Thanks for these thoughts. Those 2 routes are possible but have the downside of being entirely transactional and precluding any possibility for the people of new state to deliberate together on its desirable constitutional structure

These are all very helpful and interesting further avenues. West Belfast was intentional on basis it raises same issues as West Lothian question but in the jurisdiction under discussion. Maybe unnecessary confusion?

There has to be some sort of democratic approval in the south but doesn't necessarily have to be a border poll. And there would have to be a constitutional referendum in the south at some point, given nature of necessary changes

Very helpful but I wonder about point 5. PM could claim that departure was authorised by A50 vote and it would be extension request that would amount to initiation of new action. Would be specious, but q for MPs opposed to no-deal is whether they trust new PM not to attempt it

Here is something I have written on constitutional issues that would need to be addressed if a border poll on Irish reunification were contemplated in Northern Ireland

This all seems plausible. In a no-deal exit, the 'no-deal' might be brief but the 'exit' would be long-term. Can't see other MSs agreeing to UK re-accession in absence of stable cross-party majority in favour in the UK. 20-30 years away if ever?

Even prospectively (new entrants) hard to justify. Why differentiate between drs, other graduates? Or all those who received secondary education? Why differentiate between those who leave and those who don’t work as drs in ire for other reasons (raise family / hate sick people)

You have a constitutional right to travel and also free movement rights under EU law. I don’t think any chance this could be imposed retrospectively....

Yep. It's up there with 'don't buckle your seat belts; we're refuelling the aircraft and you may need to run for your lives.'

Endpoint in that scenario is choice between giving into UK demands to split four freedoms or require Ireland to detach from SM and CU or risk the hard and uncontrollable border

Odpověď @nick_gutteridge
Because EU doesn’t want UK to be able to use threat of a hard (and probably uncontrollable) border in Ireland during negotiations over free trade agreement (as expiry of backstop approaches) 1/

Why Brexit is a security threat to island of Ireland in political, criminal and constitutional terms; and why, therefore, the backstop is absolutely necessary and supported by majority in Northern Ireland.
