There are two Notwithstanding powers: federal and provincial. The provincial power is alive and well, as we see today, thank heavens. The federal power--unused since Patriation--remains in dire risk of desuetude. I wish Parliament would use it more frequently--or even just once.

I am less interested in the outcome of the use, than in the use itself. S33 distinguishes proper from improper uses. We must take the sweet with the sour. And if the outcome troubles us, the answer is to amend the constitution to foreclose that avenue. (Good luck, I know.)

My chapter with on "The Democratic Resilience of the Canadian Constitution" appears in this book on "Constitutional Democracy in Crisis": . But the book's title is wrong to imply that "constitutional democracy" must mean "liberal democracy."
