Are electronic signatures legal in India?
YES, eSignatures are legally binding and enforceable in almost every country in the world for almost any type of transaction. In India, contracts are generally valid if legally competent parties reach an agreement, whether they agree verbally, electronically or in a physical paper document. The Indian Information Technology Act, 2000 (IT Act) specifically provides for categories of electronic signature and digital signature, based on PKI technology. And while it provides extra weight to the latter, the IT Act specifically confirms that contracts cannot be denied enforceability merely because they are concluded electronically. Electronic records (whether or not they bear a signature) are admissible as evidence under Section 65B of the Indian Evidence Act, 1872, to support the existence, authenticity, and valid acceptance of a contract.
