There are two Notwithstanding powers: federal and provincial. The provincial power is alive and well, as we see today, thank heavens. I am less interested in the outcome of the use, than in the use itself. S33 distinguishes proper from improper uses. We must take the sweet with the sour. And if the outcome troubles us, the answer is to amend the constitution to foreclose that avenue. (Good luck, I know.)
