for particular sports, then this Agreement will be amended to reflect those restrictions, and any modifications will enter into force upon registry.

2.5 Rio 2016 reserves the right to change the terms and conditions of this Agreement from time to time and the modifications shall enter into force upon registry. Rio 2016 will notify the original Ticket Purchaser of such changes if they materially affect their rights as a consumer.

Ticket Holders are referred to Rio 2016’s Accessibility Statement (full details of which are available at our website).

    4. Tickets

4.1 A Ticket grants the Ticket Holder a revocable licence to enter a Venue to attend and to occupy a space or seat at a Session. This may be a specific, reserved seat or space, or may be for general admission to designated spectator areas of the venue. Rio 2016 may revoke this licence at any time, with cause, as outlined in this Agreement.

4.2 All Tickets remain the exclusive property of Rio 2016.

4.3 A valid Ticket must be produced to gain admission to a Session or a Venue.

4.4 Ticket Holders have responsibility for all Tickets in their possession. Once in the possession of the Purchaser, the Purchaser is solely responsible for safeguarding all Tickets. A Ticket Holder may be denied entry or asked to leave the venue for removing any part of, altering, or defacing a Ticket. Neither the Ticket Holder nor the Purchaser shall be entitled to any compensation for lost, stolen, forgotten or damaged Tickets. It may not be possible to issue duplicate Tickets.

4.5 Unless otherwise specified on the Ticket, a Ticket Holder who leaves a Venue may not use the same Ticket to re-enter the Venue for any reason. There will be no pass-outs or re-entry. If a Ticket Holder exits a Venue for any reason other than an emergency evacuation, the Ticket Holder and original Purchaser agree that Rio 2016 may void the Ticket and resell or otherwise redistribute the unoccupied seat or space to another person for the remainder of the Session.

4.6 A Ticket Holder must retain their Ticket at all times while attending the Session and the Ticket must be produced for inspection upon request by any authorized person, including without limitation an official, steward or employee of Rio 2016, or a volunteer, or the Venue or any police officer. Failure to do so may result in the Ticket Holder being required to leave a Venue.

4.7 A Ticket Holder may be required to show his or her Ticket upon exiting the Venue perimeter.

4.8 Upon request, a Ticket Holder must show their Ticket and/or proof of identity with appropriate Photographic Identification and other documents necessary to provide proof of the Ticket Holder’s eligibility for a discount, if applicable. Failure to do so may result in the Ticket Holder being required to leave the Venue.

4.9 Rio 2016 reserves the right to reassign a Ticket Holder to an alternative seat or space in a comparable location (as determined by Rio 2016 in its sole discretion) for any Venue or Session. If a ticketed seat or space cannot be provided, the Purchaser may apply for a refund as outlined in the Rio 2016 Ticket Terms of Purchase.

4.10 The Ticket Purchaser acknowledges, by selecting to receive purchased Tickets as either digital or print-at-home Tickets, and the Ticket Holder acknowledges, by using such digital or print-at-home Tickets, that only the first Ticket Holder to present a specific Ticket shall be allowed entry to the Venue. Any Ticket Holder presenting further duplicate copies of the same Ticket shall be denied entry to the Venue and shall not be entitled to any consideration, financial or otherwise. The sale of invalid Tickets is a crime under Brazilian law.

    5.     Transportation

5.1 All Ticket Holders are strongly encouraged to utilise public transport for travel to and from the Venue on the day of their Session. There will be no public parking available at any Venue. Information regarding transportation options can be found at www.rio2016.com.

5.2 Ticket Holders should allow sufficient time before the Session to travel to and access the Venue, taking into account travel times and time required for queuing and security screening prior to entering the Venue. A Ticket Holder arriving after the commencement of a Session may be required to wait for an appropriate break in competition before being granted access to his or her seat, and neither the Ticket Holder nor the Purchaser shall be entitled to a refund in the case of late arrival to the Venue.

    6.     Session alterations and interruptions

6.1 Purchasers and Ticket Holders acknowledge that Sessions may be delayed or postponed. Rio 2016 will use reasonable efforts to communicate such delays or postponements to Purchasers. It is the Purchaser’s responsibility to communicate such information to the Ticket Holder. As soon as possible after Rio 2016 becomes aware of a Session being delayed or postponed, all available information will be posted on rio2016.com. It is the responsibility of a Ticket Holder to check this website to determine whether any change has been made to Session schedule. Rio 2016 does not guarantee that Ticket Holders will be informed of such delay or postponement before the date of the Session concerned.

6.2 Ticket Holders with Tickets for a delayed Session shall not be eligible for a refund. There will be no exchanges of Tickets for another Session.

6.3 If a Session commences as scheduled and is interrupted after it begins, and Rio 2016 determines that it was substantially completed, neither the Purchaser nor the Ticket Holder holding a Ticket for the interrupted Session shall be eligible for a refund. There will be no exchanges of Tickets for another Session.

6.4 If a Session commences as scheduled, is interrupted, and Rio 2016 determines that the Session was not substantially completed, and the Session is rescheduled to take place as a new Session (i.e. separate from an existing, scheduled, Session), the Ticket Holder may retain his or her original Ticket for admission to the rescheduled Session. If, due to extenuating circumstances, the Ticket Holder is not able to attend the rescheduled Session, the Purchaser may apply for a refund as outlined in the Rio 2016 Ticket Terms of Purchase. Refunds will only be made to the Purchaser, not to the Ticket Holder. If the Ticket has been used for admission to the rescheduled Session, it will not be eligible for refund. There will be no exchanges of Tickets for another Session.

6.5 If a Session commences as scheduled and is interrupted, and Rio 2016 determines that the Session was not substantially completed, and the Session is rescheduled as part of an existing, scheduled, Session (i.e. does not take place as a new Session), the Purchaser may apply for a refund as outlined in the Rio 2016 Ticket Terms of Purchase. Refunds will only be made to the Purchaser, not the Ticket Holder. There will be no exchanges of Tickets for another Session.

    7.     Session cancellation

7.1 If a Session is cancelled (i.e. not held at all), Rio 2016 will use reasonable efforts to communicate such cancellation in advance to Purchasers. It is the Purchaser’s responsibility to communicate such information to the Ticket Holder. As soon as possible after Rio 2016 becomes aware of a Session being cancelled all available information will be posted on our website. It is the responsibility of a Ticket Holder to ascertain whether a Session has been cancelled. Rio 2016 does not guarantee that Ticket Holders will be informed of such cancellation before the date of the Session concerned.

7.2 If a Session is cancelled, the Purchaser may apply for a refund as outlined in the Rio 2016 Ticket Terms of Purchase.

    8. Liability

8.1 Purchasers and Ticket Holders acknowledge and accept the risks and dangers inherent in attending a Session.

8.2 A Ticket Holder is responsible for his or her own safety, for the safety of any accompanying children and for the safety of their own personal property.

8.3 Personal arrangements including travel, accommodation or hospitality relating to attendance at the Session which have been made by a Purchaser or Ticket Holder are made at the Purchaser’s or Ticket Holder’s own risk.

8.4 None of Rio 2016, any Authorised Ticket Source, any Venue owner, any member of the Games Body or any other Person involved in the organisation of the Games accept any responsibility for any loss, theft or damage of a Ticket Holder’s personal property. A Ticket Holder releases Rio 2016, Authorised Ticket Sources, Venue owners and the Games Bodies from any liability for any loss or damage to personal property they may suffer in relation to his or her attendance at a Venue.

8.5 None of Rio 2016, any Authorised Ticket Source, any Venue owner, any member of the Games Body or any other Person involved in the organisation of the Games shall be liable for any failure to perform any obligation under the terms and conditions of this Agreement to the extent that the failure is caused by Force Majeure or by the acts of third parties.

8.6 Except as required by law, none of Rio 2016, any Authorised Ticket Source, any member of the Games Body or any other Person involved in the organisation of the Games shall have any further liability to a Ticket Holder beyond the face value of the Ticket purchased (plus the relevant Ticket delivery fee if the Tickets have not yet been dispatched). None of Rio 2016, any Authorised Ticket Source, any Venue owner or any Games Body shall be responsible to the Purchaser or Ticket Holder for any indirect losses or damages including, but not limited to, punitive damages, loss of enjoyment, goodwill or profit and/or travel or accommodation expenses.

    9.     Resale, Reuse, and Transfer of Tickets

9.1 Tickets may not be purchased or obtained from or through any source other than directly from an Authorized Ticket Source. Tickets purchased or obtained from or through sources other than directly from Authorized Ticket Sources, in accordance with the terms and conditions of this Agreement, may be declared void, and may be seized or cancelled. In such a case, the Ticket Holder will be denied entry to the Session and the Purchaser will not be eligible for a refund.

9.2 Save as set out at clauses 9.3 and 9.4 below, Tickets are strictly non-transferable and may not be sold nor advertised for sale whether on the internet, in newspapers or elsewhere.

9.3 Rio 2016 recognizes that a Ticket Holder’s circumstances may change over time. To provide a solution for cases where a Ticket Holder is unable to use a ticket, an online procedure to facilitate Ticket return will be made available via rio2016.com.

9.4 Any Tickets issued to a Purchaser may only be used by the Purchaser or a family member, or a friend or colleague who is known to the Purchaser personally, or an officially invited guest of the purchasing organisation. The transfer of a Ticket in this manner shall not contravene clauses 9.1 and 9.2, provided that:

9.4.1 Such a transfer takes place without payment or benefit in excess of the face value price of the Ticket.

9.4.2 Such a transfer is subject to the terms and conditions of this agreement; and

9.4.3 The Purchaser consents to provide the name and address (and any other identification details, as required by Rio 2016) of each person who is intended to use a Ticket to attend a Session, if asked at any time by any official, steward, volunteer or employee of Rio 2016 or of the Venue owner or by any police official.

9.5 Tickets may not be transferred to any Person who pays or agrees to pay for some other goods or services, such as a hospitality package or accommodation, unless authorised by Rio 2016. A Ticket may not be offered as part of a package of goods or services, which, for the avoidance of doubt, may include a hospitality package, unless authorised by Rio 2016. Tickets sold or advertised for sale (whether on their own, together or as part of a package of goods and services, including hospitality packages) contrary to this clause 9.5 may be considered void, and may be seized or cancelled. In such a case, the Ticket Holder will be denied entry to the Session and the Purchaser will not be eligible for a refund.

9.6 Tickets may not be used for advertising, promotion, auctions, fundraising or marketing purposes (including in competitions, contests and sweepstakes) without prior written authorisation from Rio 2016. Tickets used for advertising, promotion, auctions, fundraising or marketing purposes without the authorisation of Rio 2016 (including in competitions, contests and sweepstakes) may be considered void, and may be seized or cancelled. In such a case, the Ticket Holder will be denied entry to the Session and the Purchaser will not be eligible for a refund.

    10.     Void Tickets

10.1 Any Ticket reasonably believed to have been obtained in breach of the terms and conditions of this Agreement and/or the terms and conditions of the Rio 2016 Ticket Terms of Purchase shall be void, and may be seized or cancelled. In such a case, all rights conferred or evidenced by such Ticket shall be nullified. In such a case, the Purchaser will not be eligible for a refund.

10.2 Any Person seeking to use a Ticket that can reasonably be believed to have been obtained in breach of the terms and conditions of this Agreement and/or the terms and conditions of the Rio 2016 Ticket Terms of Purchase in order to gain entry to or remain at a Session may be considered to be trespassing and may be denied entry to or ejected from the venue, and may be subject to criminal or civil action.

    11.     Discounted Tickets

11.1 Rio 2016 may set special Ticket prices, including discounted Tickets for students and teachers, persons with disabilities, and/or persons over the age of 60 and half-price tickets as required by legislation of the Federative Republic of Brazil and/or the relevant local jurisdictions. Ticket Holders taking advantage of such discounted Ticket prices may be required, upon request by any official, steward, employee, volunteer, or authorized partner or contractor of Rio 2016 or the Venue, to provide proof of his or her eligibility for the discount with appropriate Photographic Identification and other relevant documents if necessary. Failure to produce proof of eligibility represents a material breach of these Terms and Conditions and may result in the cancellation of the Order or the Tickets issued and in the refusal of admittance to the Venue of the Ticket Holder, who may also be asked to leave the Venue, or be required to pay the full adult price of the Ticket.

    12.     Spectator Policy

    12.1 Personal Property

12.1.1 There will be no storage available at the Venues, save for limited space afforded to children’s strollers and prams, mobility scooters and wheelchairs.

4.1 Rio 2016 stakeholders and partners, and members of the Games body, may have a contractual right to request and purchase tickets, as per the terms of their individual contract or charter. The terms of purchase are governed by the particular agreement.

    5.     Tickets Purchased from Rio 2016

5.1 Sales of Tickets by Rio 2016 will occur in various phases. Each sales phase will have specific rules, which may also be specific to the category of Purchaser. When making a Ticket Order, the Purchaser agrees to abide by all the specific purchase rules applicable to the specific sales phase. These rules may include, but are not limited to, residency restrictions (as outlined in section 3), limits to the number of Orders a Person may submit, limits on the number of Sessions a single Purchaser may be allowed to purchase, and limits to the number of Tickets that may be purchased for a specific Session. These purchase rules will be clearly outlined as a part of the purchase process. Any attempt to circumvent or avoid adherence to the purchase rules may result in the Order being rejected, and may result in other past purchases by the same Purchaser being cancelled, any issued Tickets being considered void, and any Ticket Holder in possession of such Ticket being denied entry to the Session and Venue.

5.2 Purchasers are responsible for verifying the accuracy of their Ticket Order at the time the Order is submitted or the purchase is made. Mistakes cannot necessarily be rectified after the purchase is complete. If the purchaser believes there has been a mistake, they must contact the relevant customer service centre as soon as possible.

5.3 Submission of an Order to Rio 2016 constitutes a binding offer to purchase Tickets for the specified Session(s). Once submitted, it may not be possible for a Person to alter, amend, withdraw or cancel an Order, subject to the rules of the particular sales phase, as described in clause 5.1.

5.4 A Ticket purchase is not considered complete until all payment for the purchased Tickets has been received, in full, by Rio 2016 and a transaction confirmation has been issued. No communication from any third party other than Rio 2016 or the relevant ATR shall be deemed as confirmation of the transaction, including text messages or any other information from the Purchaser’s bank or Credit Card Company.

5.5 Rio 2016 may not be held liable if a Purchaser provides incorrect or fraudulent information when submitting an Order or completing a purchase, for technical malfunctions of the internet, or for failure of computer hardware or software that may prevent the submission of an Order.

5.6 Submitting an Order for Tickets does not guarantee the availability of the requested Tickets. The ability of Rio 2016 to satisfy Tickets Orders depends on the total demand and available inventory, and is subject to the rules and requirements of the specific Ticket sales phase, as outlined in clause 5.1.

5.7 Rio 2016 may, at its sole discretion, refuse or cancel Ticket Orders from anyone whom they believe plans to distribute or offer a Ticket for resale other than in accordance with these Terms and Conditions and with the Rio 2016 Ticket Use Agreement and Spectator Policy or anyone who they believe to have provided misleading or fraudulent information in the course of purchasing Tickets.

    6.     Tickets Purchased from an Authorised Ticket Reseller

6.1 As described in clause 3.2, an NOC may nominate, and Rio 2016 may appoint, an organisation or agency to act as an Authorised Ticket Reseller for a specific territory or territories. An ATR is responsible, with Rio 2016’s prior approval, for determining the rules and processes governing the sale of Tickets within their designated territory or territories. An ATR may opt to put in place limits on how many Tickets or Sessions a Purchaser may purchase, and to determine the purchase, distribution, and payment methods. In case of a discrepancy between the purchase terms and conditions which may be put in place by an ATR and the Terms and Conditions outlined in this document, the latter shall prevail. All Tickets, regardless of from whom they were obtained or purchased, are issued subject to the Rio 2016 Ticket License Agreement and Spectator Policy.

6.2 An ATR may, at its sole discretion, refuse to sell Tickets to any person who attempts to circumvent or does not intend to adhere to any purchase rules or restrictions put in place by the ATR. An ATR is obligated to refuse the sale of Tickets to any person whom it believes plans to distribute or offer a Ticket for resale other than in accordance with these Terms and Conditions and with the Rio 2016 Ticket License Agreement and Spectator Policy.

6.3 Tickets are issued by Rio 2016 with a face value price denominated in Brazilian Reals. An ATR will always conduct ticket sales in the currency of the designated territory, and will convert the Ticket price from Brazilian Reals to the local currency using the rates published by the Central Bank of Brazil on the SISBACEN system. Any and all bank or other charges incurred as a result of the payment with a payment card or currency conversion will be the sole responsibility of the Purchaser.

6.4 An ATR may charge a reasonable per-ticket handling charge over and above the face value price of the Ticket. This fee may not be more than 20% of the face value price of the Ticket, with a maximum per-ticket amount of R$ 120,00 (one hundred twenty Brazilian Reals) or the equivalent in the local currency of the territory.

6.5 Should a Person, regardless of where they reside, believe they are being offered tickets for purchase on terms that are in violation of these Terms and Conditions or in violation of the rules set out in the Rio 2016 Ticket License Agreement and Spectator Policy, they should immediately contact Rio 2016 by email at sac(a)tkthelp.rio2016.com.

    7.     Ticket Pricing

7.1 The face value price of each Ticket has been established by Rio 2016 and all Ticket prices are denominated in Brazilian Reals and are exclusive of any booking, collection, or delivery fees.

7.2 Rio 2016 may set special Ticket prices, including discounted Tickets for students and teachers, persons with disabilities, and/or persons over the age of 60 and half-price tickets as part of a commitment to delivering an inclusive Games, and/or as required by legislation of the Federative Republic of Brazil. Ticket Holders taking advantage of such discounted Ticket prices may be required, upon request by any official, steward, employee, volunteer, or authorized partner or contractor of Rio 2016 or the Venue, to provide proof of his or her eligibility for the discount with appropriate Photographic Identification and, if it is the case, other pertinent documents.

7.3 The presentation of proper Photographic Identification and other documents necessary to provide proof of the Ticket Holder’s eligibility to a discount represents a material obligation of the ticket applicant.

    8.     Payment

8.1 By completing and submitting an Order for Tickets, the Purchaser is authorising Rio 2016 to collect payment for any Tickets which may be allocated to the Purchaser, inclusive of any applicable processing or delivery fees. For the avoidance of doubt, a Purchaser will only be charged for the Tickets that he or she has been allocated.

8.2 In recognition of Visa’s longstanding support of the Olympic Games, only Visa cards are accepted for Rio 2016 Olympic Games ticket purchases made by the Brazilian general public. The nominated Visa payment card used to purchase Tickets must be registered in the name and address of the Purchaser. Rio 2016 reserves the absolute right to refuse any Ticket Orders which fail to comply with this condition.

8.3 Full and timely payment for all tickets and the delivery fee (if applicable) is of essence and a material obligation of the Purchaser. The Purchaser is solely responsible for ensuring that his or her nominated Visa payment card is valid, that all required information is provided and confirmed, and that he or she has sufficient cleared funds for the duration of the applicable sales phase until the time payment is collected by Rio 2016. If payment cannot be collected, Rio 2016 reserves the right to refuse the associated Ticket Order.

8.4 Rio 2016´s ticket box offices will accept only Visa cards and cash (Brazilian Reals).

8.5 For Tickets purchased prior to the Games, Rio 2016 stakeholders and partners and members of the Games Body, will make payment for Tickets using a payment method specified by their individual contractual agreement. For any Tickets which may be purchased during the Games-time period, payment must be made using a Visa payment card.

    9.     Delivery – Tickets Purchased from Rio 2016

9.1 Purchasers will be informed at the time of submission of their Ticket Order of the options available for the delivery of their Tickets.

9.2 For Brazilian public Ticket Purchasers who opt for home delivery (which may include an additional cost), Tickets will be delivered via secure courier to the delivery address provided by the Purchaser at the time of submission of the Order. Tickets will not be delivered to any other address. A signature may be required upon receipt. Post Office boxes (or similar) are not acceptable addresses for the delivery of Tickets.

9.3 Where there is not enough time to deliver Tickets, or for group purchases, the Purchaser will be advised at the time of purchase of the arrangements for the collection of Tickets from an official Rio 2016 box office or ticket centre, or of any alternative delivery method that Rio 2016 may choose to offer a Purchaser to collect his or her Tickets.

9.4 If by Purchaser choice or any other reason Tickets are to be collected at an official Rio 2016 box office or ticket centre, only the Purchaser, or someone duly authorised by the Purchaser via a signed and duly notarised power of attorney, may collect the Tickets. The Purchaser acknowledges that Tickets collected in Rio 2016 box offices and ticket centres will be standard, non-souvenir tickets and collection will only be made upon presentation of a booking reference number, appropriate Photographic Identification, proof of any legal discount eligibility (if applicable) and the Visa payment card used to make the purchase (if applicable). If the Visa payment card used to make the purchase will expire before the date of collection, the Purchaser must notify Rio 2016 of the change of card details prior to collection.

9.5 Once in the possession of the Purchaser, the Purchaser is solely responsible for safeguarding all Tickets. Neither the Ticket Holder nor the Purchaser shall be entitled to any compensation for lost, stolen, forgotten, or damaged Tickets. It may not be possible to reissue a Ticket.

9.6 If Tickets have not been received 7 days before the commencement of the Session to which the Tickets relate, it is the sole responsibility of the Purchaser to contact the relevant customer service centre, the contact info for which can be obtained from rio2016.com.

9.7 If delivery cannot be accepted for any reason (for example, because of an incorrect address), Rio 2016 shall notify the Purchaser that his or her Tickets may be collected from a specified official Rio 2016 ticket box office or delivered via an alternative delivery method that Rio 2016 may determine, at its discretion, including via the provision of electronic or print-at-home Tickets.

    10.     Delivery – Tickets Purchased from an ATR

10.1 Rio 2016 is not responsible for the delivery or Tickets purchased or obtained through any sources other than directly from Rio 2016, including Tickets purchased from ATRs. ATRs are solely responsible for the delivery of the Tickets purchased or obtained through them.

    11.     Tickets

11.1 A Ticket represents a revocable licence to enter a Venue to attend a Session, and remains the property of Rio 2016. Details regarding the license granted and the terms of use of a Ticket are found in the Rio 2016 Ticket License Agreement and Spectator Policy.

11.2 By purchasing one or more Tickets, the Purchaser agrees that they will call the attention of any Ticket Holder to the Rio 2016 Ticket Use Agreement and Spectator Policy, and that any failure by the Purchaser to do so puts them in breach of these Terms and Conditions and could invalidate the license granted by the Rio 2016 Ticket License Agreement and Spectator Policy, as outlined in that agreement.

11.3 Rio 2016 takes pride in ensuring that people with physical impairments shall not be discriminated against and will, subject to availability, make accommodation for spectators with disabilities in accordance with any applicable laws. Persons with additional accessibility requirements must notify Rio 2016 of such requirements when applying for or purchasing Tickets, as outlined in the Rio 2016 Ticket Terms of Purchase.

11.4 In cases where the Purchaser opts to receive their purchased Tickets in a digital or print-at-home format, the Purchaser agrees that they will not distribute or allow to be distributed duplicate copies of such Tickets, and any such duplicate copies will not be valid for entry to a Venue, as outlined in paragraph 4.10 of the Ticket License Agreement and Spectator Policy. The Purchaser further acknowledges that any such attempt to distribute duplicate copies of digital or print-at-home tickets shall be considered a fundamental breach of these Terms and Conditions, and may result in all purchased Tickets being considered void and not valid for entry to a Venue. In such a case, the Purchaser shall not be entitled to any reimbursement for the cancelled Tickets. The sale of invalid Tickets is a crime under Brazilian law.

11.5 In case of lost or stolen Tickets, the Purchaser should immediately report such loss or theft to the Brazilian police and obtain an official police report. After obtaining an official police report, the Purchaser must then report the loss or theft to the Rio 2016 Ticketing Customer Service Centre. The police report must be obtained, and the Customer Service Centre notified, no less than 5 (five) hours before the time the Session is scheduled to commence. The Purchaser understands and accepts that, despite Rio 2016’s best efforts, it may not be possible to reissue a ticket, and that in no case will it be possible to reissue lost or stolen Ticket without an official police report.

    12.     Session Schedule Changes, Interruptions, and Cancellations.

12.1 Purchasers acknowledge that Sessions may be delayed, postponed, or cancelled. The Purchaser’s and Ticket Holder’s recourse in such situations is outlined in the Rio 2016 Ticket License Agreement and Spectator Policy.

12.2 Should the Purchaser be entitled to a refund due to a cancellation or postponement, under the conditions defined in the Rio 2016 Ticket License Agreement and Spectator Policy, they may apply for a refund according the provisions of clause 13 of these Terms and Conditions.

    13.     Refund Procedures

13.1 There will be no on-site refunds, including at the official Rio 2016 box offices or ticket centres.

13.2 Any refund request will be processed by Rio 2016 or the ATR, depending on from whom the original Tickets were purchased.

13.3 If entitled to a refund from Rio 2016, the Purchaser may, at the discretion of Rio 2016, be required to return to Rio 2016 all unused original tickets for the Session (in the cases where the Tickets were printed and delivered or collected) accompanied by a signed application refund form, which must be received by Rio 2016 no later than September 30, 2016. Refund application forms will be available online at rio2016.com.

13.4 If entitled to a refund from an ATR, the Purchaser must contact the ATR from whom the original Tickets were purchased and follow their refund procedures.

13.5 A Purchaser is entitled to refund and may apply for it in the situations described in the Rio 2016 Ticket License Agreement and Spectator Policy. In addition to the situations outlined in that agreement, the Purchaser has the right to request a refund according to the rules defined by Law N. 8.078, of September 11, 1990 the Brazilian Consumer Protection Code “CDC” in its article 49.

13.6 If entitled to a refund, Purchasers are solely responsible for recovering the Tickets from Ticket Holders and completing all the procedures described at www.rio2016.com, including returning the original Tickets to Rio 2016 or the relevant ATR (depending on from whom the original Tickets were purchased).

13.7 Any refund properly due from Rio 2016 under these Terms and Conditions will be provided via the same payment method used to make the Ticket purchase or as authorised and facilitated by Rio 2016. Rio 2016 shall endeavour to process all refunds promptly, but the Purchaser acknowledges that the completion of the refund process depends on the chosen payment method, on expiry of the relevant payment card as well as other conditions that are not known by Rio 2016 or the ATR (for example, the conditions agreed between the Purchaser and his or hers bank).

13.8 Refunds will only be made to the Purchaser, not to the Ticket Holder, and only for the face value price of the Ticket. This is the sole and exclusive remedy. There will be no exchanges of Tickets to another Session or refund of any applicable delivery charges, booking fees or other charges.

    14.     Personal data

The personal data that Purchasers provide to Rio 2016 will, subject to applicable law, be used, processed and stored by Rio 2016 in accordance with the terms of Rio 2016’s Ticketing Privacy Policy (full details of which are available at rio2016.com).

    15.     Resale, Reuse, and Transfer of Tickets

15.1 Purchasers acknowledge that Tickets shall not be purchased or obtained from or through any Person other than directly from an Authorised Ticket Source, and that Tickets may not be transferred or resold save it be in compliance with the restrictions laid out in the Rio 2016 Ticket Use Agreement and Spectator Policy. Any Tickets reasonably believed to have been purchased or obtained from or through Persons other than directly from Authorised Ticket Sources or transferred or sold otherwise than in accordance with these Terms and Conditions and those of the Rio 2016 Ticket License Agreement and Spectator Policy may be declared void, and may be seized or cancelled. In such a case, the Purchaser will not be eligible for a refund.

15.2 Any Person seeking to use a Ticket which is reasonably believed to have been obtained in breach of the terms and conditions of this Agreement and/or the terms and conditions of the Rio 2016 Ticket License Agreement and Spectator Policy in order to gain entry to or remain at a Session may be considered to be trespassing and may be denied entry to or ejected from the Venue, and may be subject to criminal or civil action.

    16.     Ticket Resale Programme – For Tickets Purchased From www.rio2016.com

16.1 The Ticket Resale Programme is open to general public Purchasers who have purchased Tickets directly from the Rio 2016 Ticketing Website. Tickets purchased in-person at a Ticket Box Office may not be returned for resale. Ticket Holders or Purchasers who have acquired their Ticket through any other channel or from an Authorised Ticket Source, including from Authorised Ticket Resellers, are not eligible to participate in the Ticket Resale Programme.

16.2 Under these Terms and Conditions, a Purchaser may apply to return Tickets for consignment re-sale by selecting eligible Tickets for eligible Sessions from their list of purchased Tickets associated with their account via the Rio 2016 Ticketing Website. Eligible Tickets will be returned to Rio 2016 inventory and made available for sale to other Purchasers on a consignment basis. The Purchaser will be reimbursed the face-value price originally paid by the Purchaser for any Tickets which are re-sold, excluding any delivery and fulfilment costs already incurred by Rio 2016. Consigned Tickets are offered for sale to other Purchasers on a best-available basis, and Rio 2016 makes no guarantee that any Ticket returned for re-sale via this programme will be sold to another Purchaser. This Programme does not operate as a consumer-to-consumer Ticket re-sale marketplace, and any such marketplace operating without the consent of Rio 2016 is a violation of these Terms and Conditions, and any Tickets re-sold in such an unauthorised manner are considered void and not valid for entry.

16.3 Rio 2016 will determine which Sessions and which types of Tickets are eligible for consignment re-sale, and Tickets and Sessions eligible for the Ticket Resale Programme will be indicated in the Purchaser’s listing of purchased Tickets in the Rio 2016 Ticketing Website. Rio 2016 may elect to change this list from time to time, for example, as the date of the Session draws near. The criteria used by Rio 2016 to determine which Sessions are eligible for re-sale is at the sole discretion of Rio 2016, and may vary by Sport, Venue, or date of the Session.

16.4 If the Purchaser returns Tickets for resale and those Tickets are resold, and those Tickets have already been delivered to the Purchaser by courier or collected by the Purchaser from a ticket box office, the Purchaser can either opt to:

        1.  Return their unused Tickets to Rio 2016 by registered mail. The reimbursement for the resold Tickets will be processed within 30 days of the receipt of the Tickets by Rio 2016.

        2.  Retain their invalidated Tickets. The reimbursement for any resold Tickets will be processed within 30 days following the end of the Games, between September 19 and October 19, 2016. If any attempt is made to use an invalidated Ticket to enter a Venue, then the Ticket Holder will be denied entry to the Venue, and the Purchaser will forfeit the right to any reimbursement for the resale of the Ticket.

If the Purchaser returns Tickets for resale and those Tickets are resold, and the Purchaser elected to receive those Tickets in a digital e-ticket format, then the reimbursement for the resale will be processed within 30 days following the end of the Games, between September 19 and October 19, 2016. If any attempt is made to access a Venue using an e-ticket which has been returned for resale by the Purchaser, then the Ticket Holder will be denied entry to the Venue, and the Purchaser will forfeit any right to reimbursement for the resale of that Ticket.

Knowingly distributing or attempting to use a Ticket which has been invalidated to access a Venue is a crime and may result in prosecution.

16.5 Once Tickets have been accepted and been made available for re-sale, Rio 2016 will notify the original Purchaser of such acceptance within 72 hours. Once consigned Tickets have been re-sold, Rio 2016 will attempt to notify the original Purchaser of the successful completion of the sale in a timely manner, but in any event, will notify the original Purchaser within 7 days.

16.6 Purchasers who purchased Tickets using a Visa credit card will be automatically reimbursed (where possible) for any Tickets successfully re-sold via the card used for the original Ticket purchase transaction. For cases where it is not technically possible to reimburse the card originally used to complete the Ticket purchase, the Purchaser will be contacted by Rio 2016 to arrange reimbursement via bank transfer or an alternative means of reimbursement.

16.7 Purchasers who purchased Tickets using a Visa credit card will be automatically reimbursed (where possible) for any Tickets successfully re-sold within 30 days of the successful completion of the transaction via the card used for the original Ticket purchase transaction. For cases where it is not technically possible to reimburse the card originally used to complete the Ticket purchase, the Purchaser will be contacted by Rio 2016 to arrange reimbursement via bank transfer or an alternative means of reimbursement.

16.8 All reimbursements will be processed between September 19 and October 19, 2016. Rio 2016 will make every effort to process reimbursements in a timely manner, but the period of time required for processing a reimbursement may vary depending on the Purchaser’s bank and reimbursement method and other factors not under the control of Rio 2016.

16.9 The Purchaser may elect to withdraw any consigned Tickets which have not yet been re-sold up until midnight two full calendar days before the commencement of the Session by contacting the Rio 2016 customer service centre and requesting that those Tickets be withdrawn from sale. For example, for a Session commencing on a Thursday at 13:00, the Tickets may be withdrawn up until Monday night at 23:59, with Tuesday and Wednesday being considered two full calendar days. In such a case, the Purchaser may be responsible for collecting physical replacements for those withdrawn Tickets from a Rio 2016 Ticket Box Office, and will be required to provide a government-issued photographic identification and the original Visa card used to purchase the Tickets in order to collect the replacement Tickets. Rio 2016 reserves the right to, at its discretion, issue replacement Tickets for those withdrawn from consignment by providing the Purchaser with digital or print-at-home Tickets, rather than by the re-issue of physically printed Tickets.

16.10 By applying to return Tickets for consignment re-sale, the Purchaser agrees that any returned Tickets which have not been sold by the time the Session commences may be used by Rio 2016 for non-revenue operational or charitable purposes, including but not limited to allowing access for family and friends of competing athletes to attend the Session, in order to avoid unused seats at the Session. In such a case, Rio 2016 will not collect any revenue for the allocation of the Tickets in question and the Purchaser is not entitled to any reimbursement for the same.

16.11 Purchasers applying to return Tickets for re-sale acknowledge that they will only be entitled to be reimbursed for the original amount paid by the Purchaser, whether full-price or discounted, should the Tickets be successfully re-sold, regardless of whether the Tickets are re-sold at a full or discounted price.

16.12 Purchasers acknowledge, by applying to return Tickets for re-sale, that any Tickets already issued, whether as physically printed or as digital or print-at-home Tickets, such Tickets shall be considered void and not valid for entry to a Venue. Purchasers further agree, by applying to return Tickets for re-sale, that any attempt to knowingly or unknowingly use or distribute for use such voided Tickets, may be considered a fundamental breach of these Terms and Conditions, and as such, the Purchaser shall not be entitled to any compensation resulting from the possible re-sale of such Tickets. The resale of invalid Tickets is a crime under Brazilian law.

    17.     General

17.1 Any information requests relating to Tickets should be addressed to the relevant customer service centre, the contact details of which can be found at rio2016.com or from the Authorised Ticket Source from whom the Tickets were obtained.

17.2 If Rio 2016 delays or fails to enforce any of these Terms and Conditions, or if an ATR or other Authorised Ticket Source fails to enforce any of these Terms and Conditions on behalf of Rio 2016, it shall not mean that Rio 2016 has waived its right to do so at any subsequent time.

17.3 If any of these Terms and Conditions cannot be enforced for any reason this shall not prevent the remaining provisions from continuing to apply.

17.4 These Terms and Conditions, together with the Rio 2016 Ticket License Agreement and Spectator Policy, together with any other contractual agreements between the Purchaser and Rio 2016 constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to the above cited agreements, which is not already set out in these agreements.

17.5 These Terms and Conditions have been drafted in Portuguese and translated to English. Translations of these Terms and Conditions to other languages may be made available by Authorised Ticket Sources. In the event of any discrepancy between the Portuguese and translated version of these Terms and Conditions, the Portuguese translation shall prevail.

17.6 These Terms and Conditions are governed by Brazilian Law and any disputes arising out of any transaction with Rio 2016 are subject to the exclusive jurisdiction of the Brazilian Courts.
