Interesting to hear 95% used 3rd party financing because conventional wisdom has been class actions are too risky for financing. A critical question would be _when_ it was sought and on whose behalf. Financing before certification seems tough; afterwards, perhaps not.

The Administration is currently asking a federal court to strike down the ACA's preexisting conditions protections. DOJ is defending other parts of the ACA, but specifically not that one. Would take Trump about 30 secs to call Sessions and order him to reverse course. He hasn't.

Especially when one of Attorney General Sessions' central arguments against nationwide injunctions is that they short-circuit the ordinary percolation of legal issues in the lower courts. That's not true to begin with, but it rings especially hollow when the government does this.

Why would the Supreme Court take DACA issue before the 9th, 2nd, 4th and 5th Circuits have a chance to weigh in? I don't get what the administration's argument would be for shutting down appellate consideration when there's no national emergency

Chief Justice Roberts tonight went out of his way to address the "contentious events in Washington" in recent weeks. Said he won't criticize the political branches but wanted to emphasize how the judical branch "must be very different". Very rare for him to comment.
